Facts Aoclicable to All Counts
AND NOW comes the Plaintiffs, THOMAS P. SCHLAGER and
BARBARA A. SCHLAGER, His Wife, by and through their
attorneys, LAW OFFICES OF TIMOTHY A. SHOLLENBERGER, and do
respectfully represent the following:
1. Plaintiff, THOMAS P. SCHLAGER, is the Administrator
of the Estate of Christopher T. Schlager, by virtue of
Letters of Administration granted by the Register of Wills,
Cumberland County, Pennsylvania on August 4, 1995. A copy
of these letters is attached hereto and incorporated by
reference herein as Exhibit A.
2. Plaintiffs, THOMAS P. SCHLAGER and BARBARA A.
SCHLAGER, are the parents of the Decedent, CHRISTOPHER T.
SCHLAGER and currently reside at 2157 Douglas Drive,
Carlisle, Cumberland County, Pennsylvania.
3. Def.endant, BEMIS COMPANY, INC., t/d/b/a BEMIS
PACKAGING MACHINERY CO. (hereinafter referred to as "Bernis")
is a Missouri corporation which does business under the
assumed name of BEMIS PACKAGING MACHINERY CO., and has its
principal place of business at 222 S. 9th Street,
Minneapolis. Mn. 55402, and a registered office in
Pennsylvania at 1635 Market Street, Philadelphia. Pa.

4. Faragraphs 1 through 3 of the Plaintiff's Complaint
are incorporated by reference herein as if set forth in
full.
5. Defendant, "BEMIS" is in the business of
manufacturing, selling, and/or distributing packaging
machinery, including such types of machinery as bag
handling, palletizing, form, fill and seal machinery, as
well as bag flattening machinery designed to flatten or
compress product that is already bagged and sealed.
6. Prior to July 12, 1995, Defendant, "BEMIS", did
sell, distribute, and deliver to HOLLY MILK, a division of
the Atlantic Dairy Cooperative, several pieces of packaging
machinery designed to fill, seal, position, flatten and
palletize bags of powdered milk including a machine bearing
a label identifying its manufacturer as BEMIS PACKAGING
MACHINERY CO. and as No. 3028A-30, hereinafter referred to
as the "bag flattener". This equipment was then assembled
and installed at the Holly plant by the agents, servants,
and or employees of "BEMIS".
7. On Wednesday, July 12, 1995, at or about 3:43 A.M.,
Plaintiff's Decedent, CHRISTOPHER T. SCHLAGER, was working
on a bag filling/sealing/positioning/flattening line located
at the Holly Milk plant at 405 Park Drive, Carlisle,
Cumberland County, Pennsylvania.
8. The line on which plaintiff's Decedent was working
contained machinery manufactured, sold and/or distributed to
Holly Milk by "BEMIS" and was configured by "BEMIS" in such
a way that it facilitated first the filling of an upright
bag with powdered milk, then transported the bag to a bag
sealing machine, where it was sealed and then manually
rotated and laid down on a conveyor which transported the
bag to the "bag flattener".
9. A bag of powdered milk that had been filled and
heat sealed had to be manually straightened by the Decedent

to allow it to appropriately pass through the "bag
flattener".
10. As he did so, Decedent's fingers became lodged in
the dual (lower and upper) belt conveyor roller assembly of
said "bag flattener" at its point of operation/entry.
11. The action of the dual conveyor assembly pulled
Decedent's arm and then his upper torso in between the dual
moving conveyor belts which are a part of the compression
assembly of the "bag flattener." As a direct and proximate
result thereof, Decedent suffered injuries causing his death
by compressional asphyxia.
12. At the date and time above mentioned, there was no
substantial change in the condition of said "bag flattener"
or the other machines comprising the line since the date
they were sold to Holly Milk.
13. Said "bag flattener" and the bag filling, sealing,
forming and flattening machines comprising the bag filling/
sealing/positioning/flattening line were in a defective
condition, unreasonably dangerous to users, consumers or
third persons in the vicinity of their use in that:
a. The safety trip wire cable on the "bag flattener" was
not properly identified and did not, upon activation,
separate the upper and lower conveyor belts on the bag
flattening machine and/or did not place the bag
flattening machine at a total zero energy state;
b. The "bag flattener" was not equipped with a positive
(physical) guard at or near the point of operation
which would prevent a human torso from entering at its
in-running nip point;
c. The infeed conveyor lacked a bag turner/tipper to
rotate and then lay the filled bag on the conveyor;
d. The infeed conveyor lacked side plates which would act
as guides to center the bag after it was turned and
tipped;
e. The "bag flattener" lacked a presence sensing device
which would bring it to a zero energy state and
separate its upper and lower conveyor if an object
other than a bas was detected by the device;

