Schwoyer, Chief Deputy District Attorney of Cumberland County, Pennsylvania brings the following Petition for a hearing on charges of Indirect Criminal Contemptl 1. A protection from Abuse Order was issued by the Court. A true and correct copy of the Order is attached. 2. The defendant's violation of this Order is averred in the attached private criminal complaint. 3. The victim requests the filing of an Indirect Criminal Contempt charge upon information received. 4. The District Attorney's Office approves the filing of this private criminal complaint. 5. The Commonwealth is requesting a hearing on the charges of Indirect Criminal Contempt pursuant to 23 Pa.C.S.A. 56113. 6. In November 1995, the defendant threw a glass scross n room breaking it into several pieces, threw several other items breaking them, broke a ceiling light fixture, and forcefully shoved the plaintiff cnuslng hel' to fear for hel' safety. c. In or about October 1995, the defendant forcefully shoved the plnintiff telling her to leave the residence. d. On severa] different occasions since the summer of 1995, the defendant has shoved and punched the plaintiff. On one occasion, the defendant choked the plaintiff until she almost lost consciousness. 6. The plaintiff believes and therefore avers that she is in immediate and present danger of nbuse from the defendant and that she is in need of protection from such abuse. 6. The plaintiff desires that the defendant be prohibited from having any direct 01' indirect contact with the plaintiff including, but not limited to, telephone and written communications. 7. The plaintiff desires that the defendant be enjoined from harassing and stalklug the plaintiff, and from harassing the plaintiff's relatives. R. The plaintiff desires that the defendant be restrained from entering her place of employment. 3 9. The plaintiff desires that the defendant be enjoined from removing, damaging, destroying or selling uny property owned jointly by the parti~s or owned solely by the plaintiff. n. EXCJ.USIVE POSSESSION 10. The apartment from which the plaintiff is usking the Court to exclude the defendant hus been rented by the plaintiff for approximately three years, and the defendant has only lived there since approximately November 1995. 11. The plaintiff currently has no place to stay except the marital home, and the defendant's mother lives in the area with whom he can stay and has the financial means to get his own residence. C. ATTORNEY FEES 12. The plaintiff asks that the defendant be ordered to pay reasonable attorney feos to Legal Services, Inc. WHEREFORE, pursuant to the provisions of the "Protection from Abuse Act" of October 7, 1976, 23 Pa.C.S. ~ 6101 et !!!t!l., as amended, the plaintiff prays this Honorable Court to grant the following relief: A. Grant a Temporary Order pursuant to the "Protection from Abuse Act:" 1. Ordering the defendant to refrain from abusing the plaintiff or placing her In fear of abuse. 2. Enola Drive, Enola, Cumberland County, Pennsylvania, to the plaintiff to the exclusion of the defendant pending a final order in this matter, and any other residence the plaintiff may establish. B. Schedule a hearing in accordance with the provisions of the "Protection from Abuse Act," and, after such hearing, enter an order to be in effect for a period of one year: 1.
