THE MASTER: Today is Tuesday, May 11, 1999, This
is the date set for a Master's hearing in the
above-captioned divorce proceedings,
Present in the hearing room are the Plaintiff,
Daniel J, Taylor, and his counsel, Richard C, Rupp,
Present with the Plaintiff is Martha Taylor, Daniel
Taylor's mother, Also present in the hearing room is the
defendant, Barbara E, Taylor, and her counsel, Jeff
Foreman,
A divorce complaint was filed on March 6, 1996,
raising grounds for divorce of irretrievable breakdown of
the marriage, Counsel are going to have their clients sign
an affidavit of consent and waiver of notice of intenti0n
to request entry of divorce decree, which documents will be
filed with the prothonotary within one week of today's
date, The divorce will then be able to be concluded under
Section 3301(c) of the Domestic Relations Code,
No economic claims were raised in the complaint,
however, on December 16, 1996, the defendant filed an
answer and new matter raising the economic claim of
equitable distribution. The claim of equitable
distribution is the only issue pending before the Master,
The parties were married on September 1, 1990 and

separated february 27, 1996, This is the first marriage
for both parties and there were no children born of this
m~rriage.
The Master has been advised that the parties have
reached an agreement with respect to the equitable
distribution claim, An agreement is going to be placed on
the record in the presence of the parties and counsel. The
agreement as stated on the record will be considered the
substantive agreement of the parties not subject to any
changes or modifications, except for correction of
typographical errors which may be made during the
transcription, The parties and counsel are going to return
tomorrow morning to review the draft of the agreement for
correction of typographical errors, make any corrections as
required, and affix their signatures by way of affirmation
of the terms of the agreement which are being placed on the
record at this time,
After the Master has been provided the signed
agreement and the affidavits and waivers have been filed,
the Master will prepare an order vacating his appointment
and counsel can file a praecipe transmitting the record to
the Court requesting a final decree in divorce,
Mr, Rupp,
MR, RUPP: Thank you, Mr. Elicker, The parties have
agreed, Mr, Elicker, that:
1, With respect to a cabin on the Susquehanna River on
Beach Island in Dauphin County, Pennsylvania, said
cabin will be transferred from wife to husband and
that the wife agrees to execute any and all
documents necessary to effectuate the transfer of
the said cabin from wife to husband.

2. In consideration of the same, husband agrees to
accept responsibility for any and all claims or
debts of a contractor who repaired and refurbished
said cabin. And husband further agrees to
indemnify and save wife harmless from any such
claims or debts of the contractor for the repair
and refurbishing of said cabin,
3. With respect to an escrow account which was opened
by Attorney Jeff Foreman, which included proceeds
from the sale of the parties' residence and further
includes approximately $14,000.00 in proceeds from
a FEMA distribution for flood insurance damages,
less approximately $3,000,00 distribution to each
of the parties, said escrow account shall be
di~tributed as follow~:
$15,000,00 of said escrow account shall be
distributed to the wife, and the balance of the
said escrow account shall be distributed to
husband.
In consideration of the said distribution,
husband agrees to accept responsibility for any and
all debt owed to Mrs. Martha Taylor arising out of
the parties' marriage, and husband agrees to
indemnify and save wife harmless from such claims
or debts owed to Mrs. M~ha Taylor.
3, The parties owned a 1993 Misty Harbor 24-foot
pontoon boat with motor. Said boat shall be
transferred to wife from husband. Husband agrees
to effectuate any documents necessary to transfer
the same.
In consideration of the transfer of said boat to
wife, wife agrees to accept responsibility for any
and all debt concerning or pertaining to the
financing or purchasing of said boat, including but
not limited to a PSECU loan or line of credit.
Wife ag.ees to indemnify and hold husband harmless
from any and all debt relating to the p~rchase or
financing of the boat, including the PSECU loan or
line of credit. If the husband's name is still on
the PSECU loan or line of credit, wife agrees to
cause husband's name to be removed same loan,
4. Husband agrees to transfer to wife a certain
full-length mirror that was left in the parties'
marital residence by wife to the wife.
5. With respect to wife's pension, wife shall retain
her full interest in the pension. With respect to
husband's IRA, husband shall retain his full
interest in said IRA account.

