Proposal for bathroom renovationlinstallation at 103 Manchester Dr,
Cut an opening in the back of the closet off the Kitchen to instdllthe bathroom sink.
Rehang the bathroom door to swing in the opposite direction. Remove the linen c[O)et in
the bathroom, Construct a wall about 5' long to separate the two bathrooms. Cut a door
(28") opening and install a door with lockset from the main bedroom. Wire a light and OFI
outlet for the both bathroom sinks. The ne~room Door will be covered with 1/4 "
lauan sheathing and vinyl Dooring. The base oard-and door casing will be installed to
match the existing house, The drywall will be finished and painted.
Items you are to provide: Commode W/Seat, Sink, Faucet, Vinyl Dooring, 2 Light
fixtures and Paint.

(10) Damaged door trim.
(11) Dry wall not sanded resulting in bubbles and
pits.

My estimate to upgrade the bathroom sink in your bathroom is $335.00. This estimate
includes all labor and materials to:
I) Remove the existing bathroom sink.
2) Install Chestnut HiD 1916SRO oval. self-rimming, vitreous china lavatory.
3) Custom make a formica vanity to receive the above lavatory.
4) ModifY the existing cabinet to include a toe space at its base.
~) Refinish all wooden parts of the base cabinet with two coats of white oil-base enamel
6) Relocate the switch and receptacle nearest the wall-hung medicine cabinet.

We received your Notice of Hearing of the Board of
Arbitration, dated November 19, 1996, in the above-referenced
matter, scheduling a hearing for Thursday, January 16, 1997, at
2:00 p.m.
Our client, Nancy Hazell, is recovering from cataract surgery
and has not healed as quickly as expected to the point where her
optimum prescription has been established. As indicated in the
enclosed letter from her attending physician, F. Jane Barton, M.D.,
her appointment of January 24, 1997, should establish the optimum
prescription and her eyesight should be fully corrected shortly
thereafter.

AND NOW, comes Plaintiff, Nancy Hazell, by her attorneys,
Metzger, Wickersham, Knauss & Erb, P.C., and makes Reply to New
Matter of Defendant, John W. Vogelsong, as follows:
10. As pleaded, no reply is required. To the extent a reply
is required, the allegations of paragraphs 5 to and including 9 of
the Answer are denied and the allegations of paragraphs 5 to and
including 9 of Complaint are incorporated herein by reference as
though fully set forth herein.
11. The allegations of paragraph 11 of the New Matter are
specifically denied. To the contrary, it is averred that the
principal work of the Defendant set forth in the proposal dated
October 16, 1995, was never completed.
The allegations of
paragraphs 5 to and including 9 of the Complaint are incorporated
herein by reference as though fully set forth herein.
12. The allegations of paragraph 12 of the New Matter are
partially admitted and partially denied. It is admitted that the
Plaintiff paid $200.00 on account. It is denied that the remaining
$238.00 is due and payable by reason of the allegations of
,
paragraphs 5 to and including 9 of the Complaint which are
incorporated herein by reference as though fully eet forth herein.
13. After reasonable investigation, Plaintiff is without
knowledge or information sufficient to toX'm a belief as to the
truth of the allegations of paragraph 13 of the New Matter and said
allegations are therefore denied. Plaintiff demands proof thereof
at the trial of this case.
14. The allegations of paragraph 14 of the New Matter are
epecifically denied. To the contrary, the allegations of
paragraphs 5 to and including 9 of the Complaint are incorporated
herein by reference as though fully set forth herein.
15. The allegations of paragraph 15 of the New Matter are
partially admitted and partially denied. It is admitted that
Plaintiff has refused and continues to refuse to make any further
payment to the Defendant. It is denied that there is any sum owed
to the Defendant. The allegations of paragraphs 5 to and including
9 of the Complaint are incorporated herein by reference as though
fully set forth herein.
WHEREFORE, Plaintiff respectfully requests your Honorable
Court to dismiss the New Matter and enter judgment against the

COMPLAINT
AND NOW COMES NANCY HAZELL, Plaintift, by her attorney.,
Metzqer, Wickersham, Rnauss , Erb and makes claim aqainst JOHN W.
VOGELSONG, Detendant, a. tollows:
1. The Plaintift, Nancy Hazell, is an adult individual
re.idinq at 103 Manchester Road, Lower Allen Township, Cumberland
County, Pennsylvania, 17011.
2. The Detendant, John W. Voqelsonq, is an adult individual
residinq at 612 South York Road, Dillsburg, York county,
Pennsylvania, 17019, and was at all times relevant hereto engaged
in the business ot remodeling and home improvements.
). On or about June 17, 1995, Detendant submitted to
Plaintift a proposal to perform certain works set forth therein, a
copy ot which is hereto attached, marked Exhibit "A" and made part
hereot at a price of $1,000.00 of which Plaintiff paid Defendant
$1000.00. On or about June 20, 1995, and on or about October 16,
1995, Defendant submitted to Plaintiff a supplemented proposal to
perform certain work set forth therein, copy of which is hereto
attached, marked Exhibit "B", and made part hereof at a price of
$483.00 ot which Plaintiff paid Defendant $200.00
4. The Defendant warranted and was bound to do all the work
in a workmanlike manner and be in all respects fit and proper for
the intended uses and purposee.
5. The Plaintiff relied upon the said warranties.
6. The Defendant entered upon the performance of the work
but negleoted to do and perform certain works which were requisite
and nece.sary to be done and performed and performed the same in a
bad, inartificial and unworkmanlike manner as follows:
a. In kitchen, installed a cracked wood shelf in
p~ntry oloset which bowed and sagged.
b. In powder room
(1) base and vanity top not secured so that it
moves against pipes.
(2) No strip under door.
(3) Carpet raw edges curling up.
(4) Wall bulges and is pitted.
(5) electrio switch installed too low.
(6) Wiring for medicine cabinet light placed too
high.
(7) Left hole in wall above light fixture about
1 1/2" x 2".
(8) Removed door stop and failed to replace it.
(9) Nail holes are visible.
(10) Damaged door trim.
(11) Dry wall not sanded resulting in bubbles and
pits.
C. In bathroom

