AND NOW, comes Movant, Saundra E. Swartz, by and through
her attorneys, Meyers, Desfor, Saltzgiver & Boyle and files the
following Motion for the Entry of Qualified Domestic Relations
Order and in support thereof avers as follows:
1. Movant is Saundra E. Swartz, an adult individual residing
at 5439 Jonestown Road, Harrisburg, PA 17112, Defendant in
the above captioned action.
2. Respondent is Terrance J. Swartz, an adult individual
residing at 1228 Edinburg Circle, New Cumberland, PA
17070, Plaintiff in the above-captioned action.
3. The parties were married on February 2, 1980 and were
divo~ced by Decree in Divorce on May 27, 1999.
4. Pursuant to their divorce, the parties executed an
Agreement before the Divorce Master, E, Robert Elicker,
Esquire. on August 5, 1999 (hereinafter "Agreement") which
settled all issues of equitable distribution, alimony,
alimony pendente lite, and counsel fees and expenses. (See
Exhibit "A").
5. Under paragraph 4 of said Agreement, the parties agreed
that Movant would receive the sum of $730.00 per month for

THE MASTER: Today is Thursday, August 5, 1999.
This is the date set for a Master's hearing in the above
captioned divorce proceedings. We were originally going to take
testimony on the economic issues; however, counsel had advised
the Master earlier this week the intention of this hearing was
to put testimony on regarding the factor of marital misconduct
as that factor may have affected wife's alimony claim. In any
event, we do not need to take any testimony on any issues
relating to economic claims since the parties, after
negotiations, have resolved the economic issues.
The parties were divorced by decree entered by
Judge Bayley on May 27, 1999. The decree did preserve the
economic claims of equitable distribution, alimony, alimony
pendente lite, and counsel fees and expenses.
We are going to place on the record an agreement
and the agreement as stated on the record will be considered the
substantive agreement of the parties not subject to any changes
or modifications except for correction of typographical errors
which may have been made during the transcription. We are going
to ask the parties and counsel to return later today to review

the draft of the agreement for typographical errors, make any
correction of typographical errors as required and then affix
their signatures by way of affirmation of the terms of the
agreement which are being stated on the record at this time.
That means that after the parties and counsel leave the
conference/hearing room, upon the statelT,ent of the agreement on
the record, they will not make any substantive changes to the
terms of the agreement.
Following the receipt by the Master of the
agreement. which will have been affirmed by the signatures of
the parties and counsel, the Master will prepare an order
vacating his appointment. The agreement may also provide that
there will be a QDRO required to accomplish the terms of
settlement; that QDRO can be presented to Judge Bayley or any of
the other judges in the county for signature following the
conclusion of the agreement on the record and the vacation of
the Master's appointment. The QDRO will be able to be entered
and will supplement the requirements of the agreement at the-
time the QDRO has been prepared. Ms. Daley.
MS. DALEY: Thank you, Mr. Elicker. We have met
and discussed division of property and provisions for alimony in
this case and I believe we have agreed to the following:
1. The parties owned real estate as tenants by the
entireties located at 1903 Letchworth Drive, camp lIill,
Pennsylvania. This property was ~ubject to foreclosure
action. We have confirmed today that the sheriff of

Cumberland County sold this property at sheriff's sale to
the First Union National Bank, the successor trustee for
the Pennsylvania Housing Finance Agency, on May 13, 1999.
We have not been able to determine if there is any
deficiency but my client, the husband. Terrance Swartz,
agrees that he will hold his wife harmless and indemnify
her from any liability associated with this mortgage
obligation.
2. The parties have also agreed that all personal property,
tangible and intangible, this wo~ld include bank
accounts, vehicles, furnishings, household goods, and the
like, everything in the possession of the wife shall be
wife'S property; everything in the possession of
husband shall be husband's property.
3. Any credit cards, loans, or other balances that the
parties have accumulated, shall be the sole liability of
the person in whose name they have been created.
Therefore, all such loans of wife will be wife's
obligations; all such loans of husband will be husband's
obligations.
4. The husband has participated in the Pennsylvania state
Employees' Retirement System. We have contacted Harry
Leister of the Conrad siegel firm and asked him to
prepare a QDRO that effectuates the terms we have
agreed to today.
Through the assistance of Mr. Lelster we have agreed Ms.
Swartz will receive the sum of $730.00 per month which
will continue for the duration of her life. We note
under the terms of the plan that she cannot name a
survivor to her benefit. My client, Mr. Swartz, will be
entitled to receive all of the option four funds; that
would be his contribution to the plan because we factored
those contributions into the monthly annuity.
We are also agreeing that Mr. Swartz will select a joint
and survivor benefit so that Ms. Swartz will be
guaranteed that her benefit will continue even if Mr.
Swartz should predecease her.
This benefit will commence at the time Mr. Swartz starts
to receive his retirement and will continue on an ongoing
basis. Mr. Swartz is not obligated to retire at any
specific time. It is within his discretion as to when he
seeks to do so.