f. The conveyor release mechanism of the bag flattening
machine was improperly designed and/or manufactured
causing it to fail when workers attempted to activate
it to release the upper and lower conveyors on the bag
flattening machine;
g. The conveyor release mechanism of the "bag flattener"
was not designed to achieve an instantaneous zero
energy state comparable to that of the belt drives;
h. The flattening machine did not have adequate warnings
or signs in the section immediately prior to the point
of operation/entry, including, but not limited to the
following:
i. failure to paint the conveyor frame an appropriate
color;
ii. failure to sign or label said section by advising
those in its area of use that they should not
place hands or other body parts at or near the
point of operation;
i. Despite prior knowledge of the layout of Holly's bag
filling/sealing/positioning/flattening operation,
Defendant failed to include a transfer/infeed conveyor
to provide safe orientation and handling of a bag prior
to its entering the "bag flattener;
j. The "bag flattener" did not include a feature that
would reverse the direction of the top and bottom
conveyor as part of an emergency stop and "zero energy
shutdown" .
k. The top conveyor cover of the "bag flattener" was of
inadequate length thereby exposing the user to its
point of operation/entry.
14. The defects set forth in paragraph 13 a-k existed
at the time said machinery left "BEMIS's" possession and
control.
15. Plaintiff, Decedent, CHRISTOPHER T. SCHLAGER, was
unaware of the defective and unreasonably dangerous
condition of the "bag flattener" and the other machines
comprising the bag filling, sealing, positioning, forming
and flattening line.
16. Christopher Schlager's injuries were the direct

and proximate result of the unreasonably dangerous and
defective condition of said "bag flattener" and the other
machines comprising the bag filling, sealing, positioning
and flattening line and. therefore, Defendant BEMIS COMPANY,
INC. t/d/b/a/ BEMIS PACKAGING MACHINERY CO. is strictly
liable in tort.
Neqliqence
17. Paragraphs 1 through 16 of the Complaint are
incorporated by reference herein and made a part hereof as
if set forth in full.
18. The aforementioned incident is the direct and
proximate result of the careless, reckless and negligent
conduct of Defendant "BEMIS" acting through its agents,
servants and/or employees in that it:
a. Failed to advise the Plaintiff of the
fllling/sealing/positioning/flattening risks
attendant to the use of the bag equipment;
b. Placed the aforementioned machine on the market
when it knew or should have known they lacked
safety devices that would have prevented a person
from getting caught in the dual conveyor assembly
of the "bag flattener";
c. Placed its bag flattener on the market with an
emergency pull cord that was not properly
designated as such and which did not separate the
conveyors of the dual belt conveyor assembly;
d. Placed a "bag flattener" on the market without a
mechanism to "quick release" the dual belt
conveyor assembly;
e. Failed to exercise reasonable care in assembling
and installing the equipment comprising the bag
filling/sealing/positioning/palletizing line on
which Plaintiff's Decedent was working;
f. Placing its "bag flattener" on the market without
a positive (physical) guard that would prevent a
person from getting any portion of their body
caught or lodged in its dual belt conveyor
assembly and the moving conveyor belts which are a
part of said assembly; and

g. In failing to make available to Holly Milk all
devices necessary to make its "bag flattener" safe
for its intended use.
SURVIVAL ACTION
19. Paragraphs 1 - 18 of the Plaintiff's complaint are
incorporated by reference herein and made a part hereof as
if set forth in full.
20. Plaintiff, THOMAS P. SCHLAGER, brings this action
on behalf of the Decedent of and by virtue of the provisions
of P. L. 508, as amended by P. L. 202, No. 53, !l8(13), (20
Pa. C. S. A., !l3371) and by virtue of P. L. 586, No. 142, !l2
(42 Pa. C. S. A., !l8302).
21. During the time from the incident set forth above
until his death, the Decedent sustained mental and physical
pain and suffering for which d~mages are claimed.
22. At the time of his death, Plaintiff was twenty two
(22) years old having been born on July 25, 1972.
23. As a direct and proximate result of the aforesaid
incident I Decedent suffered a loss of gross earnings and
gross earning power in excess of his personal maintenance
expenses from the time of his death to the end of his life
expectancy for which damages are claimed.
WHEREFORE, the plaintiffs demand judgment of Defendant,
BEMIS COMPANY and BEMIS PACKAGING MACHINERY CO., in excess
of the jurisdictional amount requiring compulsory
arbitration.

25. The Plaintiff, THOMAS P. SCHLAGER, is bringing
this action of behalf of the beneficiaries of the Decedent
by virtue of the provisions of the Act of July 9, 1976, P.L.
586, No. 142, 52, as amended by P.L. 1409, No. 326, Article
II, ~201 (42 Pa. C. S. A. ~8301). No action was instituted
during the lifetime of the Decedent and no action for his
death is presently pending against the Defendant herein.
26. The Plaintiff brings this action on behalf of the
following persons who are entitled to recover damages in
this action:
Thomas P. Schlager, Father of the Decedent
Barbara A. Schlager, Mother of the Decedent
The present residence address of the above individuals
is 2157 Douglas Drive, Carlisle, Cumberland County,
Pennsylvania.
27. By reason of the death of the Decedent as set
forth above, the Decedent or his estate incurred hospital,
funeral, medical, burial and estate administration expenses
for which damages are claimed.
28. By reason of the death of the Decedent caused by
the Defendants as set forth above, Decedent's family have
sustained the loss of the pecuniary value of the services,
society, and comfort that he would have given to them had he
lived, including but not limited to work around the home,

but it is denied that it does business under the assumed name of Bemis Packaging Machinery Co.,
which instead is a solely owned division of Bemis Company. Inc.
Strict Liability
4, The answers to paragraphs I through 3 above are incorporated by reference in answer
to 1]4,
5, Admitted,
6, The averments of1]6 are admitted and denied. While it is admitted that Defendant
Bemis sold, delivered and distributed to Holly Milk equipment to llatten and palletize bags of
powdercd milk, it is denied that Bemis Packaging Machinery Co. manufactured the bag llattener and,
instead, it is averred that McCullough & Company manufactured the Dura-Pak bag llattener conveyor
which Bemis distributed to Holly Milk in this instance; it is denied that Bemis sold, distributed or
delivered to Holly Milk equipment to fill, seal and position and it is further averred that it is believed
that the packaging line in question consisted of equipment in the nature of a Niro bag filler and St.
Regis bag sealer. While these pieces of equipment would have been placed in a line. the individual
pieces of equipment had been pre-assembled by the manufacturers and installation consisted in
conjunction with Holly plant employees with merely attaching the pre-existing items to each other
in the line,
7, It is believed contrary to some of the allegations of1]7 that Mr. Christopher Schlager.
a temporary help supplied by Manpower. was one of three workers on the bag
fillinglsealing/positioning/llattening line and that he was located at the sealer/llattener area.

