I
3. On the 30th day of November, 1992. the above named mortgagor made, ellecuted and
delivered a mortgage upon premises hereinafter described to GMAC Mortgage Corporation ofPA. which
mortgage is recorded in the Office of the Recorder of Deeds lor Cumberland County in Mortgag" Book
llOS page SS3.
4. The premises subject to the said mortgage is described in ElIhibit "A" attached hereto and
made a part hereof
S, The mortgage secures defendant's certain Note dated the same as the mortgage in the amount
of $41.300.00 payable to plaintiff in monthly installments with interest at the rate of7.8S% per annum.
A copy of the said Note is attached hereto, made a part hereof and marked Exhibit "B",
6, On the I Sth day of December, 1995, the said mortgage was last assigned to MELLON BANK
N,A" Trustee under a certain Indenture of Trust with Pennsylvania Housing Finance Agency, the plaintiff
herein, by written assignment which is being recorded forthwith in the Office of the Recorder of Deeds
for Cumberland County.
7, The mortgage is in default because the defendant has failed to make the payment of the
monthly installment of principal and interest in accordance with Ihe terms of the mortgage for the month
of November 1994, and each month thereafter, up to and including the present time,
8, The following amounts are due on the mortgage:

Interest at 7.8S% per annum from 10/1/94 through
2129/96 ($8,74 per diem)
Late charges accrued thru 2129196 ($14.94/month)
Escrow deficit (taxes and insurances) ($8S,14/month)

9. The attorney's fee setlorth is in conformity with the mortgage and Pennsylvania law and will

be collected in the event the premises are purchased by a third party at Sheriff's Sale, If the mortgage is
reinstated prior to sale, reasonable attorney's fees will be charged based on the work actually performed.
10. On July 26, 1995. plaintiff sent to defendant by certified mail Notice of Intention to Foreclose
Mortgage in accordance with the provisions of Section 403 of Pennsylvania Act NO.6 of 1974, a true
and Correct copy of which is attached hereto, made a part hereof and marked Exhibit "C",
II. On July 26, 1995, plaintiff sent to defendant by first class mail Notice of Homeowners'
Emergency Mortgage Assistance Program in accordance with Pennsylvania Act 91 of 1983. a true and
correct copy of which is attached hereto, made a part hereof and marked Exhibit "0". Defendant has not
had the required face-to-face meeting with the mortgagee within the required time and plaintiff has
received no notice that defendant has had a face-to-face meeting with a consumer credit counseling
agency, nor has plaintiff received notice that defendant has filed an application with the Homeowners'
Emergency Mortgage Assistance Program.
WHEREFORE, plaintiff demands judgment in the sum of $48,608. 75 plus interest. late charges,
escrow amounts and costs to the date of judgment and foreclosure of the said mortgage.

ALL THAT CERTAIN unit in the property-known. named and identified
in the Declarlltion Plan, referred to below as Westwood Village
Condominium located in East Per.nsboro Township, Cumberland County,
Commonwealth of Pennsylvania, which has heretofore been submitted
to the provisions of the Unit Property Act of Pennsylvania. Act of
July 3, 1963, P.L. 196, by the recording in the Office of the
Recorder of Deeds of Cumberland County. Pennsylvania. of a
Declaration Creating and Establishing Westwood Village Condominium
dated January 29, 1975, and recorded on January 29, 1975, in Misc.
Book 213 at page 283, and amended by a certain First Amendment to
Declaration Creating and Establishing Westwood Village Condominium
dated May 28, 1976 and recorded on June 22, 1976, in Misc. Book 222
at page 729, and a certain Second Amendment to Declaration Creating
and Establishing Westwood Village Condominium dated July 21, 1976,
and recorded on July 26, 1976, in Misc. Book 223 at page 343, and
a Code of Regulations of Westwood Village Condominium dated January
29, 1975, and recorded on January 29, 1975, in Misc. Book 213 at
page 3285 and amended by a certain FirAt Amendment to Code of
Regulations of Westwood Village Condominium dated May 28, 1976, and
recorded on June 22, 1976, in Misc. Book 222 at page 737, and
Declaration Plan of Westwood Village Condominium dated January 29,
1975, and recorded on January 29, 1975, in Plan Book 26 at page 15,
and amended by a certain First Amendment to Declaration Plan of
Westwood Village Condominium dated July 21, 1976, and recorded on
July 26, 1976, in plan Book 28 at page 72, being designated on said
Declaration Plan of Westwood Village Condominium as Unit No. 810,
Suite 104, L17, GA in Block #~, Building #3, known as 810 Charlotte
Way, Suite 104, Enola. Cumberland County, Pa., as more fully
described in such Declaration Plan and Declaration Creating and
Establishing Westwood Village Condominium, as the same appears of
record as set forth above, including any amendments thereto,

not later than thirty (30) days after sale. This schedule will state
who will be receivLng that money. The money will be paid out in

proposed distribution LS wrong) are filed"with the Sheriff ~ithin ten
(10) days after the filing of the schedule.
