The plaintiff, Phyllis IN, Moos!!, is an individual residing at 151)0 Newville Road, Carlislt>, Cumberland County, Pennsylvania. 2. The defendant, John W. Keim, 15 an individual residing at 567 "E" Street, Carlisle, Cumberland County, Pennsylvania. 3. On or about March 19, 1994, at approximately 2:30 P.M., the plaintiff was a passenger in a vehicle operated by her husband, Russell F, Moose, in an easterly direction on TrindIe Road. 4. A3 the Moose vehicle was passing the Carlisle Plaza Mall, in the Borough of Carlisle, Cumberland County, Pennsylvania, the defendant pulled out from one of the exit ways, directly into the path of the Moose vehicle. 5. As a direct and proximate result of the negligence of the defendant, an accident ensued. 6. The defendant was negligent in the following respects: (a) In failing to maintain a proper lookout; (b) In failing to drive within the assured clear distance ahead; (c) In failing to obey traffic control devices; (d) In failing to ascertain that it was safe to enter the roadway before doing so, and (e) In failing to yield to traffic on the through roadway. 7. As a direct and proximate result of the negligence of the defendant, the plaintiff, Phyllis W. Moose, was injured. Her injuries include, but are not limited to, celvical injury and/or aggravation of pre-existing conditions in the cervical spine. 8. As a direct and proximate result of the negligence of the defendant, the plaintiff has suffered, and will continue to suffer in the future, medical bills
