The allegations set Plaintiff's Complaint are if set forth in full. forth in paragraph 1 3 of the incorporated herein by reference as 10. On or about October 15, 1991, the Plaintiff, William A. Wray, President of Wray's Music House, Inc., entered into a verbal contract with the Defendant, Joseph Mohn, Jr., wherein Defendant would spent time and use equipment of his own to benefit Plaintiff. 11. Under the terms of the oral agreement, Wray's Music House, Inc., had to pay Joseph Mohn, Jr., 40% of the amount from all proceeds received from clients who used the studio, as compensation for his services and use of his equipment. 12. On or about March 1, 1992, Joseph Mohn, Jr., started to work at the studio as agreed to in the oral contract. 13. On or about April 5, 1994, Joseph Mohn, Jr., performed his last work at the studio. 14. From March 1, 1992, to April 5, 1994, Joseph Mohn, Jr., had worked in the studio for more than 788 hours. 15. Joseph Mohn, Jr., did not receive any payment at all as compensation for his services. 16. After evaluating the hours spent working at the studio and the use of Joseph Mohn, Jr.' s equipment, the amount due and outstanding to Joseph Mohn, Jr., is $31,830.00, calculated as follows: -2- . The Plaintiff, Wray I s Music !louse, Inc., is a Pennsylvania corporation with a place of business as 326 Market street, Lemoyne, Cumberland county, Pennsylvania, 17043. 2. The Defendant, Joseph Mohn, Jr., is an adult individual residing at 6412 Cannon Drive, Mechanicsburg, Cumberland County, Pennsylvania, 17055. 3. The Additional Defendant, individual residing at 91 Cumberland county, Pennsylvania, William Skyline 17055. A. Wray, is an adult Drive, Mechanicsburg, 4. On or about October 15, 1991, William A. Wray, entered into a verbal contract with Joseph Mohn, Jr. for performance of services using his own equipment. 5. Joseph Mohn, Jr., in accordance with the oral agreement, had to perform his music recording services at the recording studio, located at 92 Skyline Drive, Mechanicsburg, Pennsylvania. -1- L 6. Under the terms of the oral agreement, had to pay Joseph Mohn, Jr., 40% of the amount receivad from clients who used the studio, as his services and use of his equipment. William A. Wray from all proceeds compensa tion for 7. Further, it was agreed that William A. \'Iray would apply all the amount duo and owing to Joseph Molm, Jr., toward the account held by Wray's Music House, Inc., in the name of Josoph Mohn, Jr., being for the purchase of the m~sic equipment bought on June 25, 1990, until the balance was paid in full. 8. On or about March 1, 1992, Joseph Mohn, Jr., started to work at the studio as agreed to in the oral contract. 9. On or about April 5, 1994, Joseph Mohn, Jr., performed his last work at the studio. 10. Joseph Mohn, Jr., did not receive any payment at all as compensation for his services. 11. William A. Wray did not apply any amount due and owing to Joseph Mohn, Jr., toward his account, held by Wray's Music House, Inc. 12. On or about April 22, 1996, Wray's Music House, Inc., filed a law suit against Joseph Mohn, Jr., to recover the damages in the amount of $5,753.21, plus interest at the rate of 6% per annum, and costs. WHEREFORE, the Defendant, Joseph Mohn, Jr., respectfully requests this Honorable Court to order that the liability, if any, against the Defendant, Joseph Mohn, Jr., becomes the sole and exclusive liability of tho Additional Defondant, \'Iilliam A.
