DEARDORFF, WILLIAMS & OTTO. and hercby provides Defendant's counter proposal to tbe
distribution proposed in Plaintiffs Third Request IiII' Conlerence, as lilllows:
I, Plaintiff: Linda L. Maxwell. liled a two count Complaint against Dele_nliant Dennis
Crissman, Count I of the Complaint sought partition of the jointly owncd property. Count II of the
Complaint sought specilic pcrlimnancc of the March I. 1994 Agreement of Sale (hereinafter the
"Agreement"). A copy ofthis Agreement is attached hereto and incorporated herein as Exhibit "A",
2. As this case progresscd. Plaintiffclected to pursue rclicfunder Count II for specific
perlimnance of the Agreement. rather than through an action in partition under ('ountl. Sl:.I:. Orders
dated June 20, 1997 and August 28. 1997, copies of which arc attached hereto and collectively
marked as Exhibit "Il",
3, As Delendant was unable to obtain financing to buyout the Plaintil'!: this ('ourt
directed that Paragraph 9 of the Agreement be implemented, Sl.:!:. Order dated September 4. 1997.
A copy of this Order is attached hereto as Exhibit "C",
4, Paragraph 9 of the Agreement states as tilllows:
9. ANI> IT IS H!RTm:R lJNI>ERSTOOD AND AGRHD that in the case
of dflilult of payment any sum 01' interest, taxes hen~in agreed to be paid or premiums
on insurance herein agreed to be carried. IiII' the space of 30 days aileI' the same shall
become due and payable by the terms hereof. that then and in such case. this
agreement shall become null and void and the party of the lirst part sh,11I have the
exclusive right to have the property appraised and listed lilr sale, In the event that
the property is to be sold the party of the lirst part and the party of the second part
shall split the costs of sale of the property eljually and shall also split the net proc~'Cds

in escrow by Plaintiffs allorney pending resolution of the parties' respective intercsts therein,

1. THAT the said parties the first part, in
consideration of the covenants and agreements hereinafter
contained. on the part of the said party of the second part
to be kept and performed, have agreed and do hereby agree to
sell and convey unto the said party of the second part, his
heirs or assigns, all the land and premises hereinafter
mentioned and fully described, for the sum of Twenty
Thousand ($20,000.00) DOllars, to be paid as follows:

beginning on the fifteen day of March, 1994, and thereafter
on the fifteenth day of each month with the full balance due
and owing to be paid on or before the fifteenth day of

The defendant shall have thirty (30) days within which to bring current his payments in
accOldance with the agreement of the parties dated March I, 1994, and to commence the making
of regular monthly payments thereafter, In the event there is a default in any payment
thereafter, the property to be sold in accordance with paragraph 9 of the agreement of the
parties as aforesaid.

" COMES NOW the above-captioncd Plaintiff and again moves the Court to scbedule a
~
conference to resolve the remaining issues in this case,
1. For a small matter, this one has had a tonuous history,
2, On June 20, 1997, after proceedings over the preceding several mODths, this Coun
granted relief to the Plaintiff, but gave the Defendant thirty days in which to cure the arrears or
otherwise work out a resolution, Exhibit A.
3. After 110 resolution was possible, the Plaintiff requested a coqference to resolve the
iuues, but this time Defendant fmally appeared. He was also unfortuDately detained for failure
to respond to Domestic Relations orders and was jailed. However, there was a brief bearina OD
September 4, and die Court entered lID order specifically enforcing a clause in a sales aareemcm
of die ~ and diRctina that Plainlitf be given access for inspection and appraisal. Ellbibit B.
4. Since tben, the PllIintiff bas inspected the property, discovered it to be in a borrid

stale of disrepair, and obtained an appraisal by Leon D. Gerlacb, Exhibit C,
5. The appraisal cost ber $225, Exhibit D , We regard that as a cost of sale,

