JILL that certain tract of land situate in the Borough of
Carlisle, Cumberland County, Pennsylvania, more particularly
bounded and described pursuant to a Land Subdivision of
Schoolfield, Chapel Hill, dated April, 1987 revised through
February 11, 1988, and recorded in CUmberland County plan Book 55,
Page 29, as follows:
BEGINNING at an iron pin on the northern dedicated right-of-way
line of School Field Drive at the southwestern corner of Lot No. 12
as shown on the above-described SIJbdivision Plan; thence by said
northern dedicated right-of-way line of School Field Drive, North
89 degrees, 53 minutes 00 seconds West 12.06 feet to an iron pin;
thence 90ntinuing by said northern dedicated right-of-way line by
a curve to the right having a radius of 15.00 feet a distance of
15.71 feet to an iron pin; thence continuing by said northern
dedicated right-of-way line by a curve to the left having a radius
of 75,00 feet a distance of 78.54 feet to an iron pin on said
right-of-way line at the southeastern corner of Lot No. 14 as shown
on the above-described subdivision Plan; thence by said Lot No. 14,
North 00 degrees 07 minutes 00 seconds East 188.31 feet to an iron
pin in line of Lot No. 22 as shown on the above described
Subdivision Plan; thence by said Lot No. 22, South 83 degrees 42
minutes 00 seconds East 90,53 feet to an existing iron pin in line

ALL that certain tract of land situate in the Borough of
Carlisle, Cumberland County, Pennsylvania, more particularly
bounded and described pursuant to a Land Subdivision of
Schoolfield, Chapel Hill, dated April, 1987 revised through
February 11, 1988, and recorded in Cumberland County plan Book 55,
Page 29, as follows:
BEGINNING at an iron pin on the northern dedicated right-of-way
line of School Field Drive at the southwestern corner of Lot No. 12
as shown on the above-described Subdivision Plan; thence by said
northern dedicated right-of-way line of School Field Drive, North
89 degrees, 53 minutes 00 seconds West 12,06 feet to an iron pin;
thence I continuing by said northern dedicated right-of-way line by
a curve to the right having a radius of 15.00 feet a distance of
15.71 feet to an iron pin; thence continuing by said northern
dedicated right-of-way line by a curve to the left having a radius
of 75.00 feet a distance of 78,54 feet to an iron pin on said

4. On or about September I, 1989, Defendants executed a Note ("Note") in favor of
PlaintitTin the original principal amount of$148,50000 A true and correct copy of said Note is
marked Exhibit "A", attached hereto and mude a part hereof.
6. On or about September I, 1989, as security for payment of the aforesaid Note.
Defendants, made, executed and delivered to Plaintiff a Mortgage in the originul principal
amount of$148,500.00 on the premises hereinafter described, said Mortgage being recorded in
the Office of Recorder of Deeds of Cumberland County on September I, 1989, in Mortgage
Book Volume 951, Page 68. A true and correct copy of said Mortgage containing a description
of the premises subject to said Mortgage is marked as Exhibit "B", attached hereto and made a
part hereof.
7. Defendants are the record and real owners of the aforesaid mortgaged premises.
8. Defendants are in default under the terms of the aforesaid Note and Mortgage for,
inter alia, failure to pay the monthly installments of principal and interest on said Note when
due,
9. Demand for payment has been made upon the Defendants by Plaintiff, but
Defendants have failed or refused to pay.
10, On November 7, 1995, Defendants were mailed Notices of Horneowner's
Emergency Mortgage Assistance Act of 1983, in compliance with the Homeowner's Emergency
Mortgage Assistant Act, Act 91 of 1983,
11. Plaintiff was not required to send Defendants written notice of Plaintiff's intention
to foreclose said Mortgage pursuant to 41 P S ~403 (Act 6 of 1974) prior to the commencement
of this action for the reasons that
(a) said Mortgage is not a "residential mortgage" as delined in 41 PS *101; and
(b) the Defendants are not "residential mortgage debtors" as delined in 41 PS. *101.

12. The amount due and owing PlaintilTby Defendants is as follows:
Principal: $142,180.13
Interest through 3/27/96: 14,552.79
Late Charges through 3/27/96: 543.5 I
Escrow Deficiency thruugh 3/27/96: 1,053.91
Attorney's Fees (5% of amount due): 7916.52
TOTAL:
$166,246.86
WHEREFORE, Plaintiff demands judgment in mortgage foreclosure for the amount due
of $166,246.86, with interest thereon at the rate of $37.03 per diem from March 27, 1996, plus
costs (including increases in escrow deficiency) and additional late charges, and for foreclosure
and sale of the mortgaged premises.

the plaintiff has a valid claim to foreclose the Mortgage or
judgment.

and Notice to Defend or if the judgment was entered before twenty
(20) days after service or in certain other events, To exercise

AND NOW, comes the Plaintiff, Chase Manhattan Mortgage
Corporation, formerly Chase Home Mortgage Corporation, by and
through its attorneys, O'KEEFE, GRENEN & BIRSIC, P.C" and files
the within Motion for Service of Complaint in Mortgage Foreclosure
Pursuant to Special Order of Court under Pennsylvania Rule of Civil
Procedure 430 as follows:
1, On or about April 12, 1996, Plaintiff filed a
Complaint in Mortgage Foreclosure against the Defendants, Kenneth
P. Aultice, Janet D, Aultice and The United States of America, at
the above-captioned number and term.
2 r On or about April 19, 1996, Plaintiff mailed to
defendant, Janet D. Ault ice, a copy of the Complaint in Mortgage
Foreclosure by registered mail, return receipt requested to her
last known address being Gustavo Becquer, 27 Esc Barcelona, Spain
08023, A true and correct copy of the receipt for registered mail
is marked Exhibit "A", attached hereto and made a part hereof.
3. On or about May 15, 1996, Plaintiff l'eceived the
Complaint in Mortgage Foreclosure sent to defendant, Janet D.
Aultice, unclaimed. A true and correct copy of the Registered Mail
Card is ma:z:'ked Exhibit "B" "ttached hereto and made a part hereof.
4. An Affidavit of the Plaintiff stating the nature and
extent of the investigation which has been made to determine the
whereabouts of Defendant, Janet D. Aultice, and the reasons why
service of the Complaint in Mortgage Foreclosure cannot be made, is
marked Exhibit "C", attachp.d hereto and made a part hereof.
WHEREFORE,
Plaintiff respectfully requests that this
Honorable Court direct the Sheriff of Cumberland County to serve
Defendant, Janet D, Aultice, with the Complaint in Mortgage
