WHEREAS, MELVIN D, DOWDY and BONNIE B. DOWDY, husband and
wife, of 12 Royal Palm Drive, Mechanicsburg, PA
17055 (the
"Owner"), owners of the tract of land hereinafter described, have
executed or are about to execute contemporaneously herewith a
contract with J. W. MUMPER CONSTRUCTION, INC" with a principal
place of business at 804 sprint Lane, Camp Hill, PA 17011 (the
"contractor"), for site improvements on, and other improvements to,
tracts of land known as Lot 130, The Peninsula, silver spring
Township, cumberland county, Pennsylvania, upon property more
particularly described on Exhibit "A" attached hereto, incorporated
herein by reference and made a part hereof (the "Premises").

NOW, Marett. , 1996, before any authority has been given
by the said Owner to the said Contractor to commence work on said
site improvements, or to otherwise construct any improvements
thereto, or to purchase materials for the same, or to enter into
any contracts with any subcontractors or materialmen, or to
authorize any purchases by or through any subcontractors or
materialmen, in consideration of the making of said contract with
the owner and the further consideration of One ($1,00) Dollar to
Contractor paid by said owner, and with the intent of all parties
Contractor paid by said Owner, and with the intent of all parties
to be legally bound hereby, it is agreed that no lien shall be
filed against the building or Premises, or any part thereof, by the
Contractor or any subcontractor or by any of the materialmen or
workmen or any other person for any labor, or materials purchased,
or extra labor or materials purchased, for the site improvements to
the Premises (including hereafter changes made thereto), the right
to file liens being expressly waived.
It is the full intent of the contractor, for itself and tor
any subcontractors or materialmen claiming for themselves, or by,
through or under the contract or the contractor, that the right to
file a mechanic's lien, under the provisions of law and/or of Aots
of Assembly in suoh cases made and provided, for work done or
materials furnished in and about the construction of the
residential dwelling and improvements to the Premises above
described is hereby waived.

ALL THAT CERTAIN tract or parcel of land sltuRte in Sliver Spring
Township, Cumberland County, Pennsylvania, more particularly bounded
and described In accordance with the Major Final Subdivision Plan for The
Peninsula (Phase II), prepared by Hartman & Associates, P.C., more
particularly bounded and described as follows, to wit:
BEGINNING at an Iron pin on the eastern right-of-way line of
Gunpowder Road (50' r,o,w.) at the dividing line between Lot-131 and
Lot-130 on the hereinabove referenced subdivision plan; thence along the
dividing line between Lot-131 and Lot-130 North 88 degrees 58 minutes 42
seconds East a distance of 258.79 feet to an Iron pin on the western right-
of-way line of Sample Bridge Road (T-596) (60' r.o,w.); thence along the
western right-of-way line of Sample Bridge Road South 02 degrees 19
minutes 18 seconds East a distance of 170.04 feet to an Iron pin at the
dividing line between Lot-129 and Lot-130; thence along the dividing line
between Lot-129 and Lot-130 South 88 degrees 58 minutes 42 seconds
West a distance of 262.65 feet to an Iron pin on the eastern right-of-way
line of Gunpowder Road; thence along the eastern right-of-way line of
Gunpowder Road North 01 degree 01 minute 18 seconds West a distance
of 170.00 feet to an Iron pin at the dividing line between Lot-131 and Lot-
130; the point and place of BEGINNING.
CONTAINING 1.0175 acres more or less.
BEING Lot-130 on the Major Final Subdivision Plan for The
Peninsula (Phase II) as recorded In the Office of the Recorder of Deeds In
and for Cumberland County In Plan Book 67 at page 86.
UNDER AND SUBJECT to existing bUilding restrictions, ordinances,
easements of roads, privileges or rights of public service companies, If any;
or easements or restrictions visible upon the ground, deed restrictions
Imposed on all Lots within Phase II of the Subdivision Plan, easements and
restrictions shown on the Subdivision Plan as recorded and the Addition to
Declaration of Restrictions and Covenants as recorded In the Office of the
Recorder of Deeds In and for Cumberland County on February 14, 1994