6, With respect to the vehicles, the parties shall
retain each of their vehicles.
7, With respect to property, furnishings and cash, or
other possessions already in each parties'
possession, each party shall retain full and
complete possession of such property, furnishings,
cash and other possessions; and any and all claims
of each spouse against the other or debts,
etcetera, against each spouse shall be otherwise
cancelled,
MR, FOR8MAN: I want to more particularly identify
that escrow account because in all the previous filings,
the escrow is identified by an account number at CoreStates
Bank; and it is now First Union Bank with a new account
number, The new account being 3014130650779,
(Whereupon, Mr. Rupp continued:)
8. Furthermore, except as herein otherwise provided,
each party may dispose of his or her property in
any way and each party hereby waives and
relinquishes any and all rights he or she may now
have or hereafter acquire under the present or
future laws of any juriSdiction to share in the
property or the estate of the other as a result of
the marl tal relationship including without
limitation, statutory allowance, widow's allowance,
right of intestacy, right to take against the will
of the other, and right to act as administrator or
executor in the others' estate, 8ach will at the
request of the other execute, acknowledge, and
deliver any and all instruments which may be
necessary or advisable to carry into effect this
mutual waiver and relinquishment of all such
interests, rights, and claims.
MR. RUPP: Present at this conference table is my
client, Mr, Dan Taylor, Dan, have you heard what we have
stated on the record?
MR. TAYLOR: Yes, I did.
MR. RUPP: Are you in agreement with the
substantive terms that we have placed on the record?
MR, TAYLOR: Yes, I am.

allowed to change any substantive item after today?
MR. TAYLOR: Agree.
MR. RUFF: And we will come back and sign the
stipulations of settlement later this morning or early this
afternoon,
MR. TAYLOR: Okay,
THE MASTER: You understand that when you leave
this room, you can't make any substantive changes, that the
agreement is on the record, and that the signatures that
you are going to affix are simply to affirm what you have
already agreed to,
MR. TAYLOR: Understood, sir.
THE MASTER: Do you understand the terms of the
agreement?
MR. TAYLOR: Yes, I do,

MR. E'OREMAN: Mrs, Taylor, you have heard the
agreement that we put on the record this morning?

agreement that we agreed to through negotiations this
morning?

RE: Pre-Hearing Conference Memorandum
DATE: Wednesday, December 9, 1998
Present for the Plaintiff, Daniel J. Taylor, is
attorney Richard C. Rupp, and present for the Defendant, Barbara
E. Taylor, is attorney Jeff Foreman.
A divorce complaint was filed on March 6, 1996,
raising grounds for divorce of irretrievable breakdown of the
marriage. counsel have indicated that the parties will sign and
file affidavits of consent and waivers of notice of intention to
request entry of divorce decree prior to the hearing to be
scheduled. On December 18, 1996, the Defendant filed an answer
and new matter raising the economic claim of equitable
distribution. There have been no other economic claims raised
in the proceedings.
Husband is 39 years of age and Mr. Rupp is going to
provide us an address so we can send him a notice of the hearing
date. Mr. Taylor lives with a female friend. He is a high
school graduate and has some college courses and is currently a
director of services at Cumberland Valley Motors. He had
previously been employed by Baker Motor Company as a service
manager. Mr. Rupp indicated that his income is less than what
he had been earning at Baker Motor Company and he will file an
updated income and expense statement. Mr. Taylor has not raised
any health iS3ues and he does have medical insurance coverage
through his employment.
Wife is approximately 40 years of age and resides
at 701 Ridge Road, Lewisberry, Pennsylvania, 17339 with a male
friend. She is a high school graduate and currently works for
the Departement of Education, Commonwealth of Pennsylvania as an
administ.rative assistant. Her net income monthly is $1,695.40
but Mr. Foreman indicated that he will update that information
as she may have had an increase since the previously filed
statement. Wife has not raised any health issues. She also has
medical insurance coverage through her employment.
The parties were married on September 1, 1990, and

separated February 27, 1996. This is the first marriage for
both parties and there were no children born of this marriage.
The parties sold the real estate which they owned
at 25 Pheasant Road, Mechanicsburg, Pennsylvania, and each took
a partial distribution from the proceeds of $3,000.00. There is
a balance in the escrow account of $46,380.95 as of June 30,
1998. The escrow funds also include some other monies that were
received by the parties and added to the proceeds from the sale
of the residence. Counsel are requested to provide a breakdown
as to what other funds went into that account.
The parties lease a cabin on Beach Island, Dauphin
County, and apparently agree that the value of the cabin is
$16,000.00 but do not agree that there is a net value after a
contractor's lien of $6,000.00. The disagreement involves the
validity of a contractor's lien or a claim by a contractor
Anthony G. Sferlazza. In addition to the dispute over whether
or not Mr. Sferlazza is owed any money is also the claim that he
had use of the property in consideration for repairs that he
made on the property after a flood. Also, substantial sums of
money were received from FEMA as a result of the flood damage.
Perhaps some of those funds were placed in the escrow account
but we need to have that verified. Consequently, testimony will
have to be offered by the contractor as to the basis for any
claims which he is making and obviously we will hear testimony
of the parties regarding the relationship with the contractor
involving the repairs and his use of the cabin.
The parties own a 1988 Plymouth Horizon and counsel
have indicated that the market value is around $l,800.00. Mr.
Foreman has used a wholesale value as well on his pre-trial
statement of $1,000.00. The 1995 MaZda 626 is a leased vehicle.
The parties owned a 1993 Misty Harbor 24' pontoon
boat which wife has taken possession of and sold for $1,000.00.
Husband has an appraisal Showing the boat was worth $7,000.00.
Wife is claiming charges and repairs to the boat. We will have
to have testimony on the value of the boat and once that value
is established, that value will be charged against wife since
the boat will be distributed to her as part of the equitable
distribution.
Wife has a pension with the Commonwealth of
Pennsylvania and the number provided is not apparently the
of that pension but probably represents her contributions.
any event, in order to verify the value, Mr. Rupp is going
have her pension evaluated by a pension appraiser.

