AMENDED COMPLAINT
AND NOW, come the Plaintiffe, Edward and stephanie stence, by
and throuqh their attorneys Goldberq, Xatzman , Shipman, P.C., to
file this Complaint and, in support thereof, state .e followe:
1. Plaintiffe, Edward and Stephanie stence, are adult
individual., husband and wife, residinq at 1016 Tunbridqe Lane,
Mechanicsburq, CUmber.land County, Penneylvania, 1705~.
~. Defendant, MCRR Mechanicals, Inc. d/b/a The New C.W.
Fritz Co., ("C.W. Fritz"), is orqanized and existinq under the lawe
of the Commonwealth of Pennsylvania with a place of bueiness at 9
Brenneman CirCle, Mechanicsburq, cumberland County, pennsylvania,
17055.
3. The Defendant, Century Spoutinq Co., Inc., ("Century
Spoutinq"), is a corporaticn organized and existing under the law.
of the Commonwealth of Pennsylvania with a place of business at
2141 South Market street, Elizabethtown, Dauphin county,
p.nn.ylvania, 11022.
4. In February, 1994, plaintiff. own.d real ..tate located
at 123 M.adow Lane, ca.p Hill, cumberland county, P.nn.ylvania,
11011 ("Pre.i...").
5. In approximately F.bruary, 1994, plaintiff. .ntered into
a contract with C.W. Fritz und.r which C.W. Fritz would furni.h and
in.tall a h.ating .y.t.. in the Pr..i.... "hi~it A attach.d her.to
i. a copy of the docum.nt. provid.d to Plaintiff. from C.W. Fritz.
Plaintiff. are .e.king a copy of the originally .iqned contract
through di.cov.ry.
6. In approximately February and/or March, 19~4, C.W. Fritz
furni.h.d and in.talled a heating .y.tem in the attic area of the
pr..i....
1. In the .pring of 1994, C.ntury spouting in.tall.d a new
roof on th. pre.i.e.. See "hi~it . attached hereto.
8. prior to February 18, 1995, Plaintiff. noted that the
roof on the pre.i.e. had .tarted to buckle and telephon.d C.ntury
Spouting conc.rning thi. problem.
9. Prior to February 18, 1995, a repre.entati ve fro. Century
Spouting .poke with Plaintiff. about the buckling of the roof and
inforaed Plaintiff. that the roof .hould have been vent.d wh.n it
wa. in.talled.
10. On or about Febr.uary 20, 1995, Plaintiff. notic.d that
the ceiling in the dining roo. of the premi.e. had begun to crack1

investigetion determinsd that excessive moisture was in the attic
arsa where the heating system was installed and the exces.ive
moisture resulted in extensive damaqe to the premi.e. and personal
property therein. See "bi~it C attached hereto.

12. The collection ot exces.ive moisture in the attic area ot
the Premise. which re.ulted in .ubstantial damag8 to the Premise.
and per.onal property therein, was the direct and proximate re.ult
ot the neqliqence, carelessness, and/or reckle..ne.s ot C.W. Pritz
in that it:
eal tailed to properly install the hlolating syst_ in the
attic at the Premises which permitted the accumulation ot
excess moi.ture in the attic area; and,
ebl improperly vented the heating system which allowed
exce.sive moisture to collect in the attic area.
13. A. a direct result ot C.W. Pritz'. negligence,
carelessnes., and/or recklessness, Plaintitfs sustained significant
damaqes to the Premises and personal property therein in an amount
Ie.. than the arbitration limits ot this Court. See DbUtit C
attached hereto.
WHEREFORE, Plaintiffs, Edward lInd Stephanie Stence, demand

judgment in their tavor and against Detendant, MCRR Mechanicals,
Inc. d/b/a The New C.W. Fritz Co., in an amount less than
$25,000.00, which does not exceed the arbitration limits ot this
Court.

14. The averments ot Paragraphs 1 through 13 are incorporated
herein by reterence as it set torth at length.
15. Pursuant to the contract between Plaintifts and C.W.
Fritz, C.W. Fritz provided a preventative maintenance contract on
the heating system.
16. The collection ot excessive moisture in the attic area ot
the pre.ises which resulted in substantial damage to the premises
and personal property therein, resulted trom a breach ot contract
by C.W. Fritz in that it tailed to provide preventive maintenance
as required pursuant to the contract with Plaintitts.
17. As a direct result ot the breach ot contract, Plaintitts
sustained signiticant damages to the Premises and personal property
therein in an amount less than the arbitration limits ot this
Court. See aahibit C attached hereto.
WHEREFORE, Plaintitts, Edward and stephanie stence, demand
judgment in their tavor and against Defendant, MCRR Mechanicals,
Inc. d/b/a The New C.W. Fritz Co., in an amount less than

$~5,000.00, which does not exceed the arbitration limits ot this
Court.

