PBTITION POR APPROVAL OP A COMPROMISBD SBTTLEMBNT.
A MINOR'S ACTION
TO THE HONORABLE, THE JUDGES OF THE CUMBERLAND COUNTY COURT:
AND NOW, come the Petitioners, Ryan Johnson, a minor, by his
mother and natural guardian, Sharon Johnson, who state:
1. Petitioner, Sharon Johnson, is the mother and natural
guardian of Ryan Johnson, a minor, presently age 13, born April 30,
1982.
2. The minor, Ryan Johnson, resides with Petitioner, Sharon
Johnson, at 259 Walnut street, Shippensburg, Cumberland county,
Pennsylvania, 17257.
3. The minor Petitioner sustained injuries as a result of an
incident on September 28, 1994 when Respondent, Frank Fogelsanger,
inadvertently struck Ryan Johnson on the left lower jaw.
4. As a result of the incident, charges were filed against
Respondent, Frank Foge1sanger, who was placed on probation and
required to remain on probation until restitution was paid for Ryan
Johnson's injuries.
5. In order to determine the cost of restitution, the minor,
Ryan Johnson, was examined by Gary S. Davis, DDS.
6. A report by Dr. Davis to William Brandt, Cumberland
county Probation, indicates that two of Ryan Johnson's teeth will
need either a composite filling and/or a crown which would cost
$1100. (See Bxbibit A attached hereto)
7. The minor, Ryan Johnson, was wearing braces at the time
of the incident, continues to wear braces to this date, and there
is no estimation of when the braces may be removed from his teeth.
B. Since it is unknown when Ryan Johnson will have his
braces removed, which of the two treatment options proposed by Dr.
Davis will be necessary at the time the braces are removed, is
unknown at this time.
9. Petitioners and Respondent have agreed to settle this
matter with Respondent making payment to Petitioner, Ryan Johnson,
in the amount of $1100.
10. The Petitioners have reviewed the proposed settlement and
believe the settlement to be fair, just and equitable and to be in
the best interest of the minor, Ryan Johnson.
11. The Petitioners recognize that the monies received in
this settlement are monies for the minor, Ryan Johnson, and that
the funds must be deposited into an interest bearing, restricted
bank account insursd by the Fsderal Govsrnment or one of its
agencies and not to be removed without prior order of a court of

wantod to clarify the possible treatment plans for Ryan Johnson due
to InjurloD Duotained on September 28, 1994.
'l'he enclollod treatment plan gives two options for the upper right
canJ.no (M6) and the lower right canine (#22), Both teeth will need
oithoJ: a compulIJ.te filling or a crown. At this point, I believe a
compouJ.te filling would be the beet treatment ($102.00 each, a
total of $204.00). However, it is possible that further treatment
may bo lIeoded due to thia injury. Occasionally a small fracture
can contJ.nuo deeper and either crack the tooth further or cause the
narve to become infected. If this occurs in either tooth, the
patient ~ need a crown or a root canal in the future.