Up until the time that Ms. Swartz starts to receive her
retirement, she will continue to receive payments of
$158.00 per week. These are currently being paid to her
as alimony pendente lite. This I'ill convert to alimony
pursuant to this agreement. The payments shall continue
to be wage attached and made through the Domestic
Relations Office as they are currently. These payments
will continue until Ms. Swartz begins to receive Mr.
Swartz's Pennsylvania state Employees' Retirement. Ms.
Swartz's remarriage or cohabitation will not affect her
receiving these $158.00 payments. The only thing that
would terminate those payments would be her death, his
death, or the commencement of the retirement payment 0
being paid.
We have agreed that the alimony amount and term are
nonmodifiable.
5. Ms. Swartz has her own medical insurance and that's now
covering her as the result of the divorce.
6. There are no other items of property that need to be
divided. I believe that we have agreed that this settles
all claims for equitable distribution, alimony, alimony
pendente lite, and counsel fees and costs.
7. Mr. Swartz will pay the transcription fee today and will
also pay for the preparation of the QDRO. I will provide
the documents to Mr. Leister for the purpose of having
those prepared, supply them to Ms. Saltzgiver for her
review and approval, and then enter them in the Court.
THE MASTER: Ms. Daley has stated the agreement-of
the parties on the record. I want to note for the record that
present in the hearing room are the Plaintiff, Terrance J.
Swartz, and his counsel Kathleen carey Daley, and the Defendant,
Saundra E. Swartz, and her counsel Laurie A. Saltzgiver.

commence. This nomination shall become effective upon
approval by the Secretary of the Retirement Board, or his
authorized representative, of the within Domestic Relations
Order. The balance of any death benefit remaining after
the allocation of Alternate Payee's equitable distribution
portion ("Balance") shall be paid to the beneficiaries
named by Member on the last Nomination of Beneficiaries
Form filed with the Retirement Board prior to Member's
death.
a. If the last Nomination of Beneficiaries Form filed by
Member prior to Member's death (a) predates any
approved Domestic Relations Order, and (b) names
Alternate Payee as a beneficiary, then:
(1) the terms
of the Domestic Relations order shall alone govern
Alternate Payee's share of any death benefit, and (2)
for purposes of paying the Balance via the last
Nomination of Beneficiaries Form filed with the
Retirement Board prior to Member's death, Alternate
Payee shall be treated as if Alternate Payee
predeceased Member. No portion of the Balance shall
be payable to Alternate Payee's estate.
b. In addition, Member shall execute and deliver to
Alternate Payee an authorization, in a form acceptable
to SERS, which will authorize SERS to release to
Alternate Payee all relevant information concerning
Member's retirement account. Alternate Payee shall

deliver the authorization to SERS which will allow the
Alternate Payee to check that she has been and
continues to be properly nominated under this
paragraph.
The equitable distribution portion of the lump sum death
benefit payable to the Alternate Payee is the present value of
the portion of the Member' IS benefit assigned to the Alternate
Payee. This, in turn, is determined by (a) divided (b)
multiplied by (c) multiplied by (d), where (a), (b), (c) and (d)
are as follows:
(a) $730,00 (the amount of the monthly pension assigned to
the Alternate Payee).
(b) The joint and 100% survivor factor based upon the age
of the Member on the date of his death and the age of
the Alternate Payee on the date of the Member's death.
(c) Factor for cost of life annuity of $1.00 based upon
Member's age on the date of his death.
(d) 12.
10. The term and amounts of Member's retirement benefits
payable to the Alternate Payee after SERS approves this
Domestic Relations Order is dependent upon which option(s)
is (are) selected by Member upon retirement. Member and
Alternate Payee expressly agree that, at the time that the
Member files a retirement application with SERS, the Member
shall elect Special Option 4 under which:

