4, As ot the date this Motion to Compel, Plaintiffs have not received a
response to the Interrogatories.
5. Pursuant to Rule 4006 ot the Pennsylvania Rules of Civil Procedure,
parties must respond to Interrogatories within thirty (30) days of service of such
Interrogatories, A response includes either an answer or an objection.
6. Over thirty (30) days has passed since Plaintiffs served Defendant with
the Interrogatories,
7. Plaintiffs have also scheduled the deposition of Charles E. Widmer on
two occasions, February 4, 1997 and April 23, 1998, On both occasions Defendant
tailed to appear without giving any excuse or explanation tor his non-appearance.
S, Plaintiffs believe, and therefore aver, that the information which will be
gained by responses to the Interrogatories and taking of the Deposition of the
Defendant is necessary and vital in order for them to properly litigate their claim,
WHEREFORE, Plaintiffs, Phyllis J, Myers and Paul G. Myers, respectfully
request that this Honorable Court issue an Order compelling Defendant, Charles E.
Widmer to respond to Plaintiffs' Interrogatories and to attend a deposition of the
Defendant to be conducted on June 10, 1998 at 10:00 a,m, at the Offices of Handler