bave the exclusive ript to bave the property appraised and listed for sale. In the event that the
property Is to be sold [Ms, Maxwell] and [Mr, Crissman] shall split the cosrs of sale of the
property equally and sball also split the net proceeds therefrom equally. ..
7. The appraisal (Exhibit C) sbows the property to be worth $S3,OOO,
8. A neipbor, Mr. McGranahan, is willing to buy the property "as is" for $45,000,
Exhibit E.
9. Plaintiff is thoroughly disheartened at the condition of the property and, in light of
Mr, Crissman's recalcitrance and non-cooperatlon todate, believes It fruitless to order Mr,
Crissman to clean tbe mess up. She is willing to sell to Mr, McGranahan even if the $8,000
comes out of her sbare, a1thoup she feels that Mr, Crissman should bear some of the cleanup cost
If be does not c:lean the property up.
10. Plaintiff bas always asserted a claim for rental value and for cosrs, including her
auorney's fees.
11. In September, Plaintiff leamed that the prO(lCrty WI., scheduled to be sold for non-
payment 0' real estate taxes. She paid tbe 1995 taxes in the amount of $I,189,9S to save the
property from sale. Exhibit F.

McGr.n.han for $4,5,000 Mas isM and distributing the proceeds as follows, First, if Defeadant

record will more specifically rellect, plaintiff, Mrs, Maxwell, has always claimed that she
should receive rent for all the time that Mr, Crissmlln occupied the premises, resisted
resolving this maller, Ilnd did notlhe pay any of the contract sum, She has also had a claim
pending for allomey's fecs for pursuing this mailer. Finally, she claimed that she should be
reimbursed various costs. SOllie of those costs arc rellected on the HUD-1; some are not.

6. The debt to John Amsley's was Mr. Crissman's.
7. As shown by Exhihit F to Plaintiffs October 17, 1997, Request for Conference, she was
earlier compelled to pay thc 1995taxcs in the amount 01'$1,189.95 in order to keep the house
from being sold at a tax sale.
8, In addition, she has had:o pay court costs todate 01'$250,50 and an appraisal fee of$225,OO
towards which Mr, Crissman contributed nothing. The appraisal and the bi II for the appraisal

10, Plaintiff contends that defendant should be solely responsible for the taxes and water and
sewer rents because he lived in the house and enjoyed the benefits. Plaintiff is a Perry
County resident and recei ves no benefits from paying taxes on a Cumberland County
proferty.
11. In addition, plaintiff contends that dlCfendant should pay her half of the total fair rental value

of the house for the time he did not pay on the sales agreement and resisted plaintiff's efforts
to obtain any resolution of the mailer by avoiding contact with her, avoiding service, and
avoiding allcndance in court, She estimatcs the total 111ir rental value at $500 per month.
Halfofthat is $250 per month, From March I. 1994. to settlement on December 29. 1997,
is 46 months, or $11,500.
12. Finally, plaintiff contends that defendant should pay her attoll1ey's fees, wbich were
necessitated by delendant's refusal to honor the sales agreement and intransigence in
rcsolving the matter. Defendant's behavior was "dilatory, obduratc or vexatious" within the
meaning of 42 Pa.C.S, * 2503(6). for which rcason plaintiff is entitled to reasonable
allorney's fees, Plaintiffs allorney's Ices todate have been $5.015,00,
13. As a result. plaintiff suggests that the COllrt award her the following sum as a judgment:

COMES NOW Iheabove-caplioned Plainliff and again moves Ihe Court 10 schedule a
conference 10 resolve the remaining issues in this case.
1. For a small maller, this one has had a tortuous history,
2, On June 20,1997, after proceedings over the preceding several months, this Court
granted relief 10 Ihe Plainliff, bUI gave the Defendanlthirty days in which 10 cure the arrears or
otherwise work out a resolution, Exhibit A,
3, After no resolution was possible, the Plainliff requesled a conference 10 resolve the
issues, but this lime Defendanl finally appeared, He was also unfortunalely detained for failure
10 respond 10 Domestic Relalions orders and was jailed, However, Ihere was a brief hearing on
September 4, roo the Court entered an order specifically enforcing a clause in a sales agreemelll
of the parties and direcling that Plaintiff be given access for inspection and appraisal. Exhibil B.

