Christmas Day at 12:00 noon.
C. The Mother shall have physical custody of both Children in
every year on Mother's Day.
D. The Father shall have physical custody ot both Children in even
numbered years on Memor ial Day, Labor Day, and the Christmas
holiday trom Christmas Eve at 12:00 noon until Christmas Day at
12:00 noon.
E. The Father shall have physical custody ot both Children in odd
nurrtJered years on Easter, July 4th, Thanksgiving and the
Christmas holiday trom Christmas Day at 12:00 noon until
Decentler 26 at 12:00 noon.
F. The Father shall have physical custody of both Children in
every year on Father's Day.
6. Each party shall have physical custody ot both Children tor two
consecutive or non-consecutive weeks during the summer vacation upon
providing thirty (30) days notice to the other party. Summer vacation
custody shall not be scheduled to interfere with the other party's summer
holiday custody.
7. The holiday custody schedule shall take precedence over the regular
and summer vacation custody provisions in this Order.
8. It either party (or his or her relatives) intends to remove either
Child or both Children trom the COI1111Onweal th for an overnight period or
longer, that party shall provide to the non-custodial party the address and
telephone nurrtJer where the Child or Children can be contacted.
9. The parties and their counsel shall meet with the CUstody
Conciliator, Dawn S. Sunday, Esquire, for a second Conference on May 21,
1996 at 1:30 p.m.
10. This Order is entered pursuant to an agreement of the parties at a
Custody conciliation Conference. The parties may modify the terms of this
Order by mutual consent. In the absence of mutual consent, the provisions
of this Order shall control.

2. A Conciliation Conference was held on April 9, 1996, with the
tollowing individuals in attendance: The Father, Paul Craig, with his
counsel, R. Mark Thomas, Esquire, and the Mother, Sabrina S. Craig, who was
not represented by legal counsel at the Conference.
3. The parties agree to entry of a temporary custody order in the form
as attached pending the second Conciliation Conference to be held on May 21,
1996 at 1:30 p.m. The parties have recently separated and believe they will
be better able to work out the specific provisions of an ongoing custody
order after having tollowed the temporary arrangements set forth in the
attached Order for a period of approximately six (6) weeks.

per month upon providing forty-eight (48) hours advanced notice to the
Father. The Mother's periods of partial custody shall not be scheduled to
conflict with Zackery's school activities or prearranged activities by the
Father.
5. All exchanges of custody under this Or:der shall take place at
Rite Aid on Route 30 in Fayetteville unless the parties agree otherwise.
6. Upon request from the other party, each party shall provide
infor:mation concerning the childcare provider or babysitter cadng for: the
Children during that party's pedod of custody.
7. The Father agrees to provide the daybed for: Shea's use and
one-half of the Child's toys to the Mother:.

ordered and directed as follows:
1. A Hearing is scheduled ir Court ROOIl\ ~ ~ of the
Cl.urberland County Court 'louse on the ,," day of \'\:-L",-L ,
1997 att.1:Lo'clock C< .m., at which time testimony will be taken in this
case. The Father, Paul Craig, shall be the moving party and shall proceed
initially with testimony. Counsel for the parties shall file with the
Court and opposing counsel a Memorandum setting forth each party's position
on custody and also setting forth a list of witnesses who will be called to
testify at the Hearing along with a summary of the anticipated testimony of
each witness. This Memorandum shall be filed at least 10 days prior to the
Hearing date.

2. This Court's prior Orders dated April 17, 1996 and May 28,
1996 are suspended and replaced with this Order pending Hearing.
3. Pending Hearing or agreement of the parties, the Father, Paul
Craig, and the Mother, Sabrina S. Craig, shall have shared legal custody of
Zackery T. Craig, born October 26, 1991, and Shea LeAnn Craig, born June
27, 1994.
4. The Father shall have primary physical custody of the
Children.
5. The Mother shall have partial physical custody of both
Children on alternating weekends from Friday at 5:00 p.m. until Sunday at
6:30 p.m., beginning February 21, 1997. The Mother shall also have custody
of the parties' daughter every week from Tuesday at 5:00 p.m. until the
following Wednesday at 5:00 p.m. The weekday periods of custody shall
begin on February 25, 1997.
6. The Mother shall have custody of both Children on Easter
Sunday from 2:00 p.m. until the following Monday at 5:00 p.m.
7. The Father shall be responsible to provide all transportation
under this Order until such time as the Mother obtains use of a motor
vehicle. At that time, the parties shall exchange custody of the Children
at Rite-Aid on Rte. 30 in Fayetteville.

