Savings Bank by and through its counsel, Richard C. Ruben, Esquire
and states the following in support of its complaint:
1. The Plaintiff is Harris Savings Bank, formerly Harris Savings
A.sociation, a Corporation organized and existing under the laws of
the Commonwealth of Pennsylvania and having its principal place of
business at Second and pine streets, Harrisburg, P6nnsylvania
17101.
2. The Defendant is Dennis A. Sealover, debtor, an adult
individual whose current address is 3937 Brookridge Drive,
Mechanicsburg, pennsylvania 17055.
3. On June 24, 1986 Defendant entered into a mortgage loan
indenture with Harris Savings Association now Harris Savings Bank,
in the principal amount of Ninety-Seven Thousand, Six Hundred
Dollars ($97,600.00).
The terms of which loan are m~re
specifically evidenced and set forth in the Mortgage dated June 24,
1986, and recorded June 25, 1986 in the Cumberland county Recorder
of Deeds Office in Mortgage Book 820, Page 673, a copy of which is
attached hereto and incorporated herein by reference as Exhibit
"A". Said mortgage contains and is a lien upon the property
situate 3937 Brookridge Drive, Cumberland county, Mechanicsburg,
Pennsylvania 17055.
4. A copy of the Note, dated June 24, 1986, is attached hereto
and incorporated herein as Exhibit liB" .
!S. Plaintiff, in consideration of said Mortgage advanced to
Dennis A Sealover Thirty-Seven Thousand Dollars ($97,600.00).
6. The premises subject to said mortgage is more specifically set
forth in Exhibit "A".
7. Dennis A. Sealover is the sole owner of the said premises
securing said mortgage.
8. Said Mortgage has not been assigned in whole or in part by the
Plaintiff herein.
9. That said Mortgage is in default because Defendant herein is
currently delinquent in the amount of $19,680.36 which includes a
partial payment of $94.72 for September, 1994, payments of
$1,038.00 for the months of October, November, and December, 1994,
payments of $1,045.00 for the months of January through December,
1995, payments of $1,039.29 for the months of January, February and
March, 1996 plus late charges of $813.77.
10. The Plaintiff has given to the Defendant written notice of
intention to foreclose on said Mortgages, dated November 4, 1994,
as required by law under Act 6 a copy of which is attached hereto
and incorporated herein as Exhibit "C".
11. The Plaintiff has given written notice of default, dated
November 4, 1794, as required by the Homeowner's Emergency
Assistance Act of 1983 a copy of which is attached hereto and
incorporated herein as Exhibit liD" and no request for assistance
was made.
12. That due to Defendant'. default the entire principal aMount of
Ninety-Seven, Thousand, six Hundred Dollars ($97,600.00) has beCOMe
due and payable, together with interest at the rate of 10' per
annum, reasonable legal fees for collection of said sum in
accordance with the terms of the Mortgage less such sums as have
been paid on account of principal of the said Mortgage and costs.
13. That Plaintiff believes and therefore avers that reasonable
attorney's fees for collection of the debt are $4,550.00 and that
it will incur such amounts.
14. That Defendant is liable to the Plaintiff for interest at the
rate of 10' per annum, late charges, property taxes and expenses as
provided in the Mortgage documents that will accrue until
distribution by the Sheriff of CUmberland County, Pennsylvania, to
be computed at the time of judgment in these proceedings, in
addition to the current balance.
15. The Plaintiff believes and aver~ that the Defendant is not a
member of the armed forces nor is he in the military service of the
United States of America.
