CIVIL ACTION - COMPLAINT IN MORTGAGE FORECLOSURE
Plaintiff, Norwest Mortgage, Inc., by its attorneys, o'Keefe,
Grenen & Birsic, P.C., files the following Complaint in Mortgage
Foreclosure:

Plaintiff,
Norwest
Mortgage,
Inc.
(hereinafter
"plaintiff"), is a corporation with its principal place of business
located at 405 S.W. 5th street, Des Moines, Iowa 50328.
2. Defendants, Kevin A. winnemore and Perry R. Winnemore,
are individuals whose last known address is 216 A Street, Carlisle,
Pennsylvania 17013.
3. On or about July 22, 1993, Defendants executed a Note in
favor of First Advantage Mortgage corporation (hereinafter "First
Advantage") in the original principal amount of $68,850.00. A true
and correct copy of said Note is marked Exhibit "A", attached
hereto and made a part hereof.
4. On or about July 22, 1993, as security for repayment of
the Note, Defendants made, executed and delivered to First
Advantage a Mortgage in the original principal amount of $68,850.00
on real property and improvements thereon commonly known as 216 A
street, Carlisle, Pennsylvania
17013 (hereinafter "Mortgaged
Premises") I said Mortgage was recorded in the Office of the
Recorder of Deeds of Cumberland county on August 2, 1993, in
Mortgage Book Volume 1154, page 789. A true and correct copy of
said Mortgage containing a description of the Mortgaged Premises is
marked Exhibit "B", attached hereto and made a part hereof.
5. On or about March 18, 1994, First Advantage assigned the
aforesaid Mortgage to Plaintiff pursuant to an Assignment of
Mortgage recorded in the Office of the Recorder of Deeds of
Cumberland County in Mortgage Book Volume 468, Page 939. A true
and correct copy of said Assignment is marked Exhibit "C", attached
hereto and made a part hereof.
6. Defendants are the record and real owners of the
aforesaid Mortgaged Premises.
7. Defendants are in default under the terms of the
aforesaid Note and Mortgage for, among other reasons, failure to
pay the monthly installments of principal and interest when due.
S. Plaintiff has made demand for payment upon Defendants but
Defendants have failed or refused to pay.
9. On or about December 11, 1995, Defendants were mailed
Notices of Homeowners' Emergency Mortgage Assistance ~ct of 1983,
in compliance with the Homeowners' Emergency Mortgage Assistance
Act, Act 91 of 1983. True and correct copies of said Notices are
marked Exhibit "D", attached hereto and made a part hereof.
10. Plaintiff was not required to send Defendants written
notice of Plaintiff's intention to foreclosure said Mortgage
pursuant to 41 P.S. ~403 (Act 6 of 1974) prior to the commencement
of this action for the reason that said Mortgage is not a

ALL that certain lot or piece of ground with the messuage or tenement thereon erected, situate in the Fifth
Ward of the Borough of Carlisle, Cumberland County, Pennsylvania, more fully bounded and described as

ON the North by "A" Street; on the East by lots now or formerly of John Kutz and Walter Bishop; on the
South by a twelve (12) foot alley running parallel to said "A" Street; and on the West by property now or
formerly of Norman I. Arbegast and wife, HAVING a width of twenty-three (23) feet six (6) inches in front
