Subsequently, on Octobec 26, 1995, Di~trict Justice Manlove entered another judgment in favor of plaintiff and against Defendants in the amount of $1,576.30 (John Sopensky v. Jim Lovett and Robin Villareal, Docket No. LT..462-95). 6. On or about December 17, 1995, plaintiff received from Defendant $1,200.00, for whlch he agreed to allow Defendants to remain in possession of "Premises.. Plaintiff did not agree to forfeit rlght to collect all rents, late payment penalties, and sewer and trash charges or any and all additional charges owing to that point. 7. After taking possession of Premises on J'une 1, 1995, Defendant failed to pal any and all of the monthly lease rent payments of $475.00 totaling $5,225.00 until faced with an impending eviction order; failed to pay any late payment penalties of $20.00 each month or $240.00; failed to pay sewer and trash payments of $23.00 per month or $276.00 as agreed upon in lease; and failed to pay Court costs totaling $435.10. The total of these amounts owed by Defendant as a result of their occupancy of Premises comes to $6,140.10 (A copy of said lease is attached as Exhibit "AN). 8. In August 1995, Defendants gave Plaintiff a diamond engagement ring and a gold medallion to hold as collateral until this judgment was aatisfied. 6. subsequently, on october 26, 1995, District Justice Manlove entered another judgment in favor of Plaintiff and against Defendants in the amount of $1,516.30 (John SODenskv v. Jim Lovett and Robin Villareal, Docket No. LT-462-95). 7. On or about December 13, 1995, Defendants gave to Plaintiff a check in the amount of $~200.00, which Plaintiff agreed to accept and did accept in complete satisfaction of all amounts Defendants owed him as of that date, including but not limited to the above-described district justice judgments and all rent, and Plaintiff returned to Defendants the collateral he had been holding. A copy of said check, which was given to Defendant Jim Lovett by his father, Colonel James H. Lovett (Ret.), is attached hereto, incorporated by reference and marked as Defendants' Exhibit "A". B. Plaintiff agreed to accept $1200.00 in settlement of his claims in consideration of defects at the rental premises which significantly reduced its value. 9. Moreover, on or about May 20, 1996, Defendant Jim Lovett's father gave Plaintiff a check for $475.00, based on their agreement that this payment would satisfy all amounts which were owed to Plaintiff by Defendants through May 1996 if Defendants vacated the premises by May 31, 1996, and an additional check in the amount of $120.00 to cover rent accruing through June 7, 1996, in the event Defendants were unable to move out by the end of May. 10. Defendants moved out of the rental premises on June 2, 1996, in compliance with the agreement between Defendant Lovett's father and Plaintiff. 11. Despite the fact that the judgments have been satisfied, plaintiff recorded the district justice judgment entered on July 27, 1995 with the Prothonotary, and has obtained a writ of Execution to enforce eaid judgment, pursuant to which the Cumberland County Sheriff has levied upon Defendants' personal property. A copy of the Writ of Execution is attached hereto, incorporated by reference and marked as Defendants' Exhibit "B".
