In accordance with the IIrorementioned requirements, Plaintiff believes that Defendants
havc woefully failed to satisry the requirements necessary to Open and Strike a Judgment, First
of all, this Honornble Court entered an Order directing that depositions he takcn within sixty
(60) days of dllte or scrvlce, which was April 24, 1996, Since defendllnts havc filed the Petition
to Open and Strikc Judgment, they have the burden of proof and must movc forward to tllkc
depositions to substantillte their position to open nnd strike the jUdgment. However, more than
sixty (60) days have passed without defendants either requesting IIn extension of time to takc
dcpositions, communicating with Plaintiff's counsel of the desire to take dcpositlons, statcmcnts
or affidavits in support of defendants' petition, In shon, Defendllnts have made no lI11cmpts
whatsoevcr to comply with this Honorable Coun's Ordcr of April 22, 1996, Thus Dcfendants
havc failed to meetthc sccond and third requircments necessary to Open and Strike a Judgmcnt,
Thus, in accordancc with Pennsylvania case law, the Pctition of Dcfendants to Opcn IInd Strlkc
thc Judgmcnt must be dcnled.
Plaintiff has bcen prejudiced by Defendants' fllilure to comply with this Honornblc
Coun's Order of April 22, 1996 and has been forced to aWllit receipt of thc $10,000.00 Inltilll
paymcnt due to Dcfcndants' dilatory bchavlor in flliling to act in IIccordance with a Court Order.
Finally, the longer Dcfendllnts drag out this cllse without conducting the Coun Ordcred
Dcpositlons, the more likely that cvidencc shall become otherwisc unavailllblc for revicw and
inspcction, Accordingly, Plaintiff rcspectrully requests that Defendants' Pctltlon to Open IInd
Strikc Judgment bc Denied as Defendants havc made no erfon whatsoever to conduct depositions
to support the Petition liS Ordered by this Honorable Court.
IV. CONCLUSION