a. Member may elect to receive a refund of his
accumulated deductions.
b. Member shall elect a joint and survivor annuity with
the Alternate Payee as the survivor annuitant under
which, upon the death of the Member, $730.00 per month
shall be payable to the Alternate Payee during her
lifetime.
The intent of this Special Option 4 is that the Alternate
Payee shall be paid a monthly benefit of $730.00 for as long as
the Member lives followed by a monthly survivor benefit of
$730.00 for as long as she lives after the death of the Member.
11. Alternate Payee may not exercise any right, privilege or
option offered by SERS. SERS shall issue individual tax
forms to Member and Alternate Payee for amounts paid to
each.
12. In the event of the death of Alternate Payee prior to
commencement to her of payments from SERS under this Order,
any death benefit or retirement benefit payable to
Alternate Payee by SERS shall revert to Member.
13. In no event shall Alternate Payee have greater benefits or
rights other than those which are available to Member.
Alternate Payee is not entitled to any benefits not
otherwise provided by SERS. The Alternate Payee is only
entitled to the specific benefits offered by SERS as
provided in this Order, All other rights, privileges and
options offered by SERS not granted to Alternate Payee by

14. It is specifically intended and agreed by the parties
hereto that this Order:
a, Does not require SERS to provide any type or form of
benefit, or any option not otherwise provided under
the Retirement Code,
b. Does not require SERS to provide increased benefits
(determined on the basis of actuarial value) unless
increased benefits are paid to Member based upon cost
of living or increases based on other than actuarial
values.
15, The parties intend and agree that the within terms shall be
approved, adopted and entered as a Domestic Relations
Order.
16. The Court of Common Pleas of Cumberland County,
Pennsylvania, shall retain jurisdiction to amend any
Domestic Relations Order, but only for the purpose of
establishing it or maintaining it as a Domestic Relations
Order; provided, however, that no such amendment shall
require SERS to provide any type or form of benefit, or any
option not otherwise provided by SERS, and further provided
that no such amendment or right of the Court to so amend
will invalidate this existing Order.
17. Upon entry as a Domestic Relations Order, a certified copy
of the Domestic Relation~ Order and any attendant documents

Dear Judge Bayley:
Please be advised that I represent Saundra Swartz, the
Defendant in the above-captioned action. I have received an
Order from you scheduling a hearing on April 26, 1999 on the
Petition for Bifurcation which was filed by the husband. This is
to advise that counsel for the parties in this action have
previously attended a pre-hearing conference with the Divorce
Master on January 25, 1999. At that conference, counsel agreed
that the parties would file Affidavits of Consent to conclude the
divorce action at the time of the Master's hearing which is
scheduled for August 5, 1999. A copy of the Order and Notice
setting hearing as well as the Pre-Hearing Conference Memorandum
are enclosed.
I am requesting that the hearing on the Petition for
Bifurcation be continued until after the Master's hearing
scheduled for August of 1999. A hearing on the Petition for
Bifurcation is unnecesaary ae all issues will be d~alt with by
the Master in August of 1999. My client is by far the lesser
income producing spouse in this action and she is unable to meet
her attorney fees at present and incurring additional attorney
fees to defend herself in a bifurcation action will prejudice her
in the overall divorce case.
As the parties have previously agreed to file Affidavits of
Consent and proceed with a 3301(c) divorce, I believe that the
husband's petition for Bifurcation is merely another ploy to
harass my client and cause her to incur counsel fees. I request
that you continue the hearing until after the Divorce Master's
hearing, so that my client does not incur additional unnecessary
attorney fees.

Dear Judge Bayley:
I arn in receipt of Laurie Saltzgiver's letter to the court of March 11, 1999 regarding the
above captioned rnatter, On behalf of my client, Terranee J, Swartz, I arn writing to object to her
request for a continuance on the bifurcation action. My reasons for requesting a bifurcation are as
slated in our petition, however, I will summarize our position here for the convenience of the court,
Mr. and Mrs. Swartz have been separated since early 1996, This is more than three years and
there is an agreement that the rnarrlage cannot be rehabilitated as evidenced by both parties agre\1ing
to sign the affidavits of consent to the divorce, Although a hearing has been scheduled before the
Divorce Master for August of 1999, there is no assurahce that a divorce will be granted at that tirne,
Based upon the history ofthis case, it is very possible that additional hearings will be necessary, that
exceptions will be filed or that other procedural actions will take this case well into the next
mlllenniurn.
My client has a support obligation to his wife which will continue regardless of the
bifurcation, Mrs, Swartz works for the Cumberland County prison and, as a result, has her own
medical benefits, I am sincerely unaware of any valid reason that Mrs, Swartz would have to contest
the bifurcation other than a desire to preclude my client from a remarriage, To deny rny client a
hearing on this issue is an unreasonable restriction of his personal freedoms which are protected by
our constitution,