8, The averments of~8 are admilled and denied. The only machinery manufactured by
Bemis which was on the line was the palletizer. which was not involved in this accident at all; while
it is admilled that Bemis distributed and sold to Holly Milk the llallener, the llallener was
manufactured by McCullough & Company; Bemis did not provide by manufacturing, sale or
distribution machinery to facilitate the tilling. the transportation to a bag sealing machine, or transport
to the llallener and strict proof thereof to the contrary is demanded if relevant at time of trial; by way
of further answer, it is believed and therefore averred that Holly Milk rejected the use of a mechanical
device to be used rather than the manual rotation of the bag after it was sealed and as it entered the
bag llallener.
9, After a reasonable investigation, the answering Defendant is without knowledge or
information sufficient to form a belief as to the truth of the averments of ~9 and the same are
therefore denied and proof thereof demanded and, by way of further answer. it is believed that the
McCullough llallener conveyor contained a shut off device to be utilized to shut off the equipment
if it were necessary for any manual straightening.
10. After a reasonable investigation, the answering Defendant is without knowledge or
information sufficient to form a belief as to the truth of the averments of ~ I 0 and the same are
therefore denied and proof thereof demanded, it being further alleged that if in fact this did occur. it
did occur when the decedent failed to utilize the emergency stop located at the in-teed of the
McCullough bag llallener and around its side.
II, After a reasonable investigation. the answering Defendant is without knowledge or
information sufficient to form a belief as to the truth of the averments of ~ II and the same are

therefore denied and proof thereof demanded; by way of further answer. Defendant incorporates by
reference as if set out in full its answer to ~9 and ~ I o.
12. After a reasonable investigation. the answering Defendant is without knowledge or
information sufficient to form a belief as to the truth of the averments of ~ 12 and the same are
therefore denied and proof thereof demanded. it being further averred, as previously alleged that the
bag Ilattener was manufactured by McCullough and while distributed and sold by the answering
Defendant, the other machines ahead of the bag Ilattener were manufactured by Niro and Sl. Regis
and were not sold or supplied or distributed by the answering Defendant and strict proof thereof to
the contrary is demanded if relevant at time of trial.
13, Many. if not all, of the averments of~13 consist of legal conclusions of the Plaintiffs
and/or their counsel which, under the Rules of Civil Procedure, are deemed to be denied and no
response is necessary; by way of further answer, the answering Defendant did not manufacture, sell
or distribute the bag filling machine. which was a Niro bag filler, or the Sl. Regis bag sealer or any
fonning machine referred to; the flattening machine was manufactured by McCullough; it is believed
and therefore averred that the Ilattener conveyor designed, manufactured and assembled by
McCullough & Company was not in a defective condition unreasonably dangerous to users,
consumers or third parties in the vicinity of their use at the time that that machine was sold or
delivered or distributed by the answering Defendant to Holly Milk and the remaining averments of
~IJ are denied pursuant to Rule I029(e) pursuant to this answer. any liability or re~ponsibiiity on
behalf of the answering Defendant being hereby expressly denied.

14. The avennents of~ 14 consist oflegal conclusions to which no response is necessary
and, in any event, the answer to ~ 13 is incorporated by reference in answer thereto. While it is
admitted that the McCullough flattener conveyor was distributed and sold by the answering
Defendant, it is denied that the Niro bag fillers, St. Regis bag sealer or other machinery left "Bemis'
possession and control" and strict proof thereof to the contrary is demanded as well as the allegations
concerning deficiencies in any of the equipment. any liability or responsibility on behalf of the
answering Defendant being hereby expressly denied,
15. The avennents of this paragraph constitute legal conclusions to which no response is
required under the Rules of Civil Procedure. the averments being deemed to be denied; by way of
further answer, the remaining avennents of the paragraph are denied in confonnance with the answers
to paragraphs I through 14 above, any liability or responsibility on behalf of the answering Defendant

necessary; to the extent an answer is required. it is denied that Bemis was negligent. careless or
reckless generally or in any of the particulars alleged or that anyone on whose behalf it can be liable
were responsible for liability producing conduct; by way of further answer, the remaining averments
of ~18 are denied pursuant to Rule I029(e), it being further averred that while the answering
Defendant admits distributing a McCullough flattener conveyor, the answering Defendant did not
manufacture the flattener conveyor but instead it was designed and manufactured by McCullough;
by way of further answer, the Niro bag filler and St. Regis bag sealer were products manufactured
and designed by others and not supplied by the answering Defendant. with the answering Defendant
merely assisting in the placement and start up of the pre-assembled items designed and manufactured
by others as they relate to the Bemis palletizer and proof of liability on behalf of the answering
Defendant is hereby demanded if relevant at time of trial,
SURVIVAL ACTION
19-23, After a reasonable investigation, the answering Defendant is without knowledge or
information sufficient to form a belief as to the truth of the averments of these paragraphs and the
same are therefore denied and proof thereof demanded, any liability or responsibility on behalf of the
answering Defendant being hereby expressly denied,

29, It is believed and therefore averred that the Holly Milk operation is a powdered milk
processing and packaging line,
30, The packaging line at Holly Milk at the time of this incident consisted ofa Niro bag
filler, St, Regis bag sealer, McCullough flattener conveyor and Bemis 1000 palletizer.
31. The McCullough flattener conveyor was a McCullough Dura-Pak Model 893 bag
flattener/conditioner conveyor which was designed, manufactured, assembled. marketed, tested and
placed in the stream of commerce by McCullough & Company, 4717 East I 19th, Kansas City,
Missouri, 64134.

