11. The mother is married to Raymond Miller.
12. The father of the children is Raymond Miller, currently
residing at the Marworth Center, Lilley Lake Road, Waverly,
Pennsylvania, 18471.
13. The father is married to Jennifer Miller.
14. The relationship of plaintiff to the child is that of
grandfather. The plaintiff currently resides with his wife, Lois
Lloyd.
15. Plaintiff has no i~formation of a custody proceeding
concerning the children pending in a court of this Commonwealth.
16. Plaintiff does not know of a person not a party to the
proceedings who has physical custody of the child or claims to have
custody or visitation rights with respect to the child.
17. Plaintiff has not participated as a party or witness, or
ina any other capacity in other litigation, concerning the custody
of the child in this or in any other court.
18. Each parent whose parental rights to the child have not
been terminated and the person who has physical custody of the
child have been named as parties to this action. No other persons
will be given notice of this proceeding except for the parties
hereto.
19. Plaintiff desires, and the best interest and permanent
welfare of the children would be best served by ordering that the
Plaintiff have temporary physical custody of the children pending
furthAr order of court.

AND THEREFORE, the parties hereto, intending to be legally
bound, agree as follows:
1. Legal Custody: Legal custody of the minor children shall
shared between Father and Mother.
2. Primary Physical Custody: Father and Mother shall have
primary physical custody of the minor children.
3. Alternate Physical Custody: Grandfather shall have
physical custody of the minor children in the event both Father and
Mother are voluntarily or involuntarily hospitalized or become
patients in any treatment facility.
4. Court Order: The parties desire that this Stipulation
regarding custody be made an Order of Court; and either party may
file this Stipulation with an proposed Order without the necessity
of both parties being present or petitioning to enter the same.
IN WITNESS WHEREOF, the parties hereto, intending to be
legally bound, have executed this Stipulation and Agreement the day
and year first written above.