I arn well aware that thla is a difficult process for Mrs, Swartz and since I have been in the
case I have met with opposing counsel to try to work out seltlements a number of times, To date I
have been unsuccessful In my efforts, I do not blame Mrs, Swartz for that situation but I have
brought the case before the Master so that the parties can reach some final resolution in this matter,
Ms, Saltzglver's lelter states that this bifurcation request Is "merely another ploy to harass my client
and cause her to incur counsel fees," This statement alludes to the strained relationship between the
parties,
I would ask the court to deny Ms, Saltzglver's request for a continuance and proceed with
the bifurcation hearing as scheduled, At that point,Mrs, Swartz may appear and voice whatever
objections she has to the request and the court can render a decision,

Saltzgiver. It should be noted that Attorney Daley is
co-counsel in this case with Keith B. DeArmond. Mr.
DeArmond filed the complaint in this case. He has not
withdrawn his appearance, and Kathleen Daley has entered her
appearance on September 28, 1998, as co-counsel with Mr.
DeArmond. Mr. DeArmond is directed to be at the hearing
with Ms. Daley at the time this case is tried.
A divorce complaint was filed on April 9,
1996, raising grounds for divorce of irretrievable breakdown
of the marriage. counsel have indicated that the parties
will sign and file affidavits of consent and waivers of
notice of intention to request entry of divorce decree prior
to the hearing so the divorce can be concluded under section
3301(c) of the Domestic Relations Code.
On May 2, 1996, the defendant filed a
counterclaim raising the economic issues of equitable
distribution, alimony, alimony pendente lite, and counsel
fees and expenses. With respect to the issue of marital
misconduct as that factor may affect wife's alimony claim,
wife's attorney is going to prepare a stipulation to be
reviewed by husband's attorney regarding husband's alleged
extramarital affair with one Brenda Snell for three years
during the time the parties were married and living in a
marital relationship.
If the stipulation is prepared and accepted
by husband, that stipulation will be made part of the record
and we will not need to take testimony on the factor of
marital misconduct. Otherwise, counsel are directed to
provide the Master a list of witnesses that will be
presenting testimony on that factor at the hearing.

The parties were married on February 2, 1980,
and separated March 22, 1996. They are the natural parents
of a daughter, Angela Marie Swartz born April 30, 1981.
Husband adopted a son of wife, Marshal J. Swartz, and
husband has a son from a prior marriage.
INs band is 49 years of age and resides at
1109 Columbus Avenue, Apartment 6, Lemoyne, Pennsylvania,
with Brenda Snell. lie is a high school graduate and is
employed by the Commonwealth of Pennsylvania as managor with
the Department of Corrections. lie is currently assigned to
Graterford, Pennsylvania.
After review of the income data provided by
husband's counsel, we have determined that his current net
monthly income is $3,767.00. lIusband has not raised any
health issues and has health insurance coverage for himself
and wife through his employment. Husband is currently
paying an order of support in the amount of $1,182.00 per
month allocated $111,.00 per week for the daughter and
$158.00 per week for the wife, This order was entered July
19, 1996.
Wife is 45 years of age and resides at 409-a
Geary Avenue, Apartment A, New cumberland, Pennsylvania,
where she lives with her daughter Angela. Wife has aGED
and is currently employed with Cumberland county as a cook
for the prison. She started that job April 13, 1998. Her
income presently net per month is $1,200.00.
Wife has breast cancer and suffered a knee
injury which required surgery during a defensive training
program with the prison. She is now back to work full-time.
It is assumed that wife will be covered upon the entry of a
divorce decree under the county health insurance system.
The partieo own real estate at 1903
Letchworth Drive, Camp lIill, Pennsylvania, which is
currently subject to foreclosure proceedings and listed for
sheriff's sale March 3, 1999. There ar.e different versions
as to how the house got into foreclosure, but in any event
part of the scenario involves letting the son of the parties
move into the house on his assurance that he would maintain
the property, which apparently was not done. The property
is in poor condition for sale according to counsel, and may
be subject to a deficiency jUdgment after the sheriff's
sale. Counsel will advise the Master as to the amount of
that judgment after the sale is complete.