32. Although Bemis was on site and participated in the sale and distribution of the
McCullough l1attener conveyor and the Bemis 1000 palletizer. Bemis was not involved with the sales,
supply, distribution or the design or manufacturing of items ahead of the l1attener in the packaging
line. i.e. the Niro bag filler and St, Regis bag sealer.
33. The layout of the equipment and the design thereofwaa not Bemis'.
34. It is believed and therefore averred that this packaging line had been operational at
Holly Milk at least six months before this incident and that Holly Milk had trained its personnel and
anyone else including temporary help who were in proximity to or operating the machine in all safety
aspects of the equipment, including safe use thereof
35. It is believed and therefore averred that McCullough, lIlIthe mWlufacturer and designer
of the flattener, had an emergency orange colored cord actingllll an emergency stop cord located at
the in-feed of the bag flattener and around the side of the machine, which orange cord, when pulled,
would immediately stop the system and acted as an emergency stop for the bag flattener.
36, If, as suggested in the Plaintiffs' Complaint. the Plaintiffs' decedent decided to
manually straighten a bag of powdered milk that had previously been filled and heat sealed, the
Plaintiff should have engaged the orange emergency stop cord before proceeding to manually
straighten the bag to avoid any risk of harm by reaching or placing parts of his body into an area of
the roller belt conveyor assembly at or near the piece of equipment.
37, It is believed and therefore averred that the Plaintill's' decedent. Mr. Chris Schlager.
was a temporary help supplied by Manpower who was permitted by Holly Milk to operate or be in
proximity to the equipment where he was injured

38. It is believed and therefore averred that the Plaintiffs' decedent, Mr. Chris Schlager.
had been trained by Holly Milk concerning risks, dangers and potential risks and dangers associated
with common or other associated hazards of moving pieces of equipment such as the machines on
the line in question.
39, It is believed and therefore averred that the Plaintiffs' decedent. Mr. Chris Schlager.
having been trained by Holly Milk on the operation and hazards and risks of the machinery in question
had also been told and/or was aware that the orange cord was an emergency stop which was or
should be activated by pulling the cable to disengage the motors or drivers of the roller belt conveyor
assembly before placing any part of his body at, near or around the moving equipment to manually
straighten a bag,
40, Plaintiffs' decedellt, Mr. Chris Schlager, had been told or informed by Holly Milk that
he should not manually straighten any bag passing through or at, near or around the entry of the bag
flattener without activating the orange cable which was an emergency stop located at the inseed of
the bag flattener and around its side, all as designed by the manufacturer. McCullough & Company.
41. It is believed and therefore averred that Plaintiffs' decedent died instantly.
42, Although it is averred by the Plaintiffs that the bag flattener in question was a machine
bearing a label identifYing its manufacturer as Bemis Packaging Manufacturing Company and as No.
3028A-30, the bag flattener was not designed and manufactured by Bemis Packaging Manufacturing
Company. but instead was designed and manufactured by McCullough & Company as previously
alleged, it being further asserted that Holly Milk knew that McCullough manufactured and designed
the bag flattener, inw: lIlia. as McCullough had previously sent a demonstration model to Holly Milk

AND NOW comes the Plaintiff, THOMAS P. SCHLAGER et.
al., by and through their attorneys, LAW OFFICES OF TIMOTHY
A. SHOLLENBERGER, and filed the following Answer to
Defendant's New Matter:
29. Admitted.
30. Admitted and Denied. Admitted in part and denied
in part. It is admitted that the processing packaging line
at Holly Milk at the time of this incident consisted of a
bag filler, bag sealer, flattener, conveyor and palletizer.
plaintiff is after reasonable investigation without
knowledge sufficient to form a belief as to the truth of the
averments with respect to the manufacturer, designer or
assembler of said machine as alleged by the Defendants.
Therefore said averments are denied and strict proof is
demanded at time of trial.
31. Plaintiffs, after reasonable investigation, are
without knowledge sufficient to form a belief as to the
truth of the averments contained in Paragraph 31 of
Defendant's New Matter. On the contrary, an inspection of
the machine has revealed a label affixed thereto indicating
that the flattener was manufactured by Defendant Bemis.
32. Admitted in part and Denied in part. Defendant
admits that Bemis was on site and participated in the sale

