and closed the safety bar that the bar had flown open. The employee replied that the
roller coaster was old and was "being held together with banda ids".

The safety bar on the defendant's roller coaster car being occupied by the plaintiff
flew open due to the failure of the defendant to inspect and maintain the safety bar and
due to the negligence, recklessness, and carelessness of the defendant, and was due in
no manner whatsoever to any act or failure to act on the part of the plaintiff.
12.
The safety bar on the plaintiff's roller coaster car being occupied by the plaintiff
flew open as a result of the carelessness, recklessness and negligent manner in which
the defendant and its agents and servants operated and maintained the roller coaster,
which carelessness, recklessness, and negligence is more fully set forth as follows:
A. In failing to adequately secure the safety bar before the roller
coaster left the station;
B. In failing to properly service the safety bar to insure that it
would latch properly and completely and not open during
the operation of the roller coaster;
C. In failing to properly maintain the safety bar in a safe condition
to Insure that it would not open during the operation of the
roller coaster;
D. In failing to inspect the safety bar and its latches to determine
whether or not they were working properly and would remain
locked and secure during the roller coaster ride.

The roller coaster was owned and operated by the defendant and was entirely
and exclusively under the control and management of the defendant and its agents and
servants.

The plaintiff was seated in the roller coaster by the defendant's agent and
servant, who closed the safely bar and allegedly latched the safety ba,' to the roller
coaster car.
