'II, I. / 'I ('"j 7, "- COMPLAINT IN ~SSUMPSIT AND NOW, comes the Plaintiff, COMMUNITY BANKS, N.A., by its Attorney, Allen Shaffer, and says: 1. The Plaintiff, COMMUNITY BANKS, N.A., is a corporation duly organized and validly existing under and by virtue of the laws of the United States of America, having its principal place of business situate in Millersburg Borough, Dauphin County, Pennsylvania. 2. Defendant, JEFFREY LYNN DERSHEM, is an adult individual whose last known residence address is 506 North Enola Road, Enola, Cumberland County, Pennsylvnaia 17025. 3. On or about January 31, 1995, the Defendant executed a Pennsylvania Motor Vehicle Installment Sale Contract in favor of the Plaintiff in the principal amount of $8,415.04, with an interest rate of 12.90% and being secured by a 1990 Dodge Dakota, Ex-Cab Truck, VIN #lB7FL23G8LS645350; said Contract provides for a collection of reasonable attorney fees. A copy of said Contract is attached hereto and marked as Exhibit "A". 4. The May 20, 1995, Dakota Ex-Cab Defendant failed to make the installment payment due for the loan which had been secured by a 1990 Dodge Truck, as well as the payments due thereafter. on 5. On or about December 26, 1995 notice was sent to Defendant i.nforming him the 1990 Dodge Dakota Ex-Cab Truck had been repossessed. The Notice provided the Defendant with the amount due and owing and the location where the vehicle was being stored. The Notice also informed the Defendant the vehicle would be sold 15 days after the December 26, 1995 date. See Exhibit "B", attached hereto. 6. On or about January 26, 1996, notice was forwarded to Defendant setting forth the amount received from the sale of the 1990 Dodge Dakota Ex-Cab Truck and the deficiency balance. See Exhibit "CO, attached hereto. 7. The Defendant has made certain payments, and/or received credit for the sale of the 1990 Dodge Dakota Ex-Cab Truck, on the account; the principal amount (pay-off) remaining due, as of February 6, 1996, on the loan which had been secured by a 1990 Dodge Dakota Ex- Cab Truck, is $6,887.)9, adding the 20\ reasonahle attorney fee of $1,)77.48 thereto, brings the balance due to $8,264.87, plus interest (rom February 6, 1996, at the rate of 12.90\ per annum, ~ate charges and cost of suit. 8. Plaintiff avers that the Defendants continue to owe the Plaintiff the sum of Eight Thousand Two Hundred Sixty-four and 87/100 ($8,264.87) Dollars, plus interest, late charges and costs of suit, WHEREFORE, Plaintiff demands Judgment in favor of Plaintiff and against the named Defendants in the amount of $8,264.87; together with interest thereon at the rate of 12.90%, from February 6, 1996, late charges, and costs of suit. . r _ / ",// ~,. ~....
