On June 28, 1993, the Defendants filed a fictitious name registration with the
Commonwealth of PeMsylvania and did business using the name BolB Construclion and Home
Improvement Company.

In Late March, 1995, Plaintiff's and Defendants entered into a contract under which
Defendants were 10 construct a 16 fOOl by 26 fOOl basement and two (2) 16 fOOl by 26 foot room
additions for a total price of twenty-nine lhousand one hundred and twenty-two and 70/100
($29,122,70) dollars. A copy of the agreement is attached hereto and marked as Exhibit "A" and
made a part herewith.

The contract called for the following specific items:
(a) Dig basement 16 x 26 with 12" block, as per code. 4" 3500 PSI concrete floor,
and cut doorwllY in block as per customer.
(b) Room addition 16 x 26 over basement, 2 x 10 floor joisl, 16" on center and 3/4"
tongue and grove floor system.
(c) 2 x 4 wall studs 16" on center with double plates. R-II insulation in side walls and
R-30 in ceiling elect as per code. Drywall taped and finished paint (choice of color) exterior
plywood corners with 1/2 tongue and grove slyro foam insulation and vinyl siding (choice of
color)
(d) Room addition 16 x 26 second story 2 x 10 floor joist 16" on cenler and 3/4
tongue and grove floor system.

(e) 2 x 4 wall studs 16" on center wilh double plates. R-11 insulation in sidewalls and
R-JO In ceiling, elect as per code. Drywall taped and finished paint (choice of color) exterior
plywood corners with 1/2 longue and groove styro foam insulation and vinyl siding (choice of
color);
(I) Re-side entire house with vinyl double 4 siding (choice of color); and
(g) Re-roof entire house with J tab 25 year Owens Corning shingle includes
replacement of bad wood.
(h) Two room additions 10 include:
Elec:tric as per code
Insulation R-Il sidewalls, R-JO ceiling
1/2" drywall taped and finished
Painl choice of colors
All base and window lrim
Interior doors (2)
Closels with rods and shelves (2)
Double 4 siding vinyl
(4) windows
Gutters and down spoulS, entire house

The Defendants improperly performed lhe work and the construction was merked by
serious material defects and deficiencies which include the following:
(a) Painting nol completed; crack in wall nol repaired;
(b) Dry wall nol taped and puttied; painting not completed; electric work incomplele
and not to code; entire room not finished;
(c) Dry wall not taped and puttied; painting nol completed; electric work incomplete
and nol to code; closet not installed;
(d) Outside insulation and vinyl siding not installed;
(e) Vinyl siding not installed on entire house;
