COURT ORDER

consideration of the attached Custody Conciliation
ordered and directed as follows:

Report, it is
1. The Father, Lindsey E. Schue, and the Mother, Trina L. Schue,
shall enjoy shared legal custody of Seneca N. Schue, born
October 20, 1984 and Sierra N. Schue, born November 29, 1988.
2. During the school year, the Father shall enjoy primary
physical custody of tho minor children. During the school
year, the Mother shall enjoy temporary physical custody as
follows:
A. Every other weekend from Friday at 7 :00 p.m. through
Sunday at 7:00 p.m. Mother's alternating weekends shall
begin on September 13, 1996, with the parties alternating
thereafter.
3. During the summer months, the Mother shall enjoy primary
physical custody under the following schedule:
A. The Father shall deliver custody of the minor children to
the Mother one week from when the children are finished
with school.
B. Mother shall enjoy custody for a three-week time frame
once she has received the children in the summer. After
the first three-week period, Father shall enjoy a one-
week time period; Mother shall then have a period of
three weeks wi th the minor children wi th the Father then
enjoying another one full week. Mother shall enjoy
I custody the final three weeks of the summer. In the
event school for the children would start during the time
of Mother's custody at the end of the summer, Mother
shall return the children to the Father at least three
days prior to the start of school. In the event the
parties have a vacation scheduled during the summer that
requires the modification of the foregoing summer
schedule, the parties may agree between themselves to
alternate or modify this arrangement in any way. Time
for exchange for custody during the summer months shall
be at 7:00 p.m.

4. For the Christmas holiday, the parties shall alternate
division of the Christmas vacation with the Mother to have the
children from 7:00 p.m. on the last day of school prior to
Christmas through 2:00 p,m. on Christmas Day in even years,
and from 2:00 p.m, on Christmas Day thz'ough 7:00 p,m. on the
day prior to the resumption of school after Christmas in odd
years, and the Father to have the remaining alternating
periods of Christmas vacation each year.
S. For the Thanksgiving holiday, the parties shall al ternate
division of the Thanksgiving vacation with the Mother to have
the children from 7:00 p.m. on the last day of school prior to
Thanksgiving through 7:00 p.m. on the Saturday after
Thanksgiving Day in odd-numbered years, and from 7:00 p,m. on
the Saturday after Thanksgiving Day through 7:00 p.m. on the
last day prior to the resumption of school after Thanksgiving
in odd years. The Father is to have remaining alternating
periods of Thanksgiving vacation each year.
6. For the Easter vacation, the parties shall alternate division
of the Easter vacation with the Mother to have the children
fz'om 7:00 p,m. on the last day of school prior to Easter
through 7:00 p.m. on the Saturday before Easter in even-
numbered years, and from 7 :00 p.m. on the Saturday before
Easter through 7 :00 p.m. on the last day prior to the
resumption of school after Easter in odd years. The Father
shall have the remaining alternating periods of Easter
vacation each year,
7. The parties shall alternate holiday weekends from Friday at
7:00 p.m. to Monday at 7:00 p,m. In even-numbered years, the
Father shall have Martin Luther King, Jr, weekend, Memorial
Day weekend and Columbus Day weekend. The Mother shall enjoy
President's Day weekend, Labor Day weekend and Veteran's Day
weekend. In odd-numbered years, the designation shall be
reversed.
8. Fot" the alternating weekend visitation schedule during the
school year, no adjustments w,ill be made to the alternating
weekend partial custody schedule even though the various
holiday partial custody provisions may result in custody in
one of the parties for three weekends in a row.
9. The party who does not otherwise have custody of the children
under the terms of this order shall have the children from
4:00 p.m, to 8:00 p.m. on the birthday of either child when
their birthday falls on other than a school day; and when the
birthday of the child falls on a school day, the party who
does not otherwise have custody of the children under the
terms of this order shall have the children from 6:00 p,m. to
8:00 p.m,

The parties shall alternate holiday weekends from Friday at
7:00 P,M, to Monday at 7:00 P,M. In even numbered years, the
father shall have Martin Luther King, Jr, weekend, Memorial Day

weekend and Columbus Day weekend, The mother shall enjoy
President's Day weekend, Labor Day weekend and Veteran's Day
w~ekend. In odd numbered years, the designation shall be
reversed.

For the alternating weekend visitation schedule during the
school year, no adjustments will be made to the alternating
weekend partial custody schedule even though the various holiday
partial custody provisions may result in custody in one of the
parties for three weekends in a row,

The party who does not otherwise have custody of the
children under the terms of this Order shall have the children
from 4:00 P,M, to 8:00 P,M. on the birthday of either child when
their birthday falls on other than a school day; and when the
birthday of the child falls on a school day, the party who do..
not otherwise have custody of the children under the terms of
this Order shall have the children from 6:00 P.M, to 8:00 P.M,

The mother shall enjoy physical custody of the children fro.
9:00 A,M. to 7:00 P,M, on Mother's Day, and the father shall
enjoy physical custody for the same time fr.ame on Father's Day.

The parties may modify this Order as they agree between each
other. In the event of no agreement between the parties, this
Order shall control,

Transfer of custody shall be at the residence of the
parties. During the school year, the mother shall be required to
receive and return the children. During the summer, the father
shall be required to receive and return the children,

This Order is entered pursuant to an agreement reached by
the parties at a custody Conciliation Conference. In the event
either party desires to modify this order, that party may
petition the Court to have the case again scheduled with a
custody Conciliator.

Since entry of said Order. the circumstances have materially changed in that the
mother has becn able to move back to Cumberland County, Pennsylvania, from the
Commonweal1h of Virginia.

Petitioner rcqucsts that the custody arrangemen1 be modified from primary custody
in the fa1her to joint custody in both parties.

Petitioner believes and therefore avers that the requested modification would serve
the best interests and gencral welfare of the children in maximizing the amount of time
that they would be able to spend with each parent.

During the summer months, the mother shall enjoy primary
physical custody under the following schedule:
(a) The father shall deliver custody of the minor
children to the mother one week from when the children are
finished with school.
(b) The mother shall enjoy custody for a three week
time frame once she has received the children in the summer,
After the first three week period, the father shall enjoy a
one week time period; the mother 5hall then have a period of
three weeks with the minor children with the father then
enjoying another one full week. The mother shall enjoy
custody the final three weeks of the summer. In the event
school for the children would start during the time of the
mother's custody at the end of the summer, the mother shall
return the children to the father at least three days prior
to the start of school. In the event the parties have a
vacation scheduled during the summer that requires the
modification of the foregoing summer schedule, the parties
may agree between themselves to alternate or modify this
arrangement in any way, Time for exchange for custody
during the summer months shall be at 7:00 P.M,

For the Christmas holiday, the parties shall alternate
division of the Christmas vacation with the mother to have the

Thanksgiving through 7:00 P.M. on the Saturday after Thanksgiving
day in odd numbered years, and from 7:00 P.M, on the Saturday
after Thanksgiving day through 7:00 P,M, on the last day prior to
the resumption of school after Thanksgiving in even years. The
father is to have remaining alternating periods of Thanksgiving
vacation each year,

For the Easter vacation, the parties shall alternate
division of the Easter vacation with the mother to have the
children from 7:00 P.M. on the last day of school prior to Easter
through 7:00 P.M, on the saturday before Easter in even numbered
years, and from 7:00 P,M. on the Saturday before Easter through
7:00 P.M. on the last day prior to the resumption of school after
Easter in odd years, The father shall have the remaining