and distribution of a flattener/conveyor and pallatizer.
Plaintiff is, after reasonable investigation, without
knowledge sufficient to form a belief as to whether the
flattener/conveyor was manufactured by McCullough as alleged
by Defendant. Plaintiff admits that the palletizer was
manufactured by Defendant Bemis. Plaintiff is, after
reasonable investigation, without knowledge sufficient to
form a belief as to whether Bemis was involved with the
sales, supply, distribution or design or manufacturing of
items ahead of the flattener and the packaging line, i.e.
the Nyro bag filler and the St. Regis bag sealer and,
therefore, same is denied and strict proof thereof is
demanded at the time of trial.
33. Denied. Plaintiffs are, after reasonable
investigation, without knowledge sufficient to form a belief
as to whether the layout of the equipment and design
thereof was not Bemis'. On the contrary, there are numerous
stickers and labels on the equipment, including the bag
flattener, which state that Bemis was the manufacturer of
that equipment and Bemis personnel were on site and
participated in the sale and distribution of the
flattener/conveyor and palletizer.
34. Plaintiff is without knowledge sufficient to form
a belief as to whether the packaging line had been
operational for at least six months before the incident
and/or whether Holly Milk had trained its personnel or
anyone else, including temporary help, who were in proximity
to operating machinery in all safety aspects of the
equipment, including the safe use thereof, and strict proof
is demanded at the time of trial. Plaintiff admits that the
packaging line had been operational at Holly Milk for some
period of time before this incident.
35. Admitted in part and Denied in part. It was
admitted that there was a cord located at or near the in-
feed of the bag flattener and around the side of the machine
which cord when pulled would stop the system. Plaintiff is

without knowledge sufficient to form a belief as to its
color. Plaintiff is without knowledge sufficient to form a
belief as to whether if pulled it would immediately stop the
system and/or if it would act as an emergency stop for the
bag flattener. By way of further answer, pulling the cord
would not release the dual conveyors of the bag flattener
between which the Plaintiff's decedent was crushed.
Plaintiff is also without knowledge sufficient to form a
belief as to whether McCullough was the manufacturer or
designer of the machine and therefore provided the emergency
cord and strict proof thereof is demanded at the time of
trial.
36. Denied. Plaintiffs are, after reasonable
investigation, without knowledge sufficient to form a belief
as to whether plaintiff should have engaged the stop cord
before proceeding to manually straighten the bag to avoid
any risk of harm by reaching, placing parts of his body into
an area of the rolJer, belt, conveyor, assembly at or near
the piece of equipment and strict proof thereof is demanded
at the time of trial.
37. Admitted and Denied. It is admitted that
Christopher Schlager was permitted by Holly Milk to operate
or be in proximity to the equipment where he was injured and
it is further admitted that Christopher Schlager was
temporary help and that he was supplied by Manpower.
38. Plaintiffs are, after reasonable investigation,
without knowledge sufficient to form a belief as to whether
Christopher Schlager had been trained by Holly Milk
concerning risks, dangers and potential risks and dangers
associated with common or other associated hazards in moving
pieces of equipment such as machines on the line in question
and, therefore, same are denied and strict proof demanded at
time of trial. Plaintiffs are, after reasonable
investigation, without knowledge sufficient to form a belief
as to whether Christopher Schlager had been trained by Holly
Milk on the operation, hazards and risks of the machinery in

question and had been told and/or was made aware that the
cord was an emergency stop which was or should be activated
by pulling the cable to disengage the motors or drivers of
the rollerbelt conveyor assembly before placing any part of
his body at, near or around the moving equipment to manually
straighten a bag, and therefore, same is denied and strict
proof thereof demanded at time of trial. Plaintiffs are
without knowledge sufficient to form a belief as to whether
plaintiff decedent, Chris Schlage=, had been told or
informed by Holly Milk that he should not manually
straighten any bag passing through or at, near or around the
bag entry of the bag flattener without activating the cable
which was an emergency stop located at the in-feed of the
bag flattener around the side and/or that the bag flattener
had been designed by or manufactured by McCullough and Co.
and same is therefore denied and strict proof demanded at
time of trial.
41. Denied. On the contrary, Plaintiff's decedent's
death was not instantaneous as alleged and he did
consciously suffer for a brief period of time.
42. Plaintiffs are, after reasonable investigation,
without knowledge sufficient to form a belief as to the
truth of the averment that the bag flattener was not
designed and manufactured by Bemis Packaging Manufacturing
Co. despite the fact that the machine bears a label stating
precisely the reverse and was instead manufactured and
designed by McCullough & Co. and/or that Holly Milk knew
that McCullough manufactured and designed the bag flattener
and/or that McCullough had previously sent a demonstration
model to Holly and/or that Holly Milk felt obligated to buy
the McCullough flattener through Bemis as a distributor
because McCullough had previously sent a demonstration model
and said averments are therefore denied and strict proof
thereof is demanded at the time of trial.
43. Paragraph 43 of the Defendant's New Matter is in
the nature of a conclusion of law and to that extent

Packaging Machinery Company, a division of Bemis Company,
Inc. or Bemis Company. Inc. and its agents, servants,
employees, successors, or assigns.
"Bag flattener" means the Dura-pak Model 893 Bag
Flattener/Conditioner Conveyor which was part of the Niro
dried milk packaging line at Holly Milk and to WhlCh was
affixed a label identifying its manufacturer as "Bemis
Packaging Machinery Co." and as No. 3028A-30.
"Defendant Bemis" means Bemis Company, Inc. t/d/b/a Bemis
Packaging Machinery Company, Bemis Company, Inc. and/or
Bemis Packaging Machinery Company, a division of Bemis
Company, Inc.
"Document" means any written, printe.d, typed, or other
graphic matter of any kind or nature, however produced or
reproduced, including photographs, microfilms, phonographs,
video and audio tapes, punch cards, magnetic tapes, discs,
data cells, drums, and other data compilations from which
information can be obtained.
"Identify" or "Identity" means when used in reference

