O~ - J.t71,1 C,,-,~C~~ CIVIL ACTION - LAW DESERT DRY WATERPROOFING OF CENTRAL PENNSYLVANIA, INC, Ud/b/al DESERT DRY WATERPROOFING OF CENTRAL PA, LINDA DOLTON, DAVID REIFF and ADAM REIFF DEFENDANTS JURY TRIAL DEMANDED COMPLAINT AND NOW, comes the Plaintiff, Deanna Murray, by and through her attorney, and files this Complaint, as follows: 1. Plaintiff, Deanna Murray, is an adult individual who resides at 33 Millers Gap Road, Enola, Pennsylvania. 2. Defendant Desert Dry Waterproofing of Central Pennsylvania, Inc., is a business of unknown form or structure, with an address for conducting business at 295 Swedesford Road, Suite 273, Wayne PA 19087. 3. Upon information and belief there exists no corporation in good standing in the Commonwealth of Pennsylvania incorporated under the name "Desert Dry Waterproofing of Central Pennsylvania", issued such name as a fictitious name, or otherwise filed as a foreign business entity. 4. It is believed and therefore averred that Defendants Linda Dolton, David Reiff and Adam Reiff utilize the name "Desert Dry Waterproofing of Central Pennsylvania, Inc" as an alter ego of their individual business, and no such corporation validly exists in the Commonwealth of Pennsylvania. 5. On June 6, 2002, Plaintiff and Defendants entered into an agreement whereby Defendants would provide waterproofing services for Plaintiff at her residence. A copy of the Agreement is attached and incorporated hereto as Exhibit "A". 6. As part of the Agreement, Defendants guaranteed the quality of their work, and further guaranteed that they would continue to provide services until all water infiltration is eliminated. 7. Subsequent to the completion of the initial work, Plaintiff continued to experience water seepage into the basement of the home. 8. Plaintiff advised Defendants of this fact on numerous occasions. 9. Defendants failed to correct this substandard work, or rectify the water infiltration problem they were paid to correct. 10. Plaintiff made numerous attempts to contact Defendants, however Defendants have closed their local offices without notice to Plaintiff, and disconnected its phone lines without providing other contact information. COUNT I BREACH OF CONTRACT 11. Paragraphs 1 through 10 are incorporated herein by reference. 12. Defendants have breached the Agreement by: a. Failing to abide by the guarantee, and continue providing services until the water seepage problem has been rectified. b. failing to perform in a reasonable, workmanlike and timely manner, c. failing to act in good faith and with fair dealing. WHEREFORE, Plaintiff respectfully requests this Honorable Court enter judgment for her and against Defendants in an amount greater than $25,000.00, and further award interest and costs of suit COUNT II NEGLIGENCE 13. Paragraphs 1 through 12 are incorporated fully herein by reference. 14. Defendants owed a duty to Plaintiff to perform in a reasonable and workmanlike manner. 15. Defendants have breached such duty by failing to provide waterproofing services to the standard degree of workmanship 16. Due to Defendants' breach of such duty, Plaintiff has suffered damages in that the water infiltration problem still existed despite payment to Defendants, and she has had to incur additional costs to have workmen rectify the problem. 17. Such damages are the direct result of Defendants' negligence. WHEREFORE, Plaintiff respectfully requests this Honorable Court enter judgment for her and against Defendants in an amount greater than $25,000.00, and further award interest and costs of suit. COUNT IV FRAUD 18. Paragraphs 1 through 17 are incorporated fully herein by reference. 19. Defendants made material misrepresentations to Plaintiff regarding a guarantee to complete all work and continue to provide services until the water seepage matter was resolved. 20. Defendants made material misrepresentations to Plaintiff by providing a written contract which fraudulently represents the status of their business. 21. Defendants intentionally made such misrepresentations to induce Plaintiff to enter into the contract. 22. Plaintiff justifiably relied on such material misrepresentations, and has now suffered damages as a result of such reliance. WHEREFORE, Plaintiff respectfully requests this Honorable Court enter judgment for her and against Defendants in an amount greater than $25,000.00, and further award interest and costs of suit. COUNT IV UNFAIR TRADE PRACTICES ACT 23. Paragraphs 1 through 22 are incorporated fully herein by reference. 24. Defendants' conduct, as more fully stated above, constitutes unfair and/or deceptive acts or practices in that Defendants: a. represented that their services had characteristics, uses or benefits that they do not have, b. represented that there services where of a particular standard or quality which they were not, c. failed to comply with the terms of a written guarantee, d. engaged in other fraudulent and/or deceptive conduct which created a likelihood of confusion and misunderstanding. WHEREFORE, Plaintiff respectfully requests this Honorable Court enter judgment for her and against Defendant in an amount greater than $25,000.00, and further award interest, costs of suit, attorneys fees and treble damages.
