HomeMy WebLinkAbout02-4614JOYCE WILSON Plaintiff JOHN GEORGE Defendant : IN THE COURT OF COMMON PLEAS : CUMBERLAND COUNTY PENNSYLVANIA : : MISCELLANEOUS DOCKET NO: _- .. : CIVIL ACTION STIPULATION OF THE PARTIES WHEREAS, the parties to this matter are Joyce Wilson and John George; and WHEREAS, Plaintiff has filed a Protection From Abuse Action docketed at No. 02-4031 in Cumberland County; and WHEREAS, a Temporary Protection Order was entered on or about August 23, 2002; and WHEREAS, the parties are desirous of eni~an amicable settlement of that matter; NOW, THEREFORE be it resolved this~,~'-' c~ay of September, 2002, that the parties hereby agree, stipulate, and covenant as follows: 1. The parties agree that the action docketed to No. 02-4031 of Cumberland County shall be withdrawn and discontinued without prejudice. 2. The parties agree to the entry of the following terms, hereby agreeing that this Stipulation shall be enforceable as a Protection Order by the Court of Common Pleas, with the limitations set forth below, and further waiving any objections thereto with respect to enforcement by the Court or police departments of this Commonwealth: The parties agree to the following relief and the entry of this Stiuplation as an Order of Court directing the following relief for the period of one (l) years from the date of this Order without admitting allegations and by the consent of the parties: a. Defendant is prohibited from approaching, abusing, harassing, or threatening Plaintiff wherever she may be; Plaintiffis prohibited from approaching, abusing, harassing, or threatening Defendant wherever she may be; b. Defendant is prohibited from having any direct contact with Plaintiff; Plaintiff is prohibited from having any direct contact with Defendant; c. Defendant is prohibited from stalking or harassing Plaintiff; Plaintiff is prohibited from stalking or harassing Defendant. Pursuant to 23 Pa. C.S. §6113(g), Defendant and Plaintiffare hereby notified that violations of the Order could subject him/her to a petition for contempt and subsequent contempt order shall be deemed to have violated this Order by the Court. Specifically, Defendant/Plaintiff is notified that should he/she be found in contempt of this Order, he may be incarcerated for up to six (6) months and/or fined up to $1,000.00. This is not a Protection From Abuse matter.