2. A third Conciliation Conference was held on February 18, 1997 with
the following individuals in attendance: The Father, Paul Craig, with his
counsel, R. Mark Thomas, Esquire and the Mother, Sabrina S. Craig, with her
counsel, Joan Carey, Esquire.
3. This Court previously entered 2 Orders in this matter dated April
17, 1996 and May 28, 1996, establishing primary custody of the parties' son
with the Father and primary custody of the parties' daughter with the
Mother. Under the Orders, the parties were to have alternating weekend
custody with both Children together. Both Orders were entered as a result
of agreements at Conciliation Conferences.
4. The Father filed this Petition to obtain primary physical custody
of the parties' daughter as well as their son. The Mother strongly opposed
Father's Petition and, in fact, left the building prior to termination of
the Conference. A Hearing will be necessary in this matter.
5. The Father's position on custody is as follows: The Father stated
that since September 1996, the Father has had custody of both Children for
apprOximately twenty (20) days out of each month. Some of the additional
periods of custody with the parties' daughter was due to the Father's
request to take the Child on vacation in early October but other periods
resulted from the Mother's request that the Father take care of the Child
during periods in September and October when circumstances arose in her
life which prohibited her from being able to properly care for the Child.
The Father stated that the Mother did not seek to have custody of the
parties I daughter during Deceat>er. The Father indicated that when he took
the Children to a Christmas Eve party at the Mother's relatives' home, the
Mother did not show up and did not contact him until January 3, 1997. The

physical custody ot Zackery T. Craig and the mother/respondent is

J. Since the issuance of the Court Order dated May 28, 1996,
the petitioner/father herein has been the primary custodian tor

rights with regard to Shea LeAnn Craig.
4. Through her actions and occasional statements the
respondent/mother has made it clear that she is either unwilling or

the children at this time.

proceedings who has physical custody of the children or claims to
have custody or visitation rights with respect to the children.
7. The best interest and permanent welfare of the children
will be served by granting the relief requested because:
(a) Father will provide a nur.turing and caring atmosphere in
which the children can thrive; and
(b) Father will allow liberal visitation and assure that
children maintain meaningful contact with their mother.
8. Each parent whose parental rights to the children have
not been terminated and the person who has physical custody of the
children have been named in this action. All other persons, named
below, who are known to have or claim a right to custody or
visitation of the child will be given notice of the pendency of
this action and the right to intervene:

consideration of the attached Custody Conciliatlon Re t,
and directed as follows:

it is ordered
1. This Court's prior Order dated April 17, 1996 shall continue
in effect with the fOllowing modifications.
2. Paragraph 3. of the April 17, 1996 Order shall be replaced
with the following provision: The Father shall have partial physical
custody of both Children every weekend from Friday between 4:00 and 4:30
p.m. until the following Sunday at 6:30 p.m., when he shall return Shea to
the Mother's custody.
3. Paragraph 4. of the April 17, 1996 Order is vacated.
4. The Mother shall have the right to have periodS of partial
custody of Zackery not to exceed two consecutive days for up to two times
per month upon providing forty-eight (48) hours advanced notice to the
Father. The Mother's periods of partial custody shall not be scheduled to
conflict with Zackery's school activities or prearranged activities by the
Father.
5. All exchanges of custody under this Order shall take place at
Rite Aid on Route 30 in Fayetteville unless the parties agree otherwise.
6. Upon request from the other party, each party shall provide
information concerning the childcare provider or babysitter caring for the
Children during that party's period of custody.
7. The Father agrees to provide the daybed for Shea's use and
one-half of the Child's toys to the Mother.
8. This Order is entered pursuant to an agreement of the parties
at a Custody Conciliation Conference. The parties may modify the terms of
this Order by mutual consent. In the absence of mU)'Ual consent, the
provisions of this Order shall control. ./