18. The averments ot Paraqraphs 1 through 17 are incorporated

19. C. W. Fritz impliededly warranted that its work would be
pertormed in a qood and workmanlike manner.
~O. C.W. Fritz breached this implied warranty when it:
Cal tailed to properly install the heating system in the
attic ot the Premises which permitted the accumulation ot
excess moisture in the attic area; and,
Cbl improperly vented the heating system which allowed
exc.ssive moi~ture to collect in the attic area.
WHEREFORE, Plaintitts, Edward and stephanie stence, demand
judqment in their tavor and against Detendant, MCRR Mechanical.,
Inc. d/b/a The New C.W. Fritz co., in an amount less than
$25,000.00, which does not exceed the arbitration limits ot this
Court.

reckle..ne.. ot Century Spouting in that it:
(a) in.talled a root on the pre.i.e. in an unworuanlike
.anner;
and/or
(b) diaconnected the vent pipe tro. the heating .y.te. in the
attic cau.ing exce..ive moi.ture to collect in the attic
area;
(c) tailed to properly reconnect the vent pipe on the heating
.y.t_ in the attic cau.ing exce..ive moi.ture to collect
in the attic area;
(d) tailed to provide ventilation to the attic area ot the
pre.i.e. cau.ing exce..ive 1I0i.ture to collect in the
attic area;
(e) tailed to properly and adequately re.pond to and/or
re.olve Plaintiffs' complaints about buckling of the
roof; and,
(f) tailed to properly and adequately respond to and/or
re.olve the ventilation problem of the attic prior to
February, 1995.

25. Century Spoutinq impliededly warranted that its work

resolve the ventilation problem ot the attic prior to
February, 1995.
27. As a direct result ot Century spoutinq's breach ot
implied warranty, Plaintitts sustained siqnificant damaqes to the
Premises and to personal property therein in an amount less than
$25,000.00, which does not exceed the arbitration limits ot this
Court. See Izbtbit C attached hereto.
WHEREFORE, Plaintitts, Edward and stephanie Stence, demand
judqment in their tavor and aqainst Defendant, Century spoutinq,

2. The Plaintiffs, in their Complaint, aver, inter
alia, that on or about February 18, 1995 they "sustained
significant damage to the premises and personal property
therein in an amount less than the arbitration limits of this
Court".
J. The Plaintitf's have tailed to provide in their
Complaint a specification of the personal property allegedly
destroyed and the nature of the damage.
4. A claim for injury to or destruction of property
must be specifically pleaded under Pa. R.C.P. 1019(f), and
must include a specification of the items destroyed and the
nature of the damage so that the Defendant may intelligently
investigate the claim.
5. Because the Plaintiffs have failed to specifically
plead the items destroyed and the nature of the damage, Co-
Defendant HCRR cannot intelligently investigate their claia...
6. Co-Defendant HCRR believes, and therefore aver.,
that the Plaintiffs filed an insurance claim with their
insurance company, The Erie Insurance Group.

7. On or about May 33, 1995, Co-Defendant MeRR
believes, and therefore avers, that Erie Insurance Group made
a payment on the Plaintiffs' claim.
8. Plaintiffs have failed to plead in their Complaint
an allegation that an insurance claim was filed with their
insurance carrier, The Erie Insurance Group, that the
insurance claim was paid, and whether the amount of the claim
did not fully cover the loss of the items alleged to be
damaged by the Plaintiffs.
9. Co-Defendant MCRR bel ieves, and therefore avers,
that any damages that Plaintiffs may have sustained on or
about February 18, 1995 were covered by their insurance policy
with The Erie Insurance Group, and in the absence of
information regarding the same in the Plaintiffs' Complaint,
Co-Defendant MCRR cannot properly respond to the allegations
of any alleged damages to the Plaintiffs' premises aru:l
personal property.
WHEREFORE, Co-Defendant MCRR Mechanicals, Inc. d/b/a The
New C.W. Fritz company respectfully requests that this
Honorable Court dismiss the Plaintiffs' Complaint vith

& workmanlike manner properly carried out the contl1lcted for work.

their counsel which under the Rules of Civil Procedure are deemed to be denied and no response
is necessary; it is further averred that the avennents of pal1lgraph 26 are inconsistent with or
attempt to vary the written agreement concerning the nature and scope or the contracted for work
of the Answering Defendant and strict proof of any warranty, implied or otherwise or breach
thereof is specifically demanded at time of trial if relevant; by way of further answer, each of the
subparagraphs of paragraph 26 are denied and on the contrary, it is averred that the Answering
Defendant did not fail or omit to do or do the acts or the omissions averred therein and strict proof
thereof to the contrary is demanded if relevant at time of trial any liability or responsibility on
behalf of the Answering Defendant being hereby expressly denied.