There is a question as to whether or not
wife, considering the c~rrent asset situation, would be in a
position to contribute toward the payment of any deficiency
judgment. Obviously, if husband is going to have to assume
the full judgment then that will be conoidered in the total
review of the claim for equitable distribution.
It is noted that wife would like to be able
to have some cash from thia case to assist her in
maintaining herself and also to help pay for counsel fees.
Looking at the assets, it does not appear as if there is
much, if any, cash to be realized in this case.
A review of the assets shows the following:
The parties own a 1994 Ford truck which the husband claims
is not worth any more than the debt against the truck. Wife
needs to have verification of the debt because she thought
the truck was paid off. There is a 1990 Chrysler LeBaron
which wife believes the husband sold for $900.00.
The household tangible personal property has
been divided to the parties mutual satisfaction. The
husband, according to wife, has certain gold and silver
coins in a safe deposit box in his possession and husband
has explained to his counsel that he used those funds to
help make bail for one of the children and for other
expenses. Wife needs to provide information as to the value
of the coins and her version as to what happened to those
funds or whether she agrees with husband's statement
regarding how those funds were expended.
Finally, we are left with the huoband's
retirement plan with the Commonwealth of Pennsylvania. The
Master sees no way of doing an immediate offset method of
distributing the pension so therefore we will have to have
the pension distributed in accordance with a Qualified
Domestic Relationo Order. Of importance to the parties 1s
what decision they will make regarding the options available
for survivor benefits for wife.
A review of the above shows that there is
little, if any, cash available for distribution.
Consequently, we are easentially looking at a deferred
distribution of the pension, some adjustments with regard to
the deficiency judgment and the limited assets, a claim for
alimony and the claim for counsel fees.

THE MASTER: Today is Thursday, August 5, 1999.
This is the date set for a Master's hearing in the above
captioned divorce proceedings. We were originally going to take
testimony on the economic issues; however, counsel had advised
the Master earlier this week the intention of this hearing was
to put testimony on regarding the factor of marital misconduct
as that factor may have affected wife's alimony claim. In any
event, we do not need to take any testimony on any issues
relating to economic claims since the parties, after
negotiations, have resolved the economic issues.
The parties were divorced by decree entered by
Judge Bayley on May 27, 1999. The decree did preserve the
economic claims of equitable distribution, alimony, alimony
pendente lite, and counsel fees and expenses.
We are going to place on the record an agreement
and the agreement as stated on the record will be considered the
substantive agreement of the parties not subject to any changes
or modifications except for correction of typographical errors
which may have been made during the transcription. We are going
to ask the parties and counsel to return later today to review
the draft of the agreement for typographical errors, make any
correction of typographical errors as required and then affix
their sigllatures by way of affirmation of the terms of the
agreement which are being stated on the record at this time.
That means that after the parties and counsel leave the
conference/hearing room, upon the statement of the agreement on
the record, they will not make any substantive changes to the
terms of the agreement.
Following the receipt by the Master of the
agreement, which will have been affirmed by the signatures of
the parties and counsel, the Master will prepare an order
vacating his appointment. The agreement may also provide that
there will be a QDRO required to accomplish the terms of
settlement; that QDRO can be presented to Judge Bayley or any of
the other judges in the county for signature following the
conclusion of the agreement on the record and the vacation of
the Master's appointment. The QDRO will be able to be entered
and will supplement the requirements of the agreement at the
time the QDRO has been prepared. Ms. Daley.
MS. DALEY: Thank you, Mr. Elicker. We have met
and discussed division of property and provisions for alimony in
this case and I believe we have agreed to the following:
1. The parties owned real estate as tenants by the
entireties located at 1903 Letch~orth Drive, Camp Hill,
Pennsylvania. This property was subject to foreclosure
action. We have confirmed today that the sheriff of