13. The McCullough order acknowledgement sent by
McCullough to Bemis and ref~renced in response to
Plaintiff's Request for Production of Documents No.7 a. is
the only document that Defendant Bemis has in its
possession, control or of which it has knowledge that is
responsive to Plaintiff's Request for Production of
Documents, Set No.1 requesting the design specifications,
plans, drawings, owners manual, written instructions, plan
of installation, brochure, marketing materials, or other
documents provided to Holly Milk by Bemis with respect to
McCullough's Dura-Pack 893 Model bag flattener/conditioner
conveyor which Defendant alleges was the bag flattener sold

The Infeed Conveyors "Start" and Weed Conveyors
"Stop" pushbutton. allow the operator to control the flow
of bags into the system. The "Mode" switch must be in
the "Auto" position in order Cor the conveyors to run. If
the conveyors are running and the "Mode" switch is
turned to the "Manual" position, the inCeed conveyors
will stop.
Pallet Conveyor "J OC"
The Pallet Conveyor "Jog" pushbutton can be pressed
when the Mode switch I! either in the "Auto" or
''Manual" mode. When pressed, an empty pallet will
travel to the pallet load position. In order Cor the Pallet
Conveyor to run, pallet separation and optional
slipsheeting must be complete and there can be no pallet
at the pallet loading position. If the empty pallet jams
and doesn't make it to the pallet loading position within
a certain amount of time, the Pallet Conveyor stops.
This pushbutton is also on the pallet magazine controls.
Layer Compression .OmOn" (Optional)
The Layer Compression "OWOn" selector switch can be
used any time to turn Layer Compression "Off" or "On".
When Layer Compression is "On," and the palletizer is
operating in "Auto" mode, Layer Compression will oa:ur
on each layer after the first layer. Compression is
controlled by a timer that starts after the Load Height
Position (UIP) photo eye gets blocked. When
compression time elapses, the layer of bags will be raised
for a shon time before the Stripper Plate is retracted to
deposit the layer of bags.
Mode "Auto/Manual.
The Mode "AutolManual" selector switch can be used to
select the mode of operation. When the Mode switch is
in the "Auto" position with Palletizer "Power On" and the
Infeed Conveyors "On" the palletizer will run
automatically. When the Mode switch is in the "Manual"
position, manual functions are enabled.
Hand Palletlzlnc .OmOn" (Optional)
When a Hand Palletizing "OWOn" selector switch is
located at the Palletizer Control Station, hand stacking is
done at the Bag Reject Conveyor. When turned "On,"
all bags are divened at the Bag Reject Conveyor.

Stripper Arm "RalselLower"
The Stripper Arm "Raise/LOwer," three-position,
spring-retum-to-center selector switch can be used to
"Raise" or "Lower" the Stripper Arm when the palletizer
is in the "Manual" mode. When the selector switch is
turned to the "Lower" position, the Stripper Arm will
lower. The Stripper Arm will stay lowered until the
selector switch is turned to the "Raise" position or until
the mode selector is switched from "Manual" to "Auto."
Pallet Eject
The Pallet Eject pushbutton discharges a pallet from the
pallet load position onto the pallet discharge conveyor if
the mode selector switch is in "Manual." The pallet will
eject only after pallet separation is complete, if optional
slipsheeting is complete, or if the pallet magazine is
empty, and after the Layer Lift Carriage has raised to
the Load Height Position (UiP) photo eye, and after the
previously discharged pallet is removed clearing the Load
Cear Position (Lep) photo eye. The Load Cear
Position (LCP) photo eye must be clear Cor 15 seconds
beCore the pallet will eject.
Once the Load Clear Position (LCP) photo eye gelS
blocked on the pallet discharge conveyor by the ejected
pallet and the next pallet is indexed to the Pallet Load
Position (pLP) proximity switch, another pallet
separation cycle will be initiated.
When the Mode "Auto/Manual" selector switch is
returned to the "Auto" position and the pallet eject cycle
is complete, the Layer Lift Carriage will automatically
return. to the Layer Lift Home Position (LU-I).
Halt Pusb
The Half Push pushbutton can be used to ext~nd the
Pusher Arm to the "Row" position if the machine is in
the "Manual" mode of operation. When the pushbutton
is pressed, the Pusher Arm will extend if the Layer Lift
Carriage is home and the Layer Pusher Cear (LPC)
photo eye is clear. The Pusher Arm win conlinue
Corward (even if the pllshbutton is released) until the
Pusher Row Position (PRP) proximity switch is actuated.
When the Half Push cycle is complete, the Pusher Arm
will automatically return to the home, Pusher Home
Position (PHP) proximity switch, position.

