PRELIMINARY OBJECTIONS
Defendant, Wanyo Brother, Inc. d/b/a McAdoo Lumber Co., by and
through their Attorney, Joseph P. Semasek, Esquire, files
Preliminary Objections to the Plaintiff's Complaint in a form of a
Motion to Strike or in the alternative to transfer the cause of
action for lack of venue for the following reasons:
1. Defendant, Adam Wholesalers, Inc., is an Ohio corporation
with officos located at 1627 Ritner Highway, Carlisle, Cumberland
County, Pennsylvania 17013.
2. Defendant, Wanyo Brothers, Inc. d/b/a McAdoo LUmber Co.,
has its principal offices located at 609 East Blaine Street,
McAdoo, Schuylkill County, Pennsylvania 18237.
3. That Plaintiff it its Complaint refers to an Exhibit "An
which was not attached to the Complaint, however, refers to various
building materials ordered by Defendant and delivered to Defendant
at McAdoo, Schuylkill County, Pennsylvania,
4. That any orde.t's given to Plaintiff were given at
Defendant's location in McAdoo, Schuylkill County, Pennsylvania.
5. That any deliveries by Plaintiff were made at McAdoo,
Schuylkill County, Pennsylvania.
6. That Wanyo Brothers, Inc. d/b/a McAdoo Lumber Co., has no
other location other than MCAdoo, Schuylkill County, Pennsylvania.
7. That all records concerning the purchase and/or delivery
of materials to MCAdoo, Pennsylvania, are located in the office of
the Defendant, Wanyo Brothers, Inc. located at 609 East Blaine
Street, McAdoo, Schuylkill County, pennsylvania.
8. That venue as set forth in Pennsylvania Rules of Civil
Procedure Rule 2179 provides that the proper venue in the above
action is Schuylkill County, Pennsylvania.
9. That the alleged cause of action which is the basis of
Plaintiff's Complaint arose out of an order taken in Schuylkill
County and delivered in Schuylkill County and any cause of aotion
as a result ther~of arose in Schuylkill County.
10. That Schuylkill County is the proper place of venue in
the above action.
WHEREFORE, Defendant prays your Honorable Court to strike
Plaintiff's Complaint for lack of venue or, in the alternative, to
transfer the cause of action as provided for in Pennsylvania Rule
of Civil Procedure 2179 to Schuylkill County.