Cumberland county sold this property at sheriff's sale to
the First Union National Bank, the successor trustee for
the Pennsylvania Housing Finance Agency, on May 13, 1999.
We have not been able to determine if there is any
deficiency but my client, the husband, Terrance swartz,
agrees that he will hold his wife harmless and indemnify
her from any liability associated with this mortgage
obligation.
2. The parties have also agreed that all personal property,
tangible and intangible, this would include bank
accounts, vehicles, furnishings, household goods, and the
like, everything in the possession of the wife shall be
wife's property; everything in the possession of
husband shall be husband's property.
3. Any credit cards, loans, or other balances that the
parties have accumulated, shall be the sole liability of
the person in whose name they have been created.
Therefore, all such loans of wife will be wife's
obligations; all such loans of husband will be husband's
obligations.
4. The husband has participated in the Pennsylvania state
Employees' Retirement System. We have contacted Harry
Leister of the Conrad Siegel firm and asked him to
prepare a QDRO that effectuateH the terms we have
agreed to today.
Through the assistance of Mr. Leister we have agreed Ms.
Swartz will receive the sum of $730.00 per month which
will continue for the duration of her life. We note
under the terms of the plan that she cannot name a
survivor to her benefit. My client, Mr. Swartz, will be
entitled to receive all of the option four funds; that
would be his contribution to the plan because we factored
those contributions into the monthly annuity.
We are also agreeing that Mr. Swartz will select a joint
and survivor benefit so that Ms. Swartz will be
guaranteed that her benefit will continue even if Mr.
Swartz should predecease her.
This benefit will commence at the time Mr. Swartz starts
to receive his retirement and will continue on an ongoing
basis. Mr. Swartz is not obligated to retire at any
specific time. It is within his discretion as to when he
seeks to do so.
Up until the time that Ms. Swartz starts to receive her
retirement, she will continue to receive payments of
$158.00 per week. These are currently being paid to her
as alimony pendente lite. This will convert to alimony
pursuant to this agreement. The payments shall continue
to be wage attached and made through the Domestic
Relations Office as they are currently. These payments
will continue until Ms. Swartz begins to receive Mr.
Swartz's Pennsylvania state Employees' Retirement. Ms.
Swartz's remarriage or cohabitatlon will not affect her
receiving these $158.00 payments. The only thing that
would terminate those payments would ~e her death, his
death/ or the commencement of the retirement payment
being paid.
We have agreed that the alimony amount and term are
nonmodifiable.
5. Ms. Swartz has her own medical insurance and that's now
covering her as the result of the divorce.
6. There are no other items of property that need to be
divided. I believe that we have agreed that this settles
all claims for equitable distribution, alimony, alimony
pendente lite, and counsel fees and costs.
7. Mr. Swartz will pay the transcription fee today and will
also pay for the preparation of the QDRO. I will provide
the documents to Mr. Leister for the purpose of having
those prepared, supply them to Ms. saltzgiver for her
review and approval, and then enter them in the Court.
THE MASTER: Ms. Daley has stated the agreement of
the parties on the record. I want to note for the record that
present in the hearing room are the Plaintiff, Terrance J.
swartz/ and his counsel Kathleen carey Daley, and the Defendant,
Saundra E. Swartz, and her counsel Laurie A. Saltzgiver.

the record with their respective clientE with respect to the
terms of the agreement that have been stated to indicate that
they have been present and that they understand the terms as
stated. Ms. Daley.

DEFENDANT/WIFE'S PRE-TRIAL STATEMENT
I . BACKGROUND
The parties to this action were married on February 2, 1980
There was one child born of their marriage, namely Angela Marie
Swartz, born April 30, 1981, She is presently 17 years of age
and a senior in high school, Each of the parties had a son from
a prior relationship and wife's son, Michael J, Swartz, was
adopted by husband during the marriage, however, he is no longer
a minor. This is wife's first marriage and husband's third
marriage as he was married to his first wife on two different
occasions,
The parties separated on March 22, 1996 when wife confronte
Husband regarding his affair with her best friend, Brenda Snell,
and husband admitted that he had been engaged in an affair with
Brenda Snell for the past three years.
Wife is presently 45 years of age and is in fair health,
Wife was diagnosed with breast cancer in January of 1997 and
underwent a mastectomy, Wife continues to undergo cancer
screenings and also reconstructive breast surgery, Additionally
wife was recently injured at her place of employment and suffere
torn ligaments in her knee and had to undergo surgery to repair

At Husband's request, lIife was unemployed throughout most 0
the marriage, Wife was not employed outside the home until the
last three years of the marriage when she worked part - time as a
cook, Wife has recently become employed on a full-time basis as
a cook at the CumLerland C:ounty Prison where she has been
employed since April 13, 1998,
Wife has been the primary caretaker for the parties'
daughter, Angela, throughout the marriage and Angela'S primary
physical custodian since the parties' separation. Angela is
presently a senior in high school and plans to go to college nex
fall, Despite husband's prior promises to pay Angela'S college
education, he has now refused to pay for same, Angela'S
relationship with her father has been strained since her parents
separation as a result of Husband's affair with the mother of
Angela'S best friend,
Husband is presently 49 years of age and is in good health.
Husband is employed by the Pennsylvania State Prison System wher
he has been employed since the second year of the parties
marriage. There are minimal assets involved in this case despit
husband's significant income, Husband earns over $68,000 per
year and wife has never earned more than $10,000 per year,

