Dear Ms. Verney and Mr. Gilroy:
By order of Court of President Judge George E. Hoffer
dated August 6, 1998, the full-time Master has been appointed in
the above referenced divorce proceedings.
A divorce complaint was filed on March 6, 1996, raising
grounds for divorce of irretrievable breakdown of the marriage.
No economic claims were raised in the complaint.
On August 4, 1998, the Plaintiff filed an amended
complaint raising the additional grounds for divorce of
indignities and the economic claims of equitable distribution,
alimony, alimony pendente lite, and counsel fees and costs.
On October 8, 1997, the Plaintiff filed an affidavit
under Section 3301(d) averring that the parties separated on or
about August 22, 1995, a period of at least two years. In
response to the affidavit under Section 3301(d), the Defendant
filed a counter-affidavit on November 17, 1997, indicating that
he opposes the entry of a divorce decree because the parties
have not been separated for a period of at least two years and
because the marriage is not irretrievably broken. He also
indicated that he wished to raise economic relief but has not
filed any economic claims on his own behalf.
It appears that we may have an issue with respect to the
date of separation, however, I am going to proceed on the basis

marital property and that Defendant be assessed for all property dissipated by him prior to

10. Plaintiff lacks sufficient property and income to provide her with a reasonable income
and cannot adequately suppon herself during the divorce proceedings and after the
entry of a divorce decree.
II. Defendant has a far more economic superior position than Plaintiff and Plaintiff
requires reasonable support to adequately maintain herself.
WHEREFORE, Plaintiff prays your Honorable Coun to award alimony pendente lite
ud alimony as detennined appropriate by the Court.

13. Plaintiff has employed counsel but is unable to pay the nece!lSlry and reasonable
anorney's fees in order to adequately defend her interests in the above-captioned
maner.
14. Plaintiff has incurred certain costs in prosecuting this action and will likely incur
additional costs and expenses in valuing marital assets, attending hearings and court
proceedings.
15. Defendant is in a far more economic superior position than plaintiff and has sole
access and control of the marital assets.
WHEREFORE, plain\iffprays your Honorable Court to award counsel fees, costs, and
expenses as the Court deems appropriate.
