the claims set forth in the following pages, you must take action
wi thin twenty (20) days after this complaint and notice are served,
by entering a written appearance personally or by attorney and
filing in writing with the court your defenses or objections to the
claims set forth against you. You are warned that if you fail to
do so the case may proceed without you and a judgment may be
entered against you by the court without further notice for any
money claimed in the complaint or for any other claim or relief
requested by the plaintiff. You may lose money or property or
other rights important to you.

4. On April 14, 1995, Plaintiff and Defendant entered
into a written oontraot, a oopy of whioh is attaohed hereto as
Exhibit "B" and inoorporated herein by referenoe, in which
Plaintiff agreed to furnish and to install windows and casings to
Defendant's residence for which Defendsnt agreed to pay Plaintiff
the sum of One Thousand Two Hundred Ninety Dollars ($1,290.00).
5. On or about April 28, 1995, Plaintiff commenced the
projeots outlined in Exhibits A and B hereto annexed, and on May
31, 1995, Plaintiff completed all of its undertakings pursuant to
said contracts.
6. By May 31, 1995, Defendant incurred Seven Hundred
Thirty-Four Dollars and 50/100 ($734.50) in extra charges for work
performed by Plaintiff to Defendant's residence in accordance with
the terms and conditions outlined in the contracts contained in
Exhibits "A" and "B," for the replacement of wood that was either
rotted or otherwise struoturally unsound, together with the removal
of twenty-two ( 22 ) feet of old gutter and the installation of
twenty-two (22) feet of new gutter, as ordered orally by Defendant.
7. On September 8, 1995, Plaintiff received from
Defendant a payment of One Thousand Seven Hundred Thirty-One
Dollars and 70/100 ($1,731.70), leaving a balance due and owing
from Defendant to Plaintiff Two Thousand Four Hundred Fifty-One
Dollars and 53/100 ($2,451.53).

8. Although Plaintiff has made regular and frequent
demands for payment of the balance owed to Plaintiff, Defendant has
neglected, failed or refused to pay same.
WHEREFORE, Plaintiff requests this Honorable COurt enter
judgment against Defendant and in favor of Plaintiff in the amount
of Two Thousand Four Hundred Fifty-One Dollars and 53/100
($2,451.53), together with interest from June 1, 1995, and the
costs of this suit.