will testify regarding her extramarital affair with husband
herein, and her current living expenses and arrangement wit
husband.
2. Ronald Snell, 1308 Kelton Road, Camp Hill, Ph 17011, he wil
testify regarding his wife, Brenda Snell's extramarital
affair with the Plaintiff/Husband herein,
IV. EXHIB ITS
Paystubs, income tax returns, bank statements, pension statement
and evaluations. Defendant reserves the right to amend her
exhibit list prior to trial.
V. INCOME AND EXPENSES - see attached income tax return,
pays tub and Income and Expense Statement.
VI, PENSION AND RETIREMENT BENEFITS
The Plaintiff/Husband has a pension through the Pennsylvani
State Retirement System, This pension accrued during the partie
marriage and a valuation thereof is necessary for equitable
distribution, Wife does not have the funds to obtain a valuatio
of the Pennsylvania State Pension and requests that husband be
ordered to provide her with the funds for same.
VII, COUNSEL FEES
The Defendant has incurred substantial counsel fees in the
preparation and defense of her case, Defendant does not have

AND NOW, comes the Petitioner, Terrance J. Swartz, through his ettorney,
Kathleen Carey Daley, Esquire, and files the following Petition for Bifurcation and
respectfully avers as follows:
1. Petitioner Is Terrance J. Swartz, who Is the Plaintiff In the above-captioned
divorce action and resides at 1109 Columbus Avenue, Lemoyne, Cumberland County,
Pennsylvania.
2, Respondent Is Saundra E. Swartz, who is the Defendant In the above-
captioned divorce action and resides at 409-A Geary Avenue, New Cumberland,
Cumberland County, Pennsylvania.
3. Petitioner flied a Complaint in Divorce on April 9, 1996, under Section
3301 (c).
4. Respondent filed a counterclaim on May 2, 1996, raising the economic
Issues of equitable distribution, alimony, alimony pendente lite, and counsel fees and
expenses.
5. Property remains to be divided between the parties.
6, A Master hearing has been scheduled before E. Robert Elicker, II, Esquire,
on August 5, 1999.
7, 80th parties agree that the marrlege Is Irretrievably broken.
7. Petitioner has agreed to sign and file an affidevit of consent and a waiver of
notice of intention to request entry of a divorce decree, prior to the hearing.
6. Respondent has agreed to sign and file an affidavit of consent and a waiver
of notice of Intention to request entry of a divorce decree, prior to the hearing.
9. A copy of the Master's pre-hearing conference memorandum Is attached
hereto, and Incorporated herein, as Exhibit "A', evidencing the Intention of each party to
sign the affidavits of consent and the waivers of notice of Intention to request entry of a
divorce decree.
10. Petitioner believes and therefore avers that no prejudice will occur to either
party if a divorce Is grented prior to the resolution of the economic Issues, end further, thet
the entry of a Divorce Decree with the reservetlon of the economic Issues will be In the
best interests of both parties.
11. Pursuant to the Divorce Code, your Honorable Court has the power and
authority to grant the divorce at the present time and to reserve jurisdiction over the
remaining economic Issues,

