4. The tract of land conveyed to the plaintiff is more particu-
larly bounded and described as follow8:
ALL that certain tract of land situate in the Borough of Newburg,
Cumberland County, Pennsylvania, bounded and described as follows:
BEGINNING at a point in the center of the run; thence by said run
lands now or formerly of the heirs of Mrs. Martha Heffelfinger North
seventeen and one-half (17~) degrees West sixty-three and one-third
(63~) feet to a post or stone in center of West Main Street (East side
of said run); thence along the center of Main Street by lot now or
formerly of David Heffelfinger North sixty-seven and one-half (67~)
degrees East thirty-seven (37) feet to a point at land now or formerly
of William R. Keefer, of which this tract was a part; thence along
said land South sixty-three and one-third (63~) feet to a point on
straight line; thence by land of same West in a straight line thirty-
seven (37) feet to a point, the place of BEGINNING. CONTAINING two
thousand three hundred forty-three and one-third (2,343~) square feet.
5. The plaintiff's predecessor in title, Bernice A. Heffelfinger
and Foster S. Heffelfinger, acquired title to the property by
testamentary devise from the Estate of Edgar S. Wagner and recorded in
the Office of the Register of Wills of Cumberland County, Pennsylva-
nia, in Will Book 54, Page 362.
6. Edgar S. Wagner and Estelle T. Wagner, husband and wife,
acquired title to the property from Samuel O. Rebok and Dessie Rebok,
husband and wife, by deed dated November 20, 1928. The deed is
referenced in the recitals of subsequent conveyances but no record of
its recording can be found.
7. On information and belief, and after diligent inquiry, the
plaintiff avers that the said deed from Samuel O. Rebok and Dessie
Rebok, husband and wife, was delivered but to Edgar S. Wagner but was
misplaced before it was recorded.

8. After diligent inquiry the plaintiff has found no person or
persons who have or claim to have any right, title or interest in or
claims against the aforesaid property, the subject matter of this
action to quiet title, except the defendants, their heirs, administra-
tors, executors, and assigns.
9. The plaintiff asserts that her right, title and interest in
and to the aforesaid land, the subject matter of this action to quiet
title, is vested abs~lutely.
10. The plaintiff, nevertheless, believes that there may be a
cloud or suspicion upon the title to said real estate described in the
within complaint because of the aforesaid unrecorded deed which could
possibly hinder either plaintiff's possession and quiet enjoyment of
said real estate or delay any proposed sale of the said real estate;
and the plaintiff, accordingly, commences this action to quiet title
to remove the apparent possible interest or title in the herein
defendants, their heirs, administrators, executors, or assigns, if
any.
11. The plaintiff brings this action to quiet title under the
provisions of Pa. R.C.P. 1061, et seq., and under the general powers
of the court to quiet title to real estate pursuant to the provisions
of the Act of Assembly so providing and the Pennsylvania Rules of
Civil Procedure.
WHEREPORE. the plaintiff respectfully requests your Honorable
Court to decree:
