CIVIL ACTIONIMORTGAGE FORECLOSURE
Plaintiff is Citibank, N.A. As Trustee, a corporation duly organized under the laws of and
doing business at the above captioned address.
2. The Defendant is John E. Myers, who is the mortgagor and real owner of the mortgaged
property hereinafter described, and his last-known address is 9 Paradise Dr., Carlisle PA 17013.
On 02/21/2001, mortgagor made, executed and delivered a mortgage upon the premises
hereinafter described to Advanta National Bank which mortgage is recorded in the Office of the Recorder
of Cumberland County in Mortgage Book 1673, Page 870.
4. The aforesaid mortgage was thereafter assigned by Advanta National Bank to Citibank, N.A.
As Trustee, Plaintiff herein, by Assignment of Mortgage which will be duly recorded in the Office of the
Recorder of Cumberland County.
The premises subject to said mortgage is described in the mortgage attached as Exhibit "A"
and is known as 9 Paradise Dr., Carlisle PA 17013.
6. The mortgage is in default because monthly payments of principal and interest upon said
mortgage due 06/01/2002 and each month thereafter are due and unpaid, and by the terms of said mortgage,
upon default in such payments for a period of one month, the entire principal balance and all interest due
thereon are collectible forthwith.
7. The following amounts are due on the mortgage:

8. The attorney's fees set forth above are in conformity with the mortgage documents and
Pennsylvania Law and will be collected in the event of a third party purchaser at Sheriffs Sale. If the
mortgage is reinstated prior to the Sale, reasonable attorney's fees will be charged based on work actually
performed.
9. Notice of Intention to Foreclose as required by Act 6 of 1974 (41 P.S. §403) and notice
required by the Emergency Mortgage Assistance Act of 1983 as amended under 12 PA Code Chapter 13,
et seq., commonly known as the Combined Notice of Delinquency has been sent to Defendant by regular and
certified mail.
WHEREFORE, Plaintiff demands Judgment against the Defendant in the sum of $49,919.30,
together with interest at the rate of $11.14 per diem and other costs and charges collectible under the
mortgage and for the foreclosure and sale of the mortgaged property.

PETITION TO ALLOW SERVICE ON THE DEFENDANT
BY REGULAR MAIL, CERTIFIED MAIL AND POSTING
PURSUANT TO PA RULE OF CIVIL PROCEDURE 430
1. Plaintiff attempted to serve a true and correct copy of
the Notice of Sheriff's Sale of Real Property upon the Defendant,
John E. Myers, at the mortgage premises known as 9 Paradise
Drive, Carlisle, PA 17013. However, the Sheriff advised that
they were unable to serve the Defendant with the Notice of Sale
as the Defendant is not residing at the mortgaged premises, but
he does retrieve his mail from the mail box at the premises every
couple of days. A copy of the Sheriff's Return of Non Service,
indicating the same is attached hereto and :marked Exhibit "A."
2. Plaintiff searched for a forwarding address for
Defendant. The Post Master advised that the Defendant, John E.
Myers, has not filed a change of address from 9 Paradise Drive,
Carlisle, PA 17013. A copy of the Affidavit of Good Faith
Investigation indicating the same, is attached hereto, and marked
Exhibit "B."
3. Plaintiff has checked the Local Telephone Directory and
411 Assistance for an address for the Defendant, John E. Myers.
There are no listings for the Defendant in or around the
Middletown area. A copy of the Affidavit of Good Faith
Investigation is attached hereto, and marked Exhibit "B."
4. Plaintiff has attempted to make inquiry with a neighbor
of the Defendant, John E. Myers. Laurel Ramos of 11 Paradise
Drive, Carlisle, PA 17013 with a telephone number of 717-249-6869
was contacted. Ms. Ramos stated that the Defendant, John E.
Myers, moved out in October of 2002 and that he was in jail in
the Dauphin County area. A copy of the Affidavit of Good Faith
Investigation indicating the same, is attached hereto and marked
Exhibit "B."
5. Plaintiff has made inquiry with the local tax bureau
for an address for the Defendant, John E. Myers. The tax office
has a mailing address of 9 Paradise Drive, Carlisle, PA 17013. A
copy of the Affidavit of Good Faith Investigation indicating the
same, is attached hereto and marked Exhibit "B."
6. Plaintiff has made inquiry with the Social Security
Administration and was advised that there are no death records
for the Defendant, John E. Myers, under his social security
number. A copy of the Affidavit of Good Faith Investigation,
indicating the same, is attached hereto and marked Exhibit "B."
7. Plaintiff has investigated the Defendant's Voter
Registration Records for an address for the Defendant, John E.
Myers. The Defendant is registered at the property of 9 Paradise
Drive, Carlisle, PA 17013. A copy of the Affidavit of Good Faith
Investigation, indicating the same is attached hereto and marked
Exhibit "B."
8. Plaintiff was advised that the Defendant, John E.
Myers, was in Cumberland County Prison, but. was released.
Plaintiff has attempted to make inquiry with the Defendant's
parole officer, Brian Pomean at 717-240-6522. However, Plaintiff
left message but received no response. A copy of the Affidavit
of Good Faith Investigation, indicating the same is attached
hereto and marked Exhibit "B."
9. If service cannot be made on the Defendant, the
Plaintiff will be prejudiced.
WHEREFORE, Plaintiff prays this Honorable Court grant an
Order allowing the Plaintiff to serve a true and correct copy of
the Notice of Sheriff's Sale of Real Property upon the Defendant,
John E. Myers, by regular mail, certified mail, return receipt
and further by posting of the same by the S:aeriff of Cumberland
County at the Defendant's last-known address and mortgage
premises known as 9 Paradise Drive, Carlisle, PA 17013.

made a diligent search and inquiry for the within named defendant, to wit: John E.
Myers, but was unable to locate him in his bailiwick. He therefore returns the within
Real Estate Writ, Notice and Description as NOT FOUND. Defendant is not residing at
within address, but he does retrieve his mail from the mailbox at that address every
couple of days, We are unable to find him at the address.
Dawn Kell, Deputy Sheriff, who being duly sworn according to law, states that on
April 11, 2003 at 2:32 o'clock P.M., she posted a true copy of the within Real Estate
Writ, Notice, Poster and Description, in the above entitled action, upon the property of
John E. Myers located at 9 Paradise Drive, Carlisle, Pennsylvania, according to law.
Kenneth Gossert, Deputy Sheriff, who being duly sworn according to law, states
that on June 25, 2003 at 8:42 o'clock AM, he served the within named defendant, John E.
Myers pursuant to a court order, by posting the premises located at his last known address
of 9 Paradise Dr., Carlisle, PA 17013 with a true correct copy of the Real Estate Writ,
Notice of Sale, Description and Poster, according to law.
R. Thomas Kline, Sheriff, who being duly sworn according to law, states that
after due and legal notice had been given according to law, he exposed the within
described premises at public venue or outcry at the Courthouse, Carlisle, Cumberland
County, Pennsylvania on September 3, 2003 at 10:00 o'clock A.M. He sold the same for
the sum of $42,401.00 to James L. & Teresa M. Adams. It being the highest bid and best
price received for the same, James L. & Teresa M. Adams of 11 South East Street, P.O.
Box 82, Franklintown, PA 17323, being the buyer in this execution, paid to Sheriff R.
Thomas Kline the sum of $45,317.04.