WARRANTY ADMINISTRATION POLICY
All parts and equipment purchased by Bemis and covered by
manufacturers warranty are, in turn warranted to the purchaser per the
provisions of the Bemis standard "Terms and Conditions of Sale",' In
summary, this warranty provides protection for the purchaser of Bemis
packaging and palletizing equipment against defects in material and
workmanship for ninety (90) days from the date of shipping in the case
of electronic components, and one (1) year from the date of shipping for
the other components, excluding those parts of the equipment considered
expendable such as plastic wear guides, hoses, lamps, belts, cutting
knives, connecting pins, elastomeric components, vacuum cups, etc.
Bemis will, at the sole option of each of the operating companies, repair
or replace those components found to be defective and covered by
original equipment manufacturers according to the provisions of their
warranties. Physical rElmoval and installation of replaced or repaired parts
is not included in the warranty. However, service personnel are available
to perform these services for parts covered by warranty at currsntly
published service rates.
Labor and expenses related to replacement or installation of parts under
warranty will be invoiced at applicable standard rates.
Note:
Changes to programmable controller logic (progllml. equipment or parts mad.
by purchaser without prior knowledge and wrin.n approval of the appropriate
operating company may result in undesirable machine operation and may void
the warranty. All program changes must be approv.d prior to installation to
prev.nt pOSSible equipment damage or personal injury. Bemis Company
assumes no liability for changes made without prior approval.

Shollenberger for reimbursement of legal
expenses incurred, the sum of $8,638,47;
2) For legal fees to the Law Offices of
Timothy A. Shollenberger and William R. Bunt,
Esq. the sum of $200,000;
)) For payment of the workers' compensation lien
alleged by Fireman's Fund, the sum of $1,900;
4) The wrongful death proceeds of $331,042.30
shall be distributed to Thomas and Barbara
Schlager I
5) The proceeds allocated to the survival action
of $58,419.23 are to be turned over to
William R. Bunt, Esq" as Attorney for the
Estate of Christopher T, Schlager; and.
6) The details of said settlement are to be kept
under seal and not be subject to public
scrutiny.

2. The Petitioners. Thomas Schlager and Barbara
Sohlager. are the parents of the Deceased. Christopher T,
Schlager. and currently reside at 2157 Douglas Drive,
Carlisle, Cumberland County, Pennsylvania,
3. Jurisdiction of this Court is conferred by virtue
of the county of Decedent's residence at the time of his
death. the fact that an estate was initiated in Cumberland
County and the fact that the above-captioned action was
initiated in Cumberland County.
4, On or about July 12, 1995. Plaintiffs' Decedent,
Christopher T. Sohlager was working on bag
filling/sealing/positioning/flattening line located at the
Holly Milk Plant. 405 Pa~k Drive. Carlisle. Cumberland
County, Pennsylvania,
5, Plaintiffs have alleged that Christopher T.
Sohlager was working on a line containing machinery sold
and/or distributed to Holly Milk by Bemis Company, Inc,
which was configured in such a way that it facilitated first
the filling of an upright bag with powdered milk. then
transported the bag to a bag sealing machine, where it was
sealed and manually rotated and laid down on a conveyor
which transported the bag to a "bag flattener."
6, Plaintiffs have alleged that a bag of powdered
milk that had been filled and heat sealed had to be manually

straightened by the Decedent to allow it to appropriately
pass through the bag flattener.
7, Plaintiffs have alleged that as he did so, the
Decedent's fingers became lodged in the dual lower and upper
belt conveyor roller assembly of said bag flattener at its
point of operation entry.
8. Plaintiffs have alleged that the action of the
dual conveyor assembly pulled Decedent's arm and then his
upper torso in between the dual moving conveyor belts which
are a part of the compre8sion assembly of the bag flattener.
9, As a direct and proximate result thereof, Decedent
suffered injuries causing his death by compressional
asphyxia.
10. On or about March 21, 1996, the petitioners
through counsel initiated the above-captioned action versus
Bp.mis Company, Inc, t/d/b/a Bemis Packaging Machinery
Company by Writ of Summons,
11, On May 14, 1996, petitioners through counsel filed
a Complaint versus Bemis Company, Inc, t/d/b/a Bemis
Packaging Machinery Company at the above term and number,
12. In its Complaint, the petitioners alleged that
said bag flattener was in a defective condition and
unreasonably dangerous to users, consumers or third persona
in the vicinity of its use and that the incident outlined
above occurred as the result of the negligent conduct of

Defendant Bemis acting through its agents, servants and/or
employees.
13. Said Complaint contained a count entitled
"Survival Action" and a count entitled "Wrongful Death
Action. "
14. Defendant Bemis filed an Answer admitting that it
sold, delivered and distributed to Holly Milk equipment to
palletize bags of powdered milk, denied that it manufactured
the bag flattener, but admitted that it did distribute to
Holly Milk the bag flattener referenced in the Petitioners'
Complaint. Defendant Bemis further alleged that McCullough
and Company had manufactured the bag flattener,
15. Defendant Bemis then filed Praecipes for Writ of
Summons to join as Additional Defendants McCullough and
Company, Atlantic Dairy Cooperative, Manpower Temporary
Services and Amark Packaging Systems,
16. It was alleged that Amark Packaging Systems was a
successor corporation to McCullough and Company.
17, It is believed that Holly Milk is a division of
the Atlantic Dairy Cooperative.
18, It is believed that Manpower Temporary Services is
an employment agency through which petitioners' Decedent was
placed for temporary work at the Holly Milk plant when this
incident occurred,
19. Following the filing of the Complaint and Answer
by the Defendant, extensive discovery ensued between the