Present for the Plaintiff, Terrance J.
Swartz, is attorney Kathleen carey Daley and present for the
Defendant Saundra E. Swartz is attorney Laurie A.
Saltzgiver. It should be noted that Attorney Daley is
co-counsel in this case with Keith B. DeArmond. Mr.
DeArmond filed the complaint in this case. He has not
withdrawn his appearance, and Kathleen Daley has entered her
appearance on September 2B, 199B, as co-counsel with Mr.
DeArmond. Mr. DeArmond is directed to be at the hearing
with Ms. Daley at the time this case is tried.
A divorce complaint was filed on April 9,
1996, raising grounds for divorce of irretrievable breakdown
of the marriage. Counsel have indicated that the parties
will sign and file affidavits of consent and waivers of
notice of intention to request entry of divorce decree prior
to the hearing so the divorce can be concluded under section
3301(c) of the Domestic Relations Code.
On May 2, 1996, the defendant filed a
counterclaim raising the economic issues of equitable
distribution, alimony, alimony pendente lite, and counsel
fees and expenses. With respect to the issue of marital
misconduct as that factor may affect wife's alimony claim,
wife's attorney is going to prepare a stipulation to be
reviewed by husband's attorney regarding husband's alleged
extramarital affair with one Brenda Snell for three years
during the time the parties were married and living in a
marital relationship.
If the stipulation is prepared and accepted
by husband, that stipulation will be made part of the record
and we will not need to take testimony on the factor of
marital misconduct. otherwise, counsel are directed to
provide the Master a list of witnesses that will be
presenting testimony on that factor at the hearing.
The parties were married on February 2, 1980,
and separated March 22, 1996. They are the natural parents
of a daughter, Angela Marie Swartz born April 30, 1981.
Husband adopted a son of wife, Marshal J. swartz, and
husband has a son from a prior marriage.
Husband is 49 years of age and resides at
1109 Columbus Avenue, Apartment 6, Lemoyne, Pennsylvania,
with Brenda Snell. He is a high sohool graduate and is
employed by the Commonwealth of Pennsylvania as manager with
the Department of Corrections. He is currently assigned to
Graterford, Pennsylvania.
After review of the income data provided by
husband's counsel, we have determined that his current net
monthly income is $3,767.00. Husband has not raised any
health issues and has health insurance coverage for himself
and wife through his employment. Husband is currently
paying an order of support in the amount of $1,182.00 per
month allocated $114.00 per week for the daughter and
$158.00 per week for the wife. This order was entered July
19, 1996.
Wife is 45 years of age and resides at 409-a
Geary Avenue, Apartment A, New Cumberland, Pennsylvania,
where she lives with her daughter Angela. Wife has aGED
and is currently employed with Cumberland County as a cook
for the prison. She started that job April 13, 1998. Her
income presently net per month is $1,200.00.
Wife has breast cancer and suffered a knee
injury which required surgery during a defensive training
program with the prison. She is now back to work full-time.
It is assumed that wife will be covered upon the entry of a
divorce decree under the county health insurance system.
The parties own real estate at 1903
Letchworth Drive, Camp Hill, Pennsylvania, which is
currently subject to foreclosure proceedings and listed for
sheriff's sale March 3, 1999. There are different versions
as to how the house got into foreclosure, but in any event
part of the scenario involves letting the son of the parties
move into the house on his assurance that he would maintain
the property, which apparently was not done. The property
is in poor condition for sale according to counsel, and may
be subject to a deficiency jUdgment after the sheriff's
sale. Counsel will advise the Master as to the amount of
that judgment after the sale is complete.
There is a question as to whether or not
wife, considering the current asset situation, would be in a
position to contribute toward the payment of any deficiency
judgment. Obviously, if husband is going to have to assume
the full judgment then that will be considered in the total
review of the claim for equitable distribution.
It is noted that wife would like to be able
to have some cash from this case to assist her in
maintaining herself and also to help pay for counsel fees.
Looking at the assets, it does not appear as if there is
much, if any, cash to be realized in this case.
A review of the assets shows the following:
The parties own a 1994 Ford truck which the husband claims
is not worth any more than the debt against the truck. Wife
needs to have verification of the debt because 'she thought
the truck was paid off. There is a 1990 Chrysler LeBaron
which wife believes the husband sold for $900.00.
The household tangible personal property has
been divided to the parties mutual satisfaction. The
husband, according to wife, has certain gold and silver
coins in a safe deposit box in his possession and husband
has explained to his counsel that he used those funds to
help make bail for one of the children and for other
expenses. Wife needs to provide information as to the value
of the coins and her version as to what happened to those
funds or whether she agrees with husband's statement
regarding how those funds were expended.
Finally, we are left with the husband's
retirement plan with the Commonwealth of Pennsylvania. The
Master sees no way of doing an immediate offset method of
distributing the pension so therefore we will have to have
the pension distributed in accordance with a Qualified
Domestic Relations Order. Of importance to the parties is
what decision they will make regarding the options available
for survivor benefits for wife.
A review of the above shows that there is
little, if any, cash available for distribution.
Consequently, we are essentially looking at a deferred
distribution of the pension, some adjustments with regard to
the deficiency judgment and the limited assets, a claim for
alimony and the claim for counsel fees.

Dear Mr. DeArmond and Ms. saltzgiver:
By order of Court of President Judge George E. Hoffer
dated August 3, 1998, the full-time Master has been appointed in
the above referenced divorce proceedings. Although the motion
for appointment of Master was filed by Rathleen Carey Daley,
attorney DeArmond is counsel of record for the Plaintiff.
Consequently, this letter is being directed to Mr. DeArmond as
counsel but a courtesy copy will be sent to Ms. Daley.
A divorce complaint was filed on April 9, 1996, raising
grounds for divorce of irretrievable breakdown of the marriage.
No economic claims were raised in the complaint.
On May 2, 1996, the Defendant filed an answer and
counterclaim and in the counterclaim raised the economic issues
of equitable distribution, alimony, alimony pendente lite, and
counsel fees and expenses.
I am going to proceed on the basis that grounds for
divorce are not an issue. I am directing each counsel in
accordance with P.R.C.P. 1920.33(b) to file a pre-trial
statement on or before Friday, September 11, 199B. Upon receipt
of the pre-trial statements, I will immediately schedule a
