Plaintiff is an adult individual who currently resides at 2611 Market Street, Camp Hill, Cumberland County, Pennsylvania. 2. Defendant is a local agency who has an address of 2145 Walnut Street, Camp Hill, Cumberland County, Pennsylvania, 17011. 3. On March 9, 2002, a sewer line, owned by the Defendant and located within its right-of-way backed up causing sewage to enter Plaintiff's finished basement, 4. The sewage back-up was caused by a dangerous condition of the sewer line. 5. The dangerous condition created a foreseeable risk of a back-up into the Plaintiff's home. 6. It is believed and therefore averred that the Defendant had actual and/or constructive notice of the dangerous condition, 7. As a result of the sewage back-up, Plaintiff's personal property was damaged in the amount of $762.38. A copy of the estimate demonstrating this damage is attached hereto as Exhibit "A". 8. Plaintiff received compensation from his insurance carrier in the amount of $262.38 for the a.bove-referenced damages. Thus, Plaintiff has suffered damages in the amount of $500 as a result of the above-referenced incident, WHEREFORE, Plaintiff demands judgment against the Defendant in the amount of $500, together with interest, delay damages and costs of suit, which is an amount requiring this matter to be submitted to compulsory arbitration. Answering Defendants asserts all defenses, limitations and exclusions available under governmental immunity, including but not limited to those found in 42 Pa.C.S. ~854I et seq., and including but, limited to the notice provisions of 42 Pa. C.S ~5522. 10. Without admitting liability, Answering Defendant can at most be secondarily liable and is not primarily liable to plaintiff 11. Rule 238 of the Pennsylvania Rules of Civil Procedure, on its face, and as applied is violative of the Due Process and Equal Protection Clauses of the Fourteenth Amendment to the Constitution of the United States, ~1983 of Title 42 of the United States Code and Article I, ~1, 6, 11 and 26 and Article V, ~10(c) of the Pennsylvania Constitution and imposes a chilling effect on the exercise by Defendant of its constitutional rights. 14. !fit is determined that the Answering Defendant is liable on the plaintiff's cause of action, answering defendant avers that plaintiff's recovery should be eliminated or reduced in accordance with the Pennsylvania Comparative Negligence Act, 42. Pa. C.S. ~7102. 15. It is further averred that if the plaintiff suffered any injuries/damages, they were caused solely and primarily by the plaintiff's own carelessness and negligence. 16. It is further averred by answering defendant that if the plaintiff suffered any damages as alleged, said plaintiff assumed the risk of those damages. 17. Defendant asserts all the defenses and limitations of any tariffs and/or agreements between plaintiff and defendant.
