STIPULATION AGAINST LIENS
TI.IIS AGREEMENT made the It)~ay of r-~t'c. ,1996, by :lnd
between IIERBERT G. WEAVER, t/lllUllGEVIEW CUST0l\1110l\1ES, 945 Ridge
Road, ShippensllUrg, Pennsylvanin 17257, hereinafter refelTed to as "CONTRACTOR",
and DAVIS L. MALLEIN and NANCY L. MALLEIN, husband and wife, of West
Pennsboro Township, Cumberland County, Pennsylvllnia, hereinnfter refelTed to as
"OWNER", whereby the fOllner undel100k and agreed to erect and construct a residence
on that certain tract of ground situate in West Pennsboro Township, Cumberland County,
Pennsylvania, being known as Lot NO.3 as shown on Final Subdivision Plan for Phase
No.3 of Andrew Manor as recorded in Cumberland County Plan Book 69, Page 140,
which lot fronts on Erin Place and contains 2.93 acres, as conveyed to Owners by deed
recorded in Cumberland County Deed Book 132, Page 810,
NOW, THEREFORE, THIS AGREEMENT WITNESSETI-I: That the said
CONTRACTOR, for and in consideration of the sum of One ($1.00) Dollar to it in hand
paid by OWNER, the receipt whereof is hereby acknowledged, and the fm1her
consideration mentioned in the agreelllent aforesaid, for themselves nnd their
subcontractors, and all p1ll1ies acting through or under them, covennnlllnd agree thnt no
mechnnic's liens or c1nims shall be filed or maintllined by them or any of them IIgainst the
snid buildings and the lot of ground npl11ll1ennntthereto for or on account of any work
done or mnterinls fUlllished by them or any of thelllllnder snid contract or otherwise, for,
townrds, in, or about the erection and construction of the snid buildings on the lotllbove

described, nnd the snid CONTRACTOR, for itself, its subcontrnctors nnd others under it
hereby expressly wnives nnd relinquishes the right to hnve, file, nnd mnintnin nny
mechnnic's liens or clnims ngninstthe snid buildings or nny of them, nnd ngrcc thntthis
instnllllent, wniving the right of lien, shnll be nn indcpcndcnt covcnnnt,