(1) Failure to vent tan in bathroom through as
required by BOCA Code.
(2) Improper installation ~t electric wiring.
(3) Electric switches installed crooked.
(4) Bathroom walls painted before cleaning ott
dust.
(5) Dry wall not sanded resulting in bubbles and
pits.
(6) Paint did not cover dry wall.
(7) Paint smeared on stained glass window.
(8) Shelving not cut, sanded, pointed or tlush with
wall.
(9) Dry wall edges not straight running in a slant.
(10) Sink installed crooked and counter top around
it consisted of unfinished wood, not sanded,
splinters sticking out of raw edges.
(11) Vanity frame and doors splintery and
untinished with large hole around plumbing.
(12) Sloppy caulking and traming.
(13) No toot space under cabinets.
(14) Broke wooden carved coo-coo clock.
(15) Plaster dust allover and in everything.
(16) Installed toilet crooked.
(17) Installed new vinyl over old, making tloor
high, causing people to trip on metal strip at
door.

7. By reason of said neglect to do and perform the work and
the performance ot the same in a bad, inartificial and
unworkmanl1ke manner, on or about November 30, 1995, plaintiff
notified Defendant to discontinue any more work and that she would
have the defects corrected.
e. By reason of neglect to do and perform the work which was
required and necessary to be done and performed the same in a bad,
inartificial and unworkmanlike manner, Plaintiff took corrective
action as follows:
a. Work performed by Xenneth E. Xiefter set forth in
invoice dated January 31, 1996, hereto attached,
marked Exhibit "C" and made part hereof in the
amount of $335.00 which amount was paid by
Plaintitt .
b. Work performed by Galen Lehman set forth in invoice
dated December 4, 1995, hereto attached, marked
Exhibit "0" and made part of in the amount ot
$300.00, which amount was paid by Plaintiff.
c. Materials purchased from Sears, Roebuck & Company
set forth in invoice dated January 29, 1996, hereto
attached and marked Exhibit "E" and made part
hereof in the amount of $10.59, which amount was
paid by Plaintiff.
d. Materials purchased from Sherwin-Williams set forth
in invoice dated January 29, 1996, hereto attached,
markcad Exhibit "F" and made part hereof in the

amount ot $2.11, which amount was paid by
Plaintitf.
e. Materials purchased from Carpet Barn dated December
4, 1995, attached hereto, marked Exhibit "G", and
made part hereot in the amount ot $241.51, which
amount was paid by Plaintiff.
f. Materials purchased from Lowe's dated July 26, 1995
attached hereto, marked Exhibit "K" and made a part
hereof in the amount of $65.57 which amount was
paid by Plaintift.
q. Labor to add second coat of paint $86.00.
h. Installation ot ceilinq liqht and tan $125.00.
i. Cost ot door unit lockset $33.58.
8. Plaintitf has demanded that Defendant pay to her the sum
of $1,161.25 but Detendant retuses to pay.
9. Plaintiff has demanded that Defendant repay to her the
sum of $1,200.00, beinq the amount Plaintift previously paid to
Defendant, but Detendant retuses to pay.
WHEREFORE, Plaintiff, Nancy Hazell, respecttully requests your

returning to the premises to complete the work that was required of
him by Plaintiff.
a. In kitchen. The shelf installed by Defendant was fabricated from
material provided to Defendant by Plaintiff. and which Plaintiff
insisted that Defendant utilize in order to minimize costs.
b. In powder room.
(I) Base and vanity were installed by Plaintiffs plumber. not
the Defendant.
(2) Carpet that the Defendant installed was folded under and
stapled to the floor. a method encouraged by an approved
by Plaintiff to save costs.
(3) When Defendant was last at the property. the stapled
carpet was properly secured. What was done to the
carpeting by other contractors or by Plaintiff is beyond
Defendant's control.
(4) The wall was constructed in a workmanlike manner, and
approved by Plaintiff prior to its being painted. At that
time there was no bulging or pitting.
(5) The electric switch was not installed where Defendant

13. After reasonable investigation, Plaintiff i. without
knowledge or information sufficient to form a belief as to the
truth of the allegations of paragraph 13 of the New Matter and said
allegations are therefore denied. Plaintiff demands proof thereof
at the trial of this case.
14. The allegations of paragraph 14 of the New Matter are
specifically denied. To the contrary, the allegations of
paragraphs 5 to and including 9 of the Complaint are incorporated

Plaintiff has refused and continues to refuse to make any further