Husband previously was employed, as noted, by Baker
Motor Company and when he left that employment in October of
1998 he received a severance check representing his interest in
the pension. Mr. Rupp claims that the marital portion of that
pension is around $11,000.00. The marital portion will be
updated with an interest factor to the date of distribution.
The parties have some dispute with respect to
household tangible personal property. Husband Bays that wife
got $3,000.00 worth of property taking mostly all of the marital
assets leaving him with his premarital assets. In order to try
to resolve this issue, counsel are going to have each of the
parties make lists, obtain an appraisal if necessary, and also
have the parties note on the list whether the property indicated
is marital or premarital.
Near the time of separation, husband claims that
wife used his credit card and made $2,000.00 worth of charges on
the card for her own personal benefit. Husband should try to
verify what the charges consisted of since wife is denying using
the card for her own purposes. Husband also claims that wife
took $700.00 from a checking account which she used exclusively
for her own benefit.
At the time the parties purchased the real estate
at 25 Pheasant Road, Mechanicsburg, Pennsylvania, husband's
mother signed a statement indicating she was gifting to husband
$30,000.00 which was a contribution to allow him to obtain the
financing necessary to purchase the home. Husband is claiming
that he should be given some consideration in the equitable
distribution percentage based on his substantial contribution by
way of the gift from his mother to the marital asset. In
addition, there are two loans owed to Plaintiff's mother by the
parties which they have been paying on. The balance may be
currently around $12,500.00 and counsel are going to provide
verification of the loans and the balance as of separation. If
any payments have been made on the loan since separation, then
the party making the payment should be entitled to some credit
on account of the payments made in the final computation of the
debt and allocation of the debt.
The loans which Mr. Taylor claims were made by his
mother to the parties are in dispute by wife. Any verification
or documentation of those loans should be provided as well as
any testimony which husband's mother or the parties want to
offer on that issue. Verification of payments on those loans as
claimed by husband should also be provided specifically if those
payments were made during the time the parties were living
together.

8, PROPOSED RESOLUTION OF ECONOMIC ISSUES.
A, Defendant to receive the panies' boat. Plaintiff conlends !hat any
liabilities or storage expenses claimed by Defendant arose while boat was in
exclusive possession and control of Defendant and without Plaintiffs consent, and are
therefore the responsibility of the Defendant. Said boat has an estimated value 0($7,000,
Defendant 10 receive her pension having an estimated value for marital property
purposes of $ 21,300, based on Defendant's information.
Defendant 10 receive credit for $700 from the panies' joint checking account which
Defendant received,
Plaintiff 10 receive credit for $2,000 Defendant made in purchases using Plaintiffs
credit card.
Defendant 10 receive the furnishings and furniture and other personal property
Defendant received from the parties' household. Said items have an estimated value of
$3,000.
Pefendant to receive her automobile having a value of $1,800.
Defendant to receive $6,250 from the panies' escrow account.
The approximate value of the property or credit or cash to be retained or
transferred to Defendant is $42,050,
B. Plaintiff to receive the panies' cabin having an estimated value of $16,000
but subject to claims of a contractor for post-flood restoration. Said cabin having a net
value of approximately $6,000 after talcing the claim of the contractor into consideration.
The Plaintiff to receive his distribution of his pension, having an estimated marital
property value of $11,000. (To be provided.)
The Piaintiffto receive $28,750 from the parties' escrow account, assuming
said escrow account is $47,500.
The approximate value of the property or credit or cash to be paid, retained by or
transferred to Plaintiff is $45,750,
C. The panies owe the Plaintiffs mother, Martha Taylor two loans. One loan
is for tt,., approximate sum of $1,200. The other loan is for the approximate sum of
$11,300. Said loans were made by Plaintiffs mother to the panies during their marriage-
with the intent!hatlhey be repaid to Plaintiff smother. The Plaintiff proposes that these
joint loans be paid from the panies' escrow funds,
D, This proposed resolution resolves and repays the parties' loans from
Plaintiffs mother. This proposed resolution allows the Defendant to retain
assets in her possession or to be Iransferred to her lotaling the approximate value
$42,050, which constitutes half of the panies' marital assets less $1,850, And, it proposes
