Defendant demanded his vehicle and Plaintiff demanded payment for the work he had completed which totaled $9,047,12. Since December I, 1995, plaintiff has storcd defendant's vehicle in an inside heatcd garagc, Typical storage fees for storage by a garage are ten dollars a day for outside storage and twenty-two dollars a day for inside storage, 1,434 days have elapsed and the vehicle has been placed in a heated indoor storage spot for this period, At ten dollars a day defendant would owe $14,340.00 in storage fees and at twenty-two dollars a day Defendant would owe $31,548,00 in storage fees, STATEMENT OFTHE LAW "Whenever a workman or artisan, by his labor or skill, increases the value of personal property placed in his possession to be improved he has a lien upon it for his proper charges until paid. but in o~der to charge a chattel with his lien, the labor for which the lien is claimed mllst have been done at the request of the owner or under circumstances from w~ich his assent can be reasonably implied." LAW COMlLAINT FOR BREACH OF CONTRACT AND NOW, this 29th day of May, 1996, comes the plaintiff, LARRY J. RUNK,II, by his attorneys, IRWIN. McKNIGHT & HUGHES, and makes the following complaint against the defendant, MARLIN GASTROCK, as follows: 1. The plaintiff is Larry ], Runk, II, an adult individual residing at R, 0, #1, Box 484. Millersburg, Pennsylvania 17062, The plaintiff also conducts a welding and automobile repair business known as Bill's Welding situate at his home as well as 254 East North Street, Carlisle, Pennsylvania 17013, 2, The:defendant is Marlin Gastrock, an adult individual residing at p, 0, Box 1043, Camp I Hill, Pennsylvania 17011, 3, On or about October I, 1993, the defendant, Marlin Gastrock, requested that the plaintiff repair and completely restore the body damage on a 1976 Ford Lincoln Mark IV automobile, 4, The plaintiff, Larry Runk, agreed to restore said automobile of the defendant, Marlin Gastrock, except for the vinyl top which needed to be separately restored or replaced by a specialist. The panies agreed that the plaintiff was to be paid for his ti..te and material required to restore the automobile and place it in good operational order. 5, At the time the said automobile was given to the plaintiff, it was severely corroded by rust at many locations, The plaintiff' agreed to restore the automobile after work and on weekends and requested that the defendant provide funds for the project as the work was performed. 6, Despite repeated requests by the plaintiff the defendant refused to provide ongoing funds for the restoration of the automobile, 7. The plaintiff was able to complete the restoration of the defendant's automobile ill March of 1996, The plaintiff has incurred substantial costs which are itemized and are marked as EMibits A and 8 and are made a part of this complaint, Exhibit "A" EMibit "8" TOTAL $5,607,86 $3.439,26 $9,047,12 8, The plaintiff has offered to return the completed automobile upon payment of the outstanding bills but the defendant has refused to tender any payment. 9. The plaintiff has been storing the restored automobile of the plaintiff at his home or place of business since March 19, 1996, The plaintiff is entitled to payment of storage charges at the rate of$22,00 per day while the defendant pays the outstanding bills and picks up his automobile, 10, The defendant's failure to pay the plaintiff for the restoration of this bill is a breach of the contract reached by the panies and the plaintiff is entitled to payment in full of the outstanding charges owe~ by the defendant in addition to the storage charges. 11. In the alternative the plaintiff is entitled to his quantum merit costs and time for the work perfonned on behalf of the defendant required to restore his automobile. Runk, II, and makes the following Answer to the Counterclaim of the defendant: 16, The averments of paragraph one (1) through sixteen (16) of the Complaint and the Answer to New Matter are incorporated herein and made a part of this Answer, 17. The averments of paragraph seventeen ( 17) are admitted in part and denied in part, It is admitted that on or about October I, 1993, the parties agreed that Mr. Runk would perform work on behalf ofMr, Gastrock. It is denied that only a few rust spots were to be repaired. On the contrary, the defendant requested that his automobile be restored which required significant body restoration as well as new parts and mechanical repairs. Defendant's only request was that Plaintiff paint the body of the automobile white and repair the rust spots on the body of the automobile, Several months after agreeing to do so, Plaintiff stated he felt the vinyl top should also be replaced with a new white vinyl top for a better appearance. Plaintiff never. mentioned a specialist, and implied he would take care of replacing the top and was merely seeking permission or additional funds to do so. 4. Denied as stated. Further, the Defendant did pay the Plaintiff for the work and materials as demanded. ! 5. Admitted in part and denied in part. It is admitted that the automobile was corroded and that the Defendant requested that the Plaintiff paint it and repair any rust spots on the body a.~~.. of the automobile. It ls denied that the Plaintiff was to completely restore the automobile. The automobile was released to the care of the Plaintiff for a normal repainting and removal of rust spots. 6. Denied. Despite the Defendant's supplying payment in excess of $1,200.00, the agreed upon services were not performed, nor was the automobile delivered to the Defendant. 7. Denied. That part of the allegations of Paragraph 7 to the effect that repairs were made thereto etc., is herewith denied. On the contrary, the Defendant avers that after reasonable investigatlon, he has no knowledge or information sufficient to form a belief as to the truth of the facts averred in said paragraph. Therefore, the Defendant denies the averments of the aforesaid paragraph of the Complaint and, if material, demands proof thereof on the tr.ial of this cause. The parties agreed that the Plalntiff would perform work on the automobile after work and on weekends. The parties further agreed that the Defendant would provlde funding to the Plaintiff as work on the automoblle progressed. 19. Despite the terms of the agreement between the Defendant and the Plalntlff, Plaintiff took it upon himself to perform work on the automobile above and beyond the nature of the agreed upon services. 20. Despite the fact that the Defendant tendered payments by cash and check in excess of $1,200.00, the Plaintiff has refused to deliver the Defendant's automobile. 21. The Plaintiff's failure to deliver the vehicle to the Defendant after receiving payment for the agreed upon services is a breach of the contract formed by the parties. As such, the Defendant is entitled to the return of hls automobile in normal operating condition and total costs of $13,539,50.
