COMPLAINT IN MORTGAGE rORECLOSURE
UNITED COMPANIES LENDING CORPORATION, by its attorneys,
1<IMBERLY
McDANIEL, ESQUIRE, and THOMPSON, CALKINS , SUTTER
complains and says as follows:
1. Plaintiff is UNITED COMPANIES LENDING CORPORATION, a
corporation existing under the lawe of the State of Louisiana,
with a principal office and place of business located at 4041
Essen Lane, Baton Rouge, Louisiana 70809 ("United Companies").
3. Oefendants LOWELL B. THOMAS and ANNA M. THOMAS are adult
individuals whose last known addresses are 4 Scrafford street,
Shippensburg, Pennsylvania 17257 and 693 Ridge Road, Shippansburg,
Pennsylvania l7257, respectively.
3. Defendants executed and delivered to United Companies a
Mortgage dated July 26, 1994, which was recorded in the Recorder's
Office of Cumberland County, Pennsylvania, in Mortgage Book Volume
1236, Page 1054 ("Mortgage"). The Mortgage secures a loan in the
amount of $16,300.00 evidenced by the Note from Defendants to
United Companies dated July 26, 1994 ("Note"). True and correct
copies of the Mortgage and Note are attached
hereto
and
incorporated herein as Exhibits "A" and "B", respectively.
4. The Mortgage was assigned to Bankers Trust Company of
California by an Assignment of Mortgage recorded in the Recorder
of Deeds Office ot CUmberland County, Pennsylvania, at Mortgage
Book Volume 503, page 900. The Mortgage was subsequently
reassigned to United Companies by an Assignment of Mortgage dated
September 6, 1995 and recorded in the Recorder ot Deeds Office of
Cumberland County, Pennsylvania. True and correct copies of said
Assignments ot Mortgage are attached hereto and incorporated
herein as Exhibit "C."
5. The property subject to the Mortgage is located at 693
Ridge Road, Shippensburg, Southampton Township, CUmberland County,
Pennsylvania ("Property").
6. The Mortgage is in default by reason of the failure of
Defendants to make payments as provided for in tha Mortgage, and
by the terms of said Mortgage, the entire unpaid balance of said
principal sum, together with unpaid interest thereon, shall become
immediately due and payable.
7. Under the terms of the Mortgage, Detendants are also
liable to Plaintiff for attorney's fees and costs expended by
Plaintiff in the collections of the sums duo under the Mortgage.
8. Notice required by the Homeowners' Emergency Mortgage
Assistance Act, Act 91 (35 P.S. 1'1680.401c, et seq.), was mailed
to Defendants at their last known addresses on August lO, 1995. A
copy ot said Notice is attached hereto and incorporated herein as
Exhibit "D".
9. Defendants failed to meet with Plaintiff or an approved
consumer credit counseling agency within the period specified.
10. Pursuant to the provisions of the Loan Interest and
Protection Law, Act 6 of 1974 (41 P.S. 1402), Notices of Intention
to Foreclose Mortgage were mailed to Defendants on August 10,
1995.
A true and correct copy ot aaid Notice is attached hereto
and incorporated herein aa Exhibit "E".
11. The property subject to the Mortgage is described .s

John R. Thomas and Lydia M. Thomas, his wifer thence by
said other lands of John R. Thomas and Lydia M. Thomas,
his wite, North aeventeen (17) degrees torty-tive (45)
minutea zero (00) seconds West three hundred seventy-
nine and torty hundredths (379.40) feet to a railroad
spike aet in the center ot Legislative Route 21006 (also
known as the Ridge Road), thence along the center line
ot said roadwar North tifty-nine (59) degrees forty-
three (43) m nutes thirty-five (35) seconds East one
hundred ten (110) teet to a railroad spike eet, thence
by lands now or formerly of Harold W. Burkholder South
seventeen (17) degrees torty-tive (45) minutes zero (00)
seconds East three hundred seventy-nine and forty
hundredths (379.40) feet to an existing concrete
monument, thence by lands now or formerly of George E.
Finkenbinder south titty-nine (59) degrges forty-three
(43) minutes thirty-five (35) seconds West one hundred
ten (110) teet to an iron pin, the place of BEGINNING.
CONTAINING a total lot of 40,741 square feet and known
as Lot No. 4 as per subdivision draft prepared by Carl
D. Bert, R.S. dated December 2, 1981, reviewed by the
Cumberland County Planning commission on January 19,
1982, and approved by the Southampton Township,
Cumberland County Board ot Supervisors on September 27,
1982, said subdivision plan to be recorded.

additions 1601341E, which has been aftixed into real
estate by Lowell B. Thomas and Anna M. Thomas, his wife,
with the intent that it become part of the real estate
conveyed hereby and subject to the lien of the Mortgage.
BEING known as 692 Ridge Road, Shippensburg, PA l7257
and designated in the Cumberland county, Pennsylvania
Deed Registry Office as Tax Parcel No. 39-10-0612-0028.
BEING the same property which John R. Thomas and Lydia
M. Thomas, his wife, granted and conveyed, by Deed dated
October 26, 1982, and recorded in the Office of the
Recorder of Deeds of Cumberland County at Deed Book
Volume 29-Y, page 380, unto Lowell B. Thomas and Anna M.
Thomas, his wife.
12. The following amounts are due on the Mortgage:

herein does not seek a monetary judgment against any Defendant in
thie proceeding. Plaintiff hereby reserves its rights, if any, to
proceed in a separate action under the Deficiency Judgment Act, 42
Pa. C.S.A. 18103.
WHEREFORE, Plaintiff
prays
this
Honorable
Court
to
enter judgment in mortgage foreclosure for the amount of SIXTEEN
THOUSAND SIX HUNDRED SIXTY AND 75/100 ($16,660.75) DOLLARS, plus
additional interest and late charges at the contract rate and tax
and insurance payments and escrow charges from February 1, 1996,
and for foreclosure and sale of the mortgaged property.

promptly installments of principal and interest, as required, for
