Dear Mike:
I was surprised to receive the Notice for the arbitration hearing in the above matter,
because I did not believe that Plaintiff's counsel provided us with a copy of the Arbitration
Petition.
My clients have been experiencing a dire family crises, because their daughter has
been III with a rare form of cancer, It is so unusual that the Carlisle Sentinel had carried
an article about her illness. and the extensive fund-raising activities which are being
carried 0:1 to assist the family.
Frankly. I believe that if Ford Motor Credit Company were aware of the seriousness
of the daughter's condition, they wOIJld not press the matter at this time,
.
In any case, because of the family's situation. I intend to present a petition to the
Court asking for an indefinite stay until such time as the crises has passed and they are
more able to assist me with the trial. That will be filed within the next 2 weeks,

4. Denied. Paragraph number 11 of Defendants' New Matter is
strictly denied. After reasonable investigation the Plaintiff
believes and therefore avers that employees uf K & H Ford, Inc. did
not tell the Defendants to return the vehicle to the Dealer and
that that would satisfy their obligation. In addition, if this is
relevant and germane strict proof is demanded at the time of trial.
5. Paragraph number 12 of Defendants' New Matter is denied.
After reasonable investigation the Plaintiff is unable to determine
the truth or falsity as to what the Defendants believe and the same
is therefore denied and if relevant or material strict proof is
demanded at the time of trial,
6. Denied. Paragraph number 13 of Defendants' New Matter is
denied. After reasonable investigation the Pluintiff is unable to
determine what in fact Defendants were "not told" and if relevant
the same is therefore denied and if any responsibilitj or
obligation to so advise Defendants is material and strict proof is
demanded at the time of trial,
7. Denied. Paragraph number 14 of Defendants' New Matter is
hereby denied. This paragraph is a conclusion of law to which no
response is required.
WHEREFORE, Plaintiff requests that the New Matter be dismissed
and judgment entered in favor of Plaintiff with cost on the
Defendant.

8. Defendants responses to paragraphs 1 through 7 are incorporated herein by
reference,
9. Defendants purchased a new 1994 Ford Ranger truck, which is the subject of
Plaintiff's Exhibit "A" from K & H Ford, Inc., 6320 Carlisle Pike, Box 1177, Mechanicsburg,
Cumberland County, Pennsylvania 17055,
10, After Defendants, as a result of unexpected financial hardships, had difficulty in
making payments required on the loan for said vehicle, they contacted K & H Ford, Inc, to discuss
the matter.
11. As a result of said discussions, Defendants were told by an employee of K & H Ford,
Inc. to return the vehicle to the dealership, and that this would satisfy their obligation in full.
12. Relying upon the apparent authority of the employee of K & H Ford, Inc., which is
believed to be a franchised Ford dealership, and an agent for Ford Motor Credit Company,
Defendants returned the said vehicle to the dealership and surrendered all keys thereto.
13. At the time they surrendered the vehicle and its keys to employees to K & H Ford,
Inc,. Defendants were not told that Ford Motor Credit Company might seek to assert a claim
against them, or given any other indication that the return of the vehicle did not satisfy their
obligations inlfull. On the contrary, the apposite impression was given,
14. Ford Motor Credit Company, by permitting or acquiescing in K & H Ford, Inc. acting
with apparent authority on its behalf, is bound by the actions of K & H Ford, Inc., which accepted
said vehicle in full satisfaction of any claim against Defendants,
