AND NOW comes Plaintiff. Harris Savings Bank by and through its counsel Richard C,
Ruben. Esquire and states the following in support of its Motion:
1. PlaintifflMovant is Harris Savings Bank ("Harris". formerly Harris Savings Association)
a Pennsylvania Banking Corporation organized and existing under the laws of the
Commonwealth of Pennsylvania and having its principal place of business at Second and
Pine Streets, Harrisburg, Pennsylvania 17101
2, Defendants/Respondents are Dwain K. McLaughlin and Susan M. Wolf, adult individuals
and mortgagors of a multi-family residence at 239 Lincoln Street, Carlisle, Cumberland
County. Pennsylvania 17013.
3, That on March 6, 1996, Harris filed a Complaint in Mortgage Foreclosure with respect
to the McLaughlin/Woifs property due to a default in their mortgage recorded at Record
Book 1004. Page 105,
4, That Judgement was entered on May 22, 1996 on Harris' Complaint against the individual
defendants and the matter set for Sheriff Sale on September 4. 1996.
5, That prior to the scheduled Sheriffs Sale the Defendants, Dwain K, McLaughlin and
Susan M, Wolf brought the mortgage current pursuant to the provisions of Act 6 of 1974,
6, That pursuant to Act 6 of 1974, 41 P,S, ~404. Right 10 ClIre a Default Defendants'
mortgage was restored to the same position as if the default had not occurred.
7. That in order to evidence Harris' compliance with Act 6 provisions and in order to
reinstate the mortgage without prejudice to Plaintiff or Defendants the parties desire to
evidence said fact and strike the j udgmcnt in mortgage foreclosure entered to the above
referenced term and number,
WHEREFORE, Harris Savings Bank request this Honorable Court enter an Order in the
form of the attached:
a. Reinstating the mortgage of Dwain K, McLaughlin and Susan M. Wolf to Harris
Savings Bank effective September 3, 1996 to the same position as if default had
not occurred; and
b, Striking the Judllment in Mortgage Foreclosure in favor of Harris Savings Bank
and against Dwam K, McLau~hlin and Susan M, Wolf without prejudice to Harris
Savings Bank to enforce its nghts under the mortgage in the future.

and states the following in support of its complaint:
1. The plaintiff is Harris Savings Bank, tormerly Harris SavingB
Association, hereinafter "Harris", a corporation organized and
existing under the laws of the commonwealth ot pennsylvania and
having its principal place of Dusiness at Second and pine Streets,
HarrisDurg, pennsylvania 17101.
2. The Defendants are Dwain K. McLaughlin, an adult individual
whose address is 1841 Avenue G. scottsDluff, NE 69361 and susan M.
Wolf, an adult individual whose address is 261 Arch street,
Carlisle, PA 17013.
3. That on or aDout March 1, 1991, Defendants executed a Note in
favor of Harris Savings Association in the principal amount ot
$47,500.00.
said Note was for the purpose of financing the
purchase ot a house situate 239 Lincoln street, Borough ot
carlisle, cumDerland county, carlisle, pennsylvania 17013. A true
and correct copy ~f the Note is attached hereto and incorporated
herein as Exhibit II A" ,

4. That the Note, Exhibit "A" i. .ecured by a Mortgage on 239
Lincoln street, Borough at Carlisle, Cumberland County, Carlisle,
Pennsylvania 17013 dated March 1, 1991 and recorded in the ottice
at Recorder ot Deeds Cumberland County, Pennsylvania in Record Book
1004, Page 105 on March 1, 1991, a copy at which is attached hereto
and incorporated herein as Exhibit "B".
5. That Harri. Savings Bank i. the holder at the Mortgage,
Exhibit "A" as the result of the conversion at Harris Savings
Association into Harris Savings Bank.
6. That Defendants are in default under the terms of the Note and
Mortgage in that they have failed to make monthly payments as
provided for in the Note and Mortgage for the months of November
and December, 1995 and January and February, 1996 and Plaintiff has
accelerated the debt pursuant to the terms ot the Note.
7. That in addition to the unpaid principal, accrued interest at
the contract rate at 9.25' until paid, reasonable legal fees which
are believed and alleged to be $2,383.00, costs of collection and
costs to preserve the collateral are due and payable.
8. Through February 29, 1996 the tollowing amounts are due and

9. That Detendants were given Notice ot their default and Harris'
intention to accelerate the debt under the terms ot the Note and
Mortgage on January 5, 19~6
10. The Plaintitt has given to the Defendants written notice of
intention to toreclose on said Mortgage as required by law under
Act 6, dated January 5, 1996, a copy ot which is attached hereto
and incorpol."ated herein as Exhibit "C".
11. The Plaintitt has given written notice ot detault as required
by the Homeowner's Emergency Assistance Act ot 1983, dated January
5, 1996 a copy ot which is attached hereto and incorporated herein
as Exhibit "0".
12. That written notice under the Homeowner's Emergency Assistance
Act ot 1983 is not required as this security property is tenant
occupied and not owner occupied.
WBBIlBJ'ORII. Harris Savings Bank demands judgment in it favor
and against Detendants Dwain K. McLaughlin and Susan M. Wolt in the
amount ot $50,042.84 plus costs and expenses necessary to preserve
the security and interest at the contract rate on the principal
balance trom February 28, 1996 until paid and costs of suit.