maintenance was attempted and/or performed until payment was
made by Plaintiffs. On February 14, 1995, Co-Defendant C.W.
Fritz attempted to provide preventative maintenance. However,
this attempt was unsuccessful and another preventative
maintenance check was rescheduled. On February 18, 1995, an
insp9ction was done by Co-Defendant C.W. Fritz on the sUbject
premises and it was observed by an agent tor Co-Detendant C.W.
Fritz that the vent was disconneoted. Co-Defendant C.W. Fritz
believes and therefore avers that the vent which it had
originally installed was removed during the subsequent
installation of Plaintitts' root and never put back.
17. The averments contained in paragraph 17 ot the
Amended Complaint represent conclusions ot law to which no
response is required. In the event a response is so required,
the averments of Paragraph 17 of the Amended Complaint are
denied.
WHEREFORE, Co-Defendant C.W. Fritz respectfully requests
that this Honorable Court enter judgment in its favor and
against the Plaintiffs and dismiss the Plaintiffs I Amended
Complaint with prejudice and further award Co-Defendant C.W.
Fritz all such other relief as is proper and just.

AND NOW, come the plaintitt., Edward and stephanie Stence, by
and through their attorney. Goldberg, Katzman' Shipman, P.C., to
file this complaint and, in support thereot, state as follow.:
1. Plaintiffs, Edward and Stephanie Stence, are adult
individuals, husband and wife, residing at 1016 Tunbridge Lane,
Mechanicsburg, CUmberland county, Pennsylvania, 17055.
2. Defendant, MCRR Mechanicals, Inc. d/b/a The New C.W.
Pritz co., ("C.W. Fritz"), is organized and existing under the laws
of the Commonwealth of Pennsylvania with a place of business at 9
Brenne.an Circle, Mechanicsburg, cumberland County, Pennsylvania,
17055.
3. The Detendant, Century Spouting Co., Inc., ("Century
spouting"), is a corporation organized and existing under the laws
ot the Commonwealth of pennsylvania with a place of business at
2147 South Market Street,
Elizabethtown,
Dauphin County,
P.nn.ylvania, 170~~.

a. Prior to F.bruary 18, 1995, plaintitt. not.d that the
roof on the pre.i.e. had .tarted to buckle and tel.phon.d Century
Spouting ooncerning thi. problem.
9. Prior to February 18, 1995, a representative from Century
Spouting spoke with Plaintift. about the buckling of the roof and
inform.d plaintiff. that the root should have been vented when it
wa. in.tall.d.
10. On or about February ~O, 1995, Plaintitt. noticed that
the c.iling in the dining room ot the pr.emise. had begun to craok;
inve.tigation determined that excessive moisture was in the attic
ar.a where the heating .ystem was installed and the exce..ive
moisture resulted in extensive damage to the Premises and p.r.onal
property therein.

the Pre.ise. which reeulted in sub.tantial damage to the Premi.es
and per.onal property therein, wa. the direct and proxi.ate re.ult
ot the neqliqence, carelessne.s, and/or recklessnes. of C.W. Fritz
in that it:
Ca) failed to properly install the heating .ystem in the
attic of the premisea which permitted the accUllulation of
exce.. moiature in the attic area;
Cb) improperly vented the heating system which allowed
exce..ive moisture to collect in the attic area; and,
Cc) tailed to provide preventive maintenance aa required
pursuant to the contract with Plaintiffs.
13. As a direct result ot C.W. Pritz's negligence,
carele..ness, and/or recklessness, Plaintitf. sustained siqnificant
damages to the pre.ise. and personal property therein in an aaount
le.. than the arbitration limits of this Court.
WHEREFORE, Plaintiffs, Edward and Stephanie Stence, de.and
judgment in their favor and against Detendant, MCRR Mechanicala,
Inc. d/b/a The New C.W. Fritz Co., in an amount less than
$25,000.00, which does not exceed the arbitration limits of this
Court.

14. The averment. ot Paragraph. 1 through 10 are incorporated
herein by reference a. it .et torth at length.
15. Damages sustained by plaintitts were the direot and
proximate re.ult of the negligence,
carele..ne.., and/or
reckle..ne.e ot Century spouting in that it:
(a)
installed a root on the Premises in an unworkmanlike
manneri
(b)
di.connected the vent pipe from the heating system in the
attic cau.ing excessive moisture to collect in the attic
areai
(c)
failed to properly reconnect the vent pipe on the heating
system in the attic causing excessive moisture to collect
in the attic areai
failed to provide ventilation to the attic area of the
Premises causinq excessive moisture to collect in the
attic areai
(e) failed to properly and adequately respond to and/or
resolve Plaintitfs' complaints about buckl1nq of the
roofi and,
(d)
(f) failed to properly and adequately respond to and/or
resolve the ventilation problem of the attic prior to
February, 1995.
l6. As a direct result ot Century Spouting'S negligence,
carelessness and/or recklessness, plaintitfs sustained siqnificant
damages to the Premises and to personal property therein in an
amount less than $25,000.00, which does not exceed the arbitration
limits ot this Court.
WHEREFORE, Plaintifts, Edward and Stephanie stence, demand
judgment in their favor and against Defendant, Century Spouting,
