5. On or about December 9, 1991, Plaintiff hired
Defendant to clean and inapect Plaintiff's chimney at 1079
Limekiln Road, New Cumberland, pennsylvania.
6. On or about December 9, 1991, Defendant cleaned
and conducted an inspection of Plaintiff's chimney. A copy of a
report reflecting this inspection is attached hereto and marked
as Exhibit "A".
7. As a result of this inspection, the following
recommendations and observations were made:
(a) Chimney needs to be repointed.
(b) H2 flu tile.
(c) Chimney needs to be relined; no liner at all.
(d) Top ceiling is wanted.

8. On or about December 18, 1991, Defendant provided
to Plaintiff a job estimate for the cost of Defendant performing
the above-listed repairs. A copy of this job estimate is
attached hereto and marked as Exhibit "B".
9. On or about October 14, 1992, Defendant completed
the relining and repairs of Plaintiff's chimney.
10. On March 12, 1994, a fire ignited in Plaintiff'.
walk-in fireplace and chimney.

COUNT I - BBGLIGBNCB
11. The averments set torth in Paragraphs 1 through 10
inclusive hereof are incorporated herein by reterence as it set
torth in their entirety.
12. The tire was caused by the negligent, careless and
reckless conduct of Defendant including, but not limited to the
following:
(a) tailing to p,roperly line the chimney;
(b) tailing to properly repair the chimney;
(c) tailing to use the appropriate lining necessary
tor the walk-in fireplace and chimney; and,
(d) tailing to utilize the appropriate materials and
methods used in the chimney relining and repairing industry.
13. Defendant's above-described negligent,
carelessness and reckless conduct resulted in the tire igniting
in Plaintiff's walk-in fireplace and chimney.
14. As a function ot Defendant's negligent, careless,
and reckless conduct, Plaintiff has suffered the following
damages:
(a) $3,165.00 in fireplace and chimney repair costs;
(b) $1,430.00 in clean up costs.
True and correct documentation of the above-referenced damages
are attached h6'>reto as Exhibit "C".

15. Plaintiff has demanded payment for the above-
referenced costs but Defendant has refused to pay for the
aforomentioned damages.
WHEREFORE, Plaintiff, William H. Reynolds, sr., demands
judgment in his favor and against Defendant, Jonathan J. Irwin,
d/b/a Chimney Sweep Systems, in the amount of $4,595.00, plus
interest, costs of suit and any and all other relief whic~ this
Court deems proper and just.

16. The averments set forth in Paragraphs 1 through 15
inclusive hereof are incorporated by reference herein as if set
forth in their entirety.
17. Defendant agreed to perform the above-listed
repairs to Plaintiff's fireplace and chimney.
18. Defendant either failed to perform said repairs or
did not adequately perform said repairs.
19. As a result of Defendant's breach of contract,
Plaintiff sustained damages in the amount of $4,595.00 plus
interests and costs, as described above.
WHEREFORE, plaintiff, william H. Reynolds, Sr., demanda
judgment in his favor and against Defendant, Jonathan J. Irwin,
d/b/a Chimney Sweep Systems, in the amount of $4,595.00, plus

interest, costs of suit and any and all other relief which this
Court deems proper and just.

12. The averments of paragraph twelve of plaintiffs complaint are specifically denied, On the
contrary. defendant provided quality materials and performed all services for plaintiff in a good and
workmanlike manner, in accordance with the standards and methods of the trade and in accordance with
the job estimate provided to plaintiff prior to the start of this project
13, The averments of paragraph thirteen of plaintiff's complaint are conclusions of law to which
no response is required. However, to the extent that a response is required, these averments are
specifically denied, On the contrary, defendant provided quality materials and perfomled all services for
plaintiff in a good and workmanlike manner, in accordance with the standards and methods of the trade
and in accordance with the job estimate provided to plaintiff prior to the start of this project Furthermore,
after reasonable investigation defendant is without knowledge sufficient to form a belief as to the truth of
the averments that any fire took place at plaintiff's residence or the cause thereof and proof thereof at trial
is demanded, If relevant
14, To the extent that the averments of paragraph fourteen of plaintiff's complaint allege that
defendant was negligent careless or reckless in the performance of his services for plaintiff, these
averments are conclusions of law to which no response is required, However, to the extent that a response
is required, these averments are specifically denied. On the contrary, defendant provided quality materials
and performed all services for plaintiff in a good and workmaniike manner, in accordance with the
standards and methods of the trade and in accordance with the job estimate provided to plaintiff prior to the
start of this project The remaining averments of this paragraph regarding plaintiff's alleged damages are
denied by reason that after reasonable Investigation defendant Is without knowledge sufficient to form a
belief as to the truth of these averments and proof thereof at trial is demanded, if relevant By way of
further response, defendant believes and therefor avers that any damages plaintiff may have suffered were
fully paid by his homeowner's insurance carrier.
15, The averments of paragraph fifteen of plaintiff's comp!alnt are admitted in part and denied
in part It is admitted that defendant received some notice of a claim regarding this project prior to recoiving
this complaint However, defendant specifically denies any and all liability for the payment of any damages
suffered or claimed to have been suffered by the plaintiff In regard to the materials and services provided to
plaintiff by the defendant By way of further response, defendant beiieves and therefor avers that any
damages plaintiff may have suffered were fully paid by his homeowner's insurance carrier,
WHEREFORE, defendant demands that plaintiffs complaint be dismissed and that
judgment be entered on behalf of the defendant and against the plaintilf.
COUNT II - BREACH OF CONTRACT
