On ,January 13, 1996 you stopoed in the area of my house
where I was shovelinq snow. You oot out of the car, came to
me and stated "we nO~1 have removed all of our property,
completed cleaninq, and desired to inspect the apartment with
you", I told you" I had no tiMe to insnect the apartment at
this time". 1 asked if you removed il11 your property includinn
the sweeper and you stated "yes", You a I so stated "if I
could not inspect the anartment with you at this time you
woul d not have time to sol ve the inspection di screpanci es", I
told you "you still have two weeks to solve any discrepancies".
You also questioned how I could enter the anartment ~lithout
your approval. The lease clearly states "the lessor or aoent
may enter at will, to inspect the premises". I also advised
you that 1 would not be returnino your security deposit
because of; under further aqreements with you items 6 and oc
"Iere violated, At no time from ,January 13. 19~1j to ,January 2~, 19%
did you contact me and request the establishment of a date and
time to inspect the apartment,
On January 29, 1~% I phoned I1r Linn at his employment.
I told him 1 \~anted to set up a time on ,January 31. 1!l!l6 (the
last day of his paid rent) to insnect the apartMent. I "Iso
advised him 1 "/Quld have ,~ith me the lady ,~ho nrepared the
anartment for their rental, It was aoreed that we would Meet
on January 31. 19~6 time of 5:30 P,t1. I also told hiM I
wanted all keys to the apartment prior to the insnection.
On January 30. 1996 "rs, Linn lert a messane on my answerino
machine, cancelled the inspection "ppointMent and statinn
the keys were in an envelope on the kitchen sink,

NOW COMES Plaintiffs Christophcr C. Linn and Robin C. Linn
("Plaintiffs"), through their own accounts and efforts, and
file within Complaint.
1. The Plaintiffs, Christopher C. Linn and Robin C. Linn,
are married adult individuals residing at 173 College Hill Road
(Central Pennsylvania Business School, Box 5-A), Summcrdale,
Cumberland County, Pennsylvania.
2. The Defendant, Richard R. Bucher, is an adult individual
residing at 214 South High Street, Mechanicsburg, Cumberland
County, Pennsylvania.
3. At all times relevant hereto Defcndant Richard R. Bucher
was the owner of a residential apartment dwelling located at
214 South High Street Rear, Mechanicsburg, Cumberland County,
Pennsylvania, which was lcascd by agrcement of terms in writing
to Plaintiffs. A true and correct copy of this lease is attached
hereto as Exhibit "A" and incorporatcd hercin by reference.
4. Thc pcrtincnt terms set forth in thc lease were for
thc pcriod of one year beginning the 1st of october, 1994, and
ending on the 30th of September, 1995. Following fulfillment

of one-year lease, a 30-day notice to vacato tho promiuou wau
required of tenants (Plaintiffs). ^ uecurl\:y depoult 1n thu
amount of $495.00 was paid by Plaintiffu to Dufondant:. Monthly
rent in the amount of $495.00 was thon due to Dufendant on the
last day of each and every month for tile comin(J month.
5. On or about December 14, 1995, Plaintiffu wero hired
by the Central Pennsylvania Uuaineua School au Ruu1dont
Assistants, a part-time posit10n which roquireD full-timo
residency on the campus of tho school and to begin on or about
January 1, 1996.
6. On or about December 15, 1995, Plaintiffs went tn
Defendant's residence and expressed verbally that they had
accepted the position as Resident Assistants and would be moving
out by January 1, 1996. Plaintiffs also explained that the
date of this meeting was to servo as the official 3D-day notice
date, as required by the lease, which would then terminate on
January 31, 1996. Plaintiffs also asked Defendant to examine
the dwelling with them to help them get the dwelling into a
satisfactory condition for Defendant. This requeDt was agreed
to by Defendant.
7. On or about December 29, 1995, Plaintiffs moved their
possessions from Defendant's rental dwelling. Payment in full
of January, 1996 rent was made. ^ note containing Plaintiff's
new address and telephone number was left for Defendant.
O. During occupancy of Dofendant's rental dwelling,
Plaintiffs made minor repairs and/or improvementu to bathroom
of said dwelling. Thoso woro:
(a) Two interior components of the sink faucet
handles and identically new faucet handles.
(b) A new, water-saving shower head. old shower head
was left behind in cabinet.
