AND SETTLEMENT OF AUTQMATIC STAY LITIGATION
Hamilton Bank ("Bank"), by its attorneys, and Warren W. Chiu
and Winnie W. Chiu ("Debtors"), by their attorney, hereby stipu-
lata and agree to compromise the pending automatic stay litiga-
tion and state:
1. That an Order for Relief was entered on a Voluntary
Petition filed by Debtors under Chapter 13 of the Bankruptcy
Code, thereby staying the commencement or continuation oC any
court proceeding against Debtors or to onfor.ce any lien against
any property of Debtors as provided by section 362 of the Bank-
ruptcy Code.
2. That on May 19, 1992, Dank filod a Motion pursuant to
section 362(d) of the Bankruptcy Code to vacate the stay imposed
upon Bank pursuant to section 362(A) and, in the alternative, for
adequate protection in accordance with Section 361.
J. That the parties have stipulated and agreed to a
nQttlement of the controversy, as follows: Debtors agree to make
;111<< continue to make monthly payments on account of thei r obi iga-
tions to Bank at $627.19 per month for seventy-two (72) months,
which payments will be applied first to interest at 9\ per annum
based on an agreed thirty-year amortization. ~he balance is due
and payable in full six (6) years (rom the date of Debtors' first
such payment.
4. That in the event Debtors fail to make any payment in
full on the day required, time being uf the essence, and upon ten
(10) days' prior written notice to counsel for Debtors, the Bank
may declare the automatic stay of Section 362 of the Bankruptcy
Code automatically lifted upon the filing of a certification by
counsel for the Bank, without further Order of Court, and the
Dank may take any and all action which it may bo enti tied to do
under state law to regain possession of and obtain title to the
property of Debtors securing Debtors' obligation to the Bank.

5. The Note is secured by a mortgage on the Premises a180
dated August 23, 1984 (the "Mortgage"), made, executed and
delivered by Defendants, as Mortgagors, to Bank, as Mortgagee,
which mortgage was duly recorded on September 19, 1984, in the
Office of the Recorder of Deeds in and for Cumberland county,
Pennsylvania, in Mortgage Book 760, page 1195. A true and
correct copy of the Mortgage is attached hereto, made a part
hereof and marked Exhibit B.
6. The failure of the Defendants, among other things, to
pay when due and payable the payments under the Note constitutes
a "default" as defined under the terms of the Mortgage.
7. The Defendants have failed and refused, among other
things, to make payments due and payable under the Note.
8. The Premises subject to the lien of the Mortgage are
described in Exhibit B.
9. The terms of the Note provide that upon the occurrence
of a default by the Defendants, the Plaintiff may accelerate and
demand immediate payment of all sums due under the Note.
10. The sum presently due and payable to Plaintiff by
Defendants are computed as follows:
a. Unpaid Principal $ 69,494.17
b. Unpaid Interest to 2/3/95 17,049.29
c. Attorney's fees 7.000.00
