It is further udmitted thut the very recento 1906 request of Junet D, Nocho thut Mr.
Dultimore vacute the residence hus not been complied with becuuse of Ms, Nocho'slack
of authority to multe such demunds,
7. Defendunt udmits thut Junet 13, Nocho pursued u Lundlord/'renunt
eviction proceeding, It hus continuully been Defendunt's position thut the mechunism
by which Mr. Bultimore would be evicted from the residenceo if he were to be evicted,
should be under the Lal1dlordlTenunt Act. Mr. Dultimore hus never conceded that
Janet Do Nocho hus the authority herself to initiute such un eviction proceeding.
8. Denied, District Justice Correul dismissed the Complulnt for Possession
which was med by Junet D. Nocho, without prejudice, und observed only the following:
"It appeurs that the identity of the Executor(s) of the Estate of Mildred P. Dultlmore
is questionable. Therefore, I believe the proper forum for eviction proceedings is in the
Court of Common Pleus." Defendant asserts thut after clurification us to who hUB
power of executor, uny executor would huve the uuthority to initiute un eviction
proceeding, so long as there would be a busis under the LundJordl'l'el1unt Act for
evicting the tenunt.

13. Denied. It is admitted that Janet B, Nocho requested that Defendant R.
Michael BllItimore agree to consolidation and that a reply would not have been
received by the time of the Plwntifrs motion. However a reply was forwarded by
Defendant before Defendant received service of the motion or rule to show cause. The
Defendant refuses to agreo to a consolidation for the reasons stated within this Answer
and New Matter.

14. The purties in the Landlord/Tenant proceeding ure Janet B. Nocho and
Ro Michael Baltimore, The parties in the estate proceeding include all five of the
sisters and brothers with interests under the Last Will and 'restU1l1ent of their mother,
Mildred p, Baltimore, They include Janet B. Nacho, R. Michllel Baltimore, Julian O.
Baltimore, Robert Baltimore, and Ronald Bnltimore.
150 Proceedings for eviction under the Landlord/Tenllnt Act of Pennsylvania
ure governed by Rules 501-582 of the Rules of Civil Procedure Governing Actions and
Proceedings before District Justices. Rule 1007 of the District Justice Rules provides
that proceedings on appeal from ajudgment of a District Justice ure to be conducted
de novo in accordance with the Rules of Civil Procedure that would be applicable If the
action was initially commenced in the Court of Common Pleas.
16. Pursuant to Cumberland County Rules of Court No. 1301-1, the
Landlord/Tenant appeal which was filed by Janet B. Nocho following the decision of
District Justice Correal would be appropriate for submission to a three member
urbitration panel.
170 Following her appenl, Janet B. Nocho filed with this Court on April 15,
1996, a Complaint, seeking possession of the real property. On April 26, 1996, the
Defendant filed an Answer to the Complaint.
18, On April 26, 1996, the Defendant filed a Petition for Appointment of
Arbitrators.
19. Under the Compulsory Arbitrlltion Rules of this Court, this matter is
appropriate for appointment of urbitrators, not for heuring by a Judge.

WHEREFORE, for the above-referenced reaaons, and especinlly because a) the
parties are not identical, and b) appeals from Landlord/Tenant Act decisions are
appropriate for compulsory arbitration, Defendant/Respondent respectfully requests

Plaintiff JANET NOCHO is an adult individual who rosides at
34 East Locust Avenue, Carlisle, Cumberland County, Pennsylvania
17013.

Defendant R. MICHAEL BALTIMORE, also known as Richard
Michael Baltimore, is an adult individual who resides at 36 East
Locust Avenue, Carlisle, Cumberland County, Pennsylvania 17013.

Plaintiff and Defendant are brother and sister and two of
the five children of Mildred P. Baltimore, Deceased.
4.
On May 6, 1996, a hearing is scheduled in the Orphanso Court
Division of this Court in the Estate of Mildred P. Baltimore
docketed to No. 21-94-833.
5.
The hearing will be addressing issues of the validity of the
life estate of Plaintiff JANET NOCHO in her mother's residence
and the request of Plaintiff JANET NOCHO for disqualification of
Defendant R. MICHAEL BALTIMORE as Executor in the Estate.

Defendant R. MICHAEL BALTIMORE has been occupying his
mother's residence and has refused the demands of Plaintiff JANET
NOCHO that he vacate the premises.
7.
Although it is the position of Plaintiff JANET NOCHO that
Defendant R. MICHAEL BALTIMORE has been nothing more than a
gratuitous licensee in the property, Plaintiff JANET NOCHO
acceded to the suggestion of Defendant R. MICHAEL BALTIMORE to
pursue his eviction as a landlord-tenant matter rather than
seeking to have him removed as a trespasser.

A hearing was held on the eviction proceedings on April 2,
1996. Plaintiff's Complaint was dismissed by District Justice
Paula p, Correal without prejudice on the basis of the standing
of Plaintiff JANET NOCHO as life tenant and proper personal
representative of the Estate.
9.
District Justice Correal opined that the proper forum for
the eviction proceedings was the Court of Common Pleas.
10.
Plaintiff JANET NOCHO has filed the above-captioned timely
appeal of that decision and a Complaint herein to get the case in
this Court.

All of the issues involved in the above-captioned eviction
proceedings will be the same issues which are involved in the
hearing schoduled for May 6, 1996, at No. 21-94-833.

Judicial economy and consistency of decisions will be served
by consolidating the above-captioned eviction proceedings with
the proceedings previously scheduled to be heard on May 6, 1996.

plaintiff JANET NOCHO has requested that Defendant R.
MICHAEL BALTIMORE agree to consolidation but has failed to
receive a response.
WHEREFORE, Plaintiff respectfully requests that your
Honorable Court issue a Rule upon Defendant to show cause why the
issue of his eviction from the real estate in which plaintiff
JANET NOCHO was devised a life estate should not be joined with
the issue of the disqualification of Defendant R. MICHAEL
BALTIMORE as Executor of the Estate of Mildred p, Baltimore with
all issues to be heard at the hearing scheduled on the Petition
for Disqualification of Defendant R. Michael Baltimore as
Executor of the Estate of Mildred P. Baltimore, which hearing is
scheduled for Monday, May 6, 1996, at 2:00 P.M. in Courtroom No.
1 of the Cumberland County courthouse, carlisle, Pennsylvania.