(c) A small double shelf.
(d) A matching deodorizer spray can apparatus.
(e) A new interior shower curtain.
(f) A new metal towel rod.
9. On or about December 30, 1995, Plaintiffs returned
to Defendant's rental dwelling and thoroughly cleaned.
Plaintiffs photographed dwelling and left.
10. On or about January 13, 1996, Plaintiffs returned to
Defendant's rental dwelling to complete cleaning and finish
business with Defendant. A conversation between Defendant and
Plaintiff Christopher C. Linn ensued and Defendant was asked
to inspect dwelling with Plaintiffs. Defendant refused.
Plaintiffs completed cleaning Defendant's rental dwelling and
left.
11. On or about January 25, 1996, a letter was sent to
Defendant by Plaintiff's acting attorney, Thomas M. Kutz,
Esquire, doing business at Frankeberger Place, 219 East Main
street, Mechanicsburg, Cumberland County, Pennsylvania, asking
for full return of Plaintiff's security deposit and outlining
Plaintiff's compliance with the lease and The Pennsylvania
Landlord Tenant Act of 1951. A true and correct copy of this
letter is attached hereto as Exhibit "B" and incorporated herein
by reference.
12. On or about January 29, 1996, Defendant tolephoned
Plaintiff Christopher C. Linn at his place of business offering
to inspect rental dwelling with Plaintiffs if Plaintiffs would
surrender keys to the dwelling prior to inspection. Plaintiff
agreed to these terms and the meeting ~as set for 5:30 p.m.
on January 31, 1996.
13. On or about January 30, 1996, Plaintiff Robin C. Linn
r~turned to Defendant's rental dwelling with Mike Mumper,
Facilities Director of Central Pennsylvania Uuuinouo School
and had him do an independent inspection 01 Defundant'u rental
dwelling. The results of Mike Mumper's inepection are recorded
in a letter to Plaintiff's acting attorney, Thomao M. Kutz,
Esquire. A true and correct copy of thie lot tor io attached
hereto as Exhibit "c" and incorporated heroin by roforonco.
14. On or about January 30, 1996, following Mike Mumper's
inspection of Defendant's rental dwelling, Plaintiff Robin C.
Linn left a sealed white envelope with Defondant's name
containing the keys to the rental dwelling locked inside the
dwelling. Plaintiff Robin C. Linn then telophoned Defendant's
residence and left a message on Defendant's answering machine
indicating the return of the keys to the rontal dwelling and
canceling Plaintiff's appointment with Defendant to inspect
the rental dwelling.
15. On or about January 30, 1996, Plaintiff Christopher
C. Linn mailed a letter to De1endant'o residence, reiterating
contents of Plaintiff Robin C. Linn's answering machine message
to Defendant. ^ true and correct copy of this letter is attached
hereto as Exhibit "0" and incorporated herein by reference.
16. On or about February 13, 1996, Plaintiffs received
by certified mail a letter from Defendant claiming Plaintiff's
security deposit would not be returned due to violations of
the lease, clauses 6 and 9C. Defendan~ also indicated his
intentions to seek additional moneys for property and punitive
damages. Defendant did not at any point in this letter offer
a list of payable damages to rental dwelling by Plaintiffs as
required by 66 P.S. 5 250.512(a). A true and correct copy of
this letter is attached hereto as Exhibit "E" and incorporated
herein by reference.
17. Plaintiffs never received a list of claimed damages
to rental dwelling from Defendant until Defendant filed his
counter claim of the District Justice Action below, which was
filed by Defendant on March 22, 1996.
16. As a result of Defendant's failure to refund Plaintiff's
security deposit or provide Plaintiff's a written list of damages
for which the Defendant would be entitled to retain the security
deposit, all in violation of the Landlord and Tenant Law, 66
P.S. 5 250.512, Plaintiffs are entitled to an amount equal to
two times the security deposit, which is $990.00.
19. On March 6, 1996, Plaintiffs initiated this action
in the office of District Justice Ronald E. Klair, Magisterial
District 09-3-05, docketed to CV-0000070-96. Plaintiffs were
successful in this action and incurred filing costs of $46.00,
which sum is recoverable from Defendant. A true and correct
copy of judgment for Plaintiffs is hereto attached as
EXUIBIT "A"
