MARRIAGE
SETTlEMENT AGREEMENT
THIS AGREEMENT, made this day of , 1997, by and between
ALLEN NICHOLS MARSHALL, JR., hereinafter referred to as "Husband", and JUDITH
ELAINE MARSHALL, hereinafter referred to as "Wife".
WITNESSETH:
WHEREAS, 1he parties hereto are Husband and Wife, having been married on July
14, 1985; and
WHEREAS, differences have arisen between Husband and Wife, as a result of which
It Is the desire of the parties after long and careful consideration, amicably 10 adjust,
compromise and settle all property rights and all rights in, to, or against each other's
property or estate, including property heretofore or subsequently acquired by either party,
and to settle all disputes existing between them, Including any and all claims for
maintenance, support, alimony, equitable distribution, counsel fees, and costs; and
WHEREAS, it Is the mutual desire of Husband and Wife to reduce their agreement
to writing; and
NOW, THEREFORE, In consideration of the mutual promises, covenants, and
agreements hereinafter contained, each of the parties hereto, inlending to be legally bound
hereby promises, covenants, and agrees as follows:

(Parties to live Seoarate and Aoartl
The parties mutually agree to live separate and apart In the marital home until the
said property Is sold. Nellher party will molest the other, or In any way harass or malign
the other, nor In any way Interfere wllh the peaceful existence of the other,

(Personal Prooertvl
Husband and Wife have divided all personal property which would constitute marital
property. Wife agrees that any property in the possession and control of Husband at the
time of the sale of the home shall be the sole and separate property of Husband; and
Husband agrees that all property In the possession and control of Wife at the time of Ihe
sale of the home hereof shall be the sole and separate property of Wife. Each of the parties
does hereby specifically waive, release, renounce and forever abandon whatever claims, if
any, he or she may have to the sole and separate property of the other.

(Automobilesl
Husband will retain sole ownership of his automobile and agrees to assume full
responsibility for any payments on the vehicle. Husband will Indemnify and hold Wife
harmless wllh respect to this vehicle.
Wife will retain ownership of her vehicle and agrees to assume full responsibility for
any payments and maintenance of this vehicle. Wife will Indemnify and hold Husband
harmless with respeclto this vehicle,

$350.0010 be applied to the mortgage, taxes, Insurance, and upkeep of the property at 10
Mayfield Road, Mechanlcsburg, Pennsylvania. Upon the sale of the house the $350,00
portion of the alimony I>ayment will be discontinued. When Wife reaches the age of 62 the
$500.00 portion of the alimony will be reduced to $300.00. Alimony will be paid by
Husband until the death of either party or should Wife either remarry or cohabltate with
another person In an Intimate relationship.

(Waiver of Inlerest In Retirement!
Husband and Wife expressly waive and relinquish any right, claim, tllle or Interest
In any pension, profit-sharing, retirement, credit union or employment-related plans In which
the other has any interest, whether vested or unvesled, matured or unmatured.

Husband and Wife declare that each has had a full and fair opportunity to obtain and
consult with legal counsel of his/her selection and tha11he Ilartles, cognizant of their legal
rights, declare and express that:

IMutual Dlschamel
Wife relinquishes her inchoate intestate right In the estate of Husband, and Husband
relinquishes his Inchoa1e intestate right in the estate of Wife, and each of the parties hereto
for himself or herself, his or her heirs, executors, administrators or assigns does remise,
release, quitclaim and forever discharge the other party hereto, his or her heirs, executors,
administrators or assigns, or any of 1hem, of any and all claims, demands, damages, actions,
causes of action or suits of law or Inequity of whatsoever kind or nature for or because of
a matter or thing done, omitted or suffered to be done by said party prior to and Including
the date hereof, except that this release shall In no way exonerate or discharge either party
hereto from the obligations and promises made and imposed by reason of this Agreement.

An action for divorce has been Instituted by the Husband In Ihe Court of Common
Pleas of Cumberland County, docketed to No. 96.1810 alieglng that the marriage Is
Irretrievably broken under Section 3301(c) of the Divorce Code.
II Is hereby agreed that the marriage Is Irretrievably broken and that colncldenllo the
signing of this Agreement, both parties will execute affidavits of consent to the entry of a
Decree In Divorce under Section 3301(c) of the Divorce Code.

The parlles hereto agree to execute and deliver all papers needed 10 effectuate the
terms and Inlenllons of Ihls Agreement.

IOreachlna Partv Pavs Costsl
If either party breaches any provisions of this Agreement, the other party shall have
the right, at his or her elecllon, either to sue for specific performance or for damages for
such breach, and 1he party breaching this Agreement shall be responsible for reasonable
legal fees and cosls Incurred by the olher In enforcing his or her rights under this
Agreement.

(General Provlslonsl
This Agreement encompasses all agreements between the parties concerning the
matters sel forth herein and may not be altered or omitted except In wrlllng executed by the
parllesi the waiver of any term, condlllon or provision of this Agreement shall In no way
be deemed a waiver of any other term, condlllons or provisions of Ihls Agreement.
If any lerm, condllion or provision of this Agreemen1 shall be determined to be void
or Invalid In law or otherwise, then only that term, condition or provision shall be stricken
from this Agreement, and in all other respects, this Agreemen1 shall be valid and conllnue
In full force.

6. There have been no prior actions of divorce or for annulment between
the parties.
7. Divorce Is sought pursuant to the provisions of the Divorce Code,
Sections 3301(c) In that:
a) The marriage Is Irretrievably broken.
8. The Plaintiff has been advised of the availability of counselling and of
the Plaintiff's right to request that the Court require the parties to participate In counselling
and does not request same.
9. Defendant Is not a member of the armed services.
WHEREFORE, Plaintiff requests your Honorable Court 10 enter a Decree In
Divorce, divorcing Plaintiff and Defendant.
