WHEREAS, KOLLAS AND COSTOPOULOS, of 1104 Femwood Avenue, Camp Hill,
Cumberland County, Pennsylvania, hereinafter referred to as Owner, is about to execute
contemporaneously herewith, a contract, with NICKEL HOMES, L.L.C., of East Berlin, Adams
County, for the erection of a house ancillary to development in a complex known as Westgate
Development, Phase ]~I, South Middleton Township, Cumberland County, Pennsylvania,
construction described as follows:
ALL THAT CERTAIN tract or parcel of ground known as and designated as Lot 4 as
shown on the Final Subdivision Plan for Westgate, Phases 3 and 4 recorded in the Office of the
Recorder of Deeds in and for Cumberland County, at Carlisle, Pennsylvania, in Plan Book 81,
Page 15.
NOW, this 10th day of September, 2002, at the time of and immediately before the
execution of the principal contract dated the 10th day of September, 2002, and before any
authority has been given by the said Owner, to the said Contractor to commence work on the said
building, or purchase materials for the same in consideration of the making of the said contract
with Owner, and the further consideration of One Dollar and 00/100 ($1.00), to Contractor paid
by Owner, it is agreed that no lien shall be filed against the building by the contractor, or any sub-
contractor, nor by any of the material men or workmen or any other person for any labor, or
materials purchased, or extra labor or materials purchased for the erection of said building, the
right to file such liens being expressly waived.

described as follows, to w~t:
Beghming at a point on the western night-of-way line of Westgate Drive at the line of
Lot No. 3, sa/d point being located the following four (4) courses from the northern night-of-
wa.; line of West Pine Street 1) by a curve to the left, having a radius of twenty-five feet
(R:25.00'), an arc distance of thirty-nine and twenty-seven hundredth feet (A~L=39.27'); 2)
by a curve to the lea, having a radius of one hundred ninety-three and six hundredth feet
(R=193.06'), an arc distance of fifty and four hundredth feet (AIL=50.04'); 3) North
fourteen degrees, zero n~mtes, zero seconds East (N 14° 00' 00" E), a distance of two
hundred seventy live and thirty-seven hundredth feet (275.37'); 4) by a curve to the left.

distance of one hundred thirty-one and eighty hundredth feet (131.80') to a point on the line
of land now' or late of Edward Oliveria; thence by said land North fifteen degrees, forty-
seven minutes, fifteen seconds West (N 15° 47' 15" WV), a distance of fifty-eight and twenty-
eight hundredth feet (58.28') to a point; thence by Lot No. 5 North eighty-one degrees,
thirty nflnutes, zero seconds East (N 81° 30' 00" E), a distance of one hundred forty-six and
sixteen hundredth feet (146.16') to a point on the western right-of-way line of Westmate
Drive; thence by said right-of-way, by a curve to the right, having a radius of three hundred
