STIPULATION AGAINST LIENS

THIS AGREEMENT made the I if.J i. day of March, 1996, by and between ROBERT
COLDSMITH, III, hereinafter referred to as Contractor, and DENNIS E. SMITH and GRACE K.
SMITH, husband and wife, hereinafter referred to as Owner, whereby the former undertakes and
agrees to erect and construct a single family dwellinG on:
ALL THAT CERTAIN tract of land, situate in the Township of Penn, County of Cumberland,
Pennsylvania, referred to as Lot No. 13, more particularly bounded and described in accordance
with the Final Subdivision Plan of Mount Rock Manor, prepared by Eric L Diffenbaugh, Professional
Land Surveyor, which Subdivision Plan has been approved by the appropriate municipal authorities
and is recorded in the OffIce of the Recorder of Deeds in and for Cumberland County, Pennsylvania,
in Plan Book 68, Page 49, as fellows:
BEGINNING at a railroad spike in the centerline of Mount Rock Road (S.R. 3015) which point
is common corner of Lots Nos. 12 and 13; thence along common boundary line of lots Nos. 12
and 13, North 62 degreas 05 minutes 09 seconds East 593.73 feet to an iron pin in line of Lot No.
17; thence along common boundary line of Lots Nos. 13 and 17, South 27 degrees 54 minutes 51
seconds East, 150.00 feet to an iron pin in the edge of Lesli Lane (a 50 foot private right-of-way);
thence along the edge of Lesli Lane, South 62 degrees 05 minutes 09 seconds West, 602.34 feet
to a railroad spike in the centerline of Mount Rock Roed; thence along the centerline of Mount Rock
Road, North 22 degrees 59 minutes 44 seconds West, 85.59 feet to an existing nail; thence
continuing by same, North 26 degrees 47 minutes 16 seconds West. 64.73 feet to a railroad spike,
the point and Place of BEGINNING. CONTAINING a total lot area of 2.0551 acres, more or less.
UNDER AND SUBJECT to the building setback lines, dedicated and publiC road rights-of-
way and other notations and conditions contained on the Subdivision Plan, all of which are
incorporated herein by reference.
ALSO UNDER AND SUBJECT, nevertheless, to the building and use restrictions which shall
be binding on the within described tract of land only and shall not be deemed tract restrictions, as
set forth In Deed Book 135, Page 1157.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in
consideration of the sum of One ($1.00) Dollar to him in hand paid by Owner, the receipt whereof
is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for
themselves and their subcontractors, and ali parties acting through or under them, covenant and
agree that no mechanic's liens or claims thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards, in, or about the
erection and construction of the said buildings on the lot above described, and the said Contractor,
