C;[, I'h'~ (~,.,,: I",., JOHN G. MYERS, SR., Defendant CIVIL ACTION - LAW COMPLAIH'l' AND NOW comes the plaintiff, by and through its attorney, James H. Turner, and makes the following complaint. 1. Plaintiff, Michigan National Bank, is a federally chartered bank with principal place of business at 27777 Inkster Road, Farmington Hills, Michigan 48333. 2. Defendant, John G. Myers, Sr., is an adult individual residing at 63 N. Middleton Road, Carlisle, Cumberland County, Pennsylvania. 3. On or about March 21, 1995, Forward Financial Company and defendant entered into a loan agreement whereby Forward Financial Company lent to defendant and defendant borrowed from Forward Financial Company the sum of $63,324.00. The terms of said loan are set forth in a written agreement signed by defendant, a true and correct copy of which is attached hereto as Exhibit A and incorporated herein by reference. 4. All of Forward Financial Company's right, title and interest has been assigned by plaintiff by virtue of an assignment, a true and correct copy of which is attached hereto as Exhibit B and incorporated herein by reference. 5. Pursuant to the terms of said agreement, defendant agreed to make monthly payments in the amount of $763.89 commencing May 5, 1995, and continuing on the fifth day of each month the~eafter. Each payment was to be applied to interest at the rate of 12.040' per annum, the balance to principal. 6. Concurrent with said agreement, defendant executed a mortgage dated March 21, 1995, in favor of plaintiff to secure the sum of $63,324.00. Said mortgage is recorded in the Office of the Recorder of Deeds in and for CUmberland County in Mortgage Book 1257, page 949. A true and correct copy of said mortgage is attached hereto as Exhibit C and incorporated herein by reference. 7. Defendant is in default under said note and mortgage in that he has failed to make the payment due December 5, 1995 and any subsequent payments. Pursuant to the terms of said note and mortgage, plaintiff is entitled to accelerate the entire remaining balance on said loan. As of the date hereof, the balance owed to the plaintiff is as follows: $63,171.46 principal balance $ 1,805.51 accrued interest to February 20, 1996 plus interest thereafter at the rate of $20.78 per day. 8.
