ANSWBR TO COMPLAINT
AND NOW comes Defendant, Ferra Co" Inc., (Ferra), by and
through its attorney, Pat A. Capolupo, Esquire, and files the
within Answer to Complaint and avers as follows, to-wit:
1. Admitted.
2. Admitted.
3. The averments made in paragraph 3 of Plaintiff I s Complaint
are denied. It is specifically denied that at the special instance
and request of the Defendant, Plaintiff sold and tendered to
Defendant various building materials and supplies delivered to and
utilized in a construction project that took place at the Capital
City Mall. Camp Hill. CUmberland County, Pennsylvania, for which
there is presently due and owing to Plaintiff by Defendant the sum
of $20,631.60.
To the contrary, the Defendant Ferra, was a
subcontractor performing work under and in accordance with an
agreement with Rycon Construction Inc. (Rycon), as general
contractor, and if any money is owed to the Plaintiff, it is the
liability of Rycon only and Ferra does not owe Plaintiff any sum or
sums.
4. The averments made in paragraph 4 of the Pla,intiff I s
Complaint are denied. It is specifically denied that Plaintiff has
rendered to Defendant Statements of Account showing a balance due
to Plaintiff by Defendant in the amount of $20,631,40, to which the
Defendant has not objected, To the contrary, The Defendant denies
owing the Plaintiff any money, and if it proven at time of trial
that money is owed to the Plaintiff by Defendant Ferra, strict
proof of the same is demanded at time of trial.
S. The averments made in paragraph S of the Plaintiff I s
Complaint are denied. It is specifically denied that although duly
demanded the said account balance in the amount of $20.631.60 has
not been paid by Defendant to Plaintiff or to anyone acting on
behalf of Plaintiff and is therefore due and payable with interest
from February 26, 1996, at the rate of 18' per annum. To the
contrary, it avel'red that the said sum was deducted from the
balance due to Ferra, by Rycon, and if any amount is due, it is due
to the Plaintiff from Rycon, as well as any interest if interest is
due. It is further denied that interest is due at the rate of 18'
per annum and strict proof of the same is demanded at time of
trial.
WHBRBPORB, Defendant demands that Plaintiff's Complaint be
dismissed.

6. This Defendant hereby incorporates by reference herein
paragraphs 1 though S as though fully set forth,
7, The parties herein entered into a Joint Check Agreement
wherein, checks were to be issued in joint names of Plaintiff and
Defendant, Ferra; and the Plaintiff breached said agreement by its
failure to request payment as agreed from the General Contractor,
Rycon, copy of said agreement is attached hereto and made a part
hereof, and marked Exhibit "A",
8, That the Defendant was notified by Rycon, the General
contractor, that Rycon deducted moneys due Ferra on the said
project to pay for equipment owed to pennsy for material, Copy of
said notice is attached hereto and marked as Exhibit "B",
9, That Ferra disputed and objected to the amount charged for
the material delivered as well as the amount owed to pennsy for the
material supplied on this project.
10. That the Defendant Ferra notified Plaintiff of said
disputed amounts owed and that as a result Rycon arbitrarily and
without Ferra's consent deducted a certain amount from the total
amount due Ferra on this project.
Wherefore, Defendant requests that Plaintiff's complaint be
dismissed and judgement entered in favor of Defendant.

General Contractor. At all tilT'es material hereto, Ferra Co., Inc, was the entity with
whom Pennsy Supply, Inc. maintained the account and it was Ferra Co., Inc, that
purchased the materials in question as evidenced by the Purchase Order directed to
Pennsy Supply, Inc, and evidenced as part of Exhibit "A" to Defendant's Answer With
New Matter.
8. Denied. After reasonable investigation, Plaintiff is without knowledge or
information sufficient to form a belief as to what notifications may have taken place
between Ayccn Construction, Inc, and the Defendant, Whether and why Aycon
deducted monies due to Ferra was a matter within the exclusive knowledge and
province of the Defendant and Plaintiff was not aware that any such monies had been
deducted by Rycon from monies due Ferra until receipt of the document attached to
the Defendant's Answer With New Matter as Exhibit "6". In any event, Plaintiff
remains of the position that whether or not Rycon deducted certain monies from
monies due and owing to Ferry Co., Inc. is of no relevance to the Plaintiff's claim for
monies due to Plaintiff by Defendant, The monies due and owing to Plaintiff for the
materials supplied to the Defendant have not been paid by the Defendant or anyone
acting on behalf of the Defendant.
9. Denied. Plaintiff is without knowledge or ir,formation regarding any
disputes or objections to the amount charged for the materials delivered to the project
by the Plaintiff, Pennsy Supply, Inc. Plaintiff has no record of any correspondence or
memorandum regarding any written or verbal dispute raised by Defendant Ferra Co.,
Inc, with respect to the pricing of the material or the amount owed to Pennsy Supply