21. Plaintiffs received answers and responses to the
various discovery requests, including various discovery
requests made by the Defendant upon various of the
Additional Defendants. In its responses to discovezy,

other associated hazards of moving pieces of
equipment such as the machines on the line in
question;
i. that Plaintiffs' Decedent had been told or
was aware that the orange cord was an
emergency stop which was or should be
activated by pulling the cable to disengage
the motors or drive~s of the roller belt
conveyor assembly before placing any part of
his person at or near or around the moving
equipment to manually straighten a bag;
j. that Plaintiffs' Decedent died instantly;
and,
k. that Plaintiffs' Decedent had been told or
informed by Holly Milk that he should not
manually straighten bags passing through or
at, near or around the entry of the bag
flattener without activating the orange
cable.
23. On July 21, 1995, the Petitioners retained the
services of Timothy A. Shollenberger, Esq. of the Law
Offices of Timothy A. Shollenberger and William R. Bunt,
Esq, to represent the Estate and beneficiaries of the Estate
of the Decedent for this claim.
24. Petitioners agreed to pay a twenty-seven (27%)
percent fee to said attorneys in the event the case was
settled without suit having been initiated and thirty-three
and one-third (33 1/3%) percent once suit was initiated up
to and including the time of trial. A copy of said
Contingent Fee Agreement is attached hereto and incorporated
by reference herein as Exhibit B.
25. After having been retained by the Petitioners,
Plaintiffs' counsel immediately initiated an extensive pre-
trial investigation which included:

a. inter.viewing several witnesses who were at or
near the scene of the incident;
b. arranging for an inspection of the machine;
c. engaging the services of an expert engineer
with specific training and experience in the
area of food processing, machinery and
equipment, Ralph Lambert, P.E,;
d. met with the investigating officer who was in
charge of the investigation of the scene;
e. initiated communications with OSHA who
conducted an onsight inspection on the date
of the incident;
f. met and obtained information from the coroner
who was present at the scene of the incident;
g, requested and arranged for a second
inspection of the machinery after suit had
been initiated and the various additional
defendants joined;
h. conducted an extensive investigation into the
corporate status of Defendant Bemis,
including conducting corporate searches with
the states of Minnesota and Missouri;
i, conducted extensive research into several
legal issues involved in the case;
j. retained and consulted extensively with a
bankruptcy attorney regarding the bankrupt
status of McCullough and Company and filed
the appropriate documents to perfect
petitioners' claim;
k. participated extensively in the OSHA
proceedings which arose following Holly
Milk's appeal of the citations issued to it
by OSHA, including but not limited to filing
a Petition for party status and legal
memoranda in support thereof, as well as
cooperating fully with attorneys for OSHA in
its preparation of the appeal; and,
1. engaged the services of an expert economist,
Craig Houston, to provide expert analysis and
opinion regarding the loss of future earnings

following additional facts with regard to its efforts and
the requested fee of counsel:
a. the requested fee is a reduction from
counsel's normal fee of forty (40%) percent
once suit is filed;
b. there are no minor beneficiaries;
c. counsel has been involved in this case from
its inception, having been retained July 21,
1995;
d. the case involved several complex issues
which were peculiar to this case, including,
but not limited to, issues regarding the
applicability of the exclusivity provisions
of the workers' compensation law; McCullough
and Company's bankrupt status; potential
liability of Amark, the alleged succes"r to
McCullough and Company; the applicabil,ty of
the defenses of assumption of the V> iI. and
contributory negligence; issues relacing to
the legal effect of indemnification language
as between Bemis and Holly Milk; and
spoiliation;
e. Petitioners' counsel, Timothy A,
ShQllenber~er, Esq., has fifteen (15) years
experience in the handling of personal injury
claims and has handled several products
liability cases and continues to handle said
claims at the present and has tried personal
injury cases to verdict in five (5) counties
and the Middle District of Pennsylvania;
f. counsel in the handling of this case has
incurred costs and expenses which counsel is
to be reimbursed under the terms and
conditions of the Contingent Fee Agreement
entered into between themselves and the
Petitioners, The total of these costs and
expenses at the time of the filing of this
petition are Eight Thousand Six Hundred
Thirty-Eight Dollars and Forty-Seven

their judgment are necessary in connection with my claim for

Costs: Costs are to be paid from my share of the total
amount recovered and include, but are not limited to:
photocopies; fax charges; postage; notaries; long distance
telephone charges; mileage for attorneys and staff;
investigation charges; photographs; court costs; LEXIS
research charges; medical records costs; fee for police
report; deposition costs; expert witness fees; stenographer
costs; and, video deposition fees.
In the event that no recovery is obtained on this
claim, the attorneys will make no charges for their time or
services. However, any costs or expenses which the
attorneys may have advanced on behalf of the claim must be
paid by me upon request of said attorneys.
As one possible settlement option, I authorize the said
attorneys to explore the possibility of a structured
settlement through the use of deferred periodic payments, I
agree that if my claim is settled through such structure,
the attorneys' fees may be paid directly to said attorneys
from the insurance company, either in one lump sum payment
at settlement, or, at the sole option of said attorneys
and/or insurance company, deferred into future payments,
However, in any event, said attorneys' fees shall be
calculated in the percentage as set forth above based upon
the cost of the structured settlement or present value
thereof in accordance with applicable law,
All medical bills for which I am legally responsible
incurred as a result of the injuries shall be
chargeable to my share exclusively, unless otherwise paid by
insurance.
The Contingent Fee Agreement applies to all proceedings
up to and including verdict or decision at trial or
arbitration, except proceedings which are or may be required
to collect first party benefits, If, in the discretion of
the attorneys, post-trial proceedings, including appeals,
are warranted, they will not be covered by this Contingent

shareholders, related corporations (including all parents, subsidiaries and affiliates, whether

entities charged or chargeable with responsibility or liability and their assigns, successors, heirs,
executors and administrators, we and/or the estate we represent, ever had, now have, or which