12, Although he was residing in the house and was supposed to mainmin it and pay the
taxes, Defendant had also neglected the 1996 and 1997 taxes, which are still owed, Exhibit G,
13, Plaintiff accordingly asks the Court to approve her selling the property to Mr,
McGranahan for $45,000 "as is" and distributing the proceeds as follows. First, if Defendant
removes the junk cars and cleans up the interior by removing all of his belongings, then the full
$8,000 ~discount" to sell to Mr. McGranahan will be borne by Plaintiff. However, if Defendant
does not at least remove his belongings, trash and cars from the property, then the "discount"
should be split between them as a cost of sale, as follows:

property can be removed without liability if Mr, Crissman does not remove them, the Court's
approval of the sale to Mr, McGranahan in the amount of $45,000, and the Court's approval,f
the distribution of the proceeds as set out above,

appearing that attempts to engineer either a private sale or
sale between the parties having proved unsuccessful, paragraph
nine of the agreement between the parties is herewith

To the Honorable Kevin A. Hess:
COMES NOW the above-captioned Plaintiff and moves the Court to schedule a conference
to resolve the remaining issues in this case,
1, On June 20, 1997. after proceedings over the preceding several months, this Court
granted relief to the Plaintiff. but gave the Defendant thirty days in which to cure the arrears or
otherwise work out a resolution. Exhibit A.
2, No proposal was forthcoming from the Defendant in those thirty days nor did he
catch up the arrears,

3, On July 23, 1997, when the thirty days were up, Plaintiff's counsel wrote to
Defendant's counsel with a proposal that the parties sell the property at a private sale to a
neighbor who was willing to pay $45,000 cash. enclosing the documentation received from the
neighbor, Exhibit B, Plaintiff's counsel gave Defendant's counsel live days in which to respond.
4. Within the five days, Defendant's counsel responded indicating that although there
continued to be "communication problems between my client and myself" he would recommend

to his client that they enter into the sale provided Mrs. Maxwell would give up her claim to
$6,000. Exhibit C.
5. Plaintiff's counsel then asked Plaintiff if she would give up the claim to $6,000,
and on August 7, 1997, she replied with an emphatic "No". Exhibit D.
6. On Augustll, 1997, counsel for Plaintiff and Defendant spoke by telephone, and
it appeared that Defendant still had not communicated with his counsel and that there was no
opportunity to resolve this matter amicably and that the Court's further involvement would be
necessary. Counsel agreed that we would attempt to get a conference at which we would address
the remaining issues.
7. In the letter of July 23 (Exhibit B) Plaintiff's counsel made it clear that Defendant's
ongoing, uncommunicative intran~igence in vacating the house would cause Plaintiff to seek her
own counsel fees from the Court as a sanction.
8. Attached as Exhibit E is a six page prim out showing all of the work done since
March 20, 1996, on behalf of Plaintiff to attempt to solve this legal problem. Mrs. Maxwell has
incurred attorneys' fees of nearly $3,000 in that length of time and there is still a conference and
other steps ahead of her.

WHEREFORE, Plaintiff asks the Court to direct that a conference as contemplated by the
June 20 Order be held, that at the conference the Court issue an Order to the Sheriff removing
Mr. Crissman, that the Court approve the sale to Mr. McGranahan in the amount of $45,000 as
a private sale, Jnd that the Court direct that out of the proceeds of the sale Linda Maxwell receive
half of the net proceeds and that out of Mr. Crissman's half, she receive any costs of repair, her
attorneys' fees to date, and the. $6,000 representing the rental value during the pendency of this

of the plaintiff and against the defendant and relief in the alternative is GRANTED.
The defendant shall have thirty (30) days wilhin which to bring current his payments in
accordance with the agreement of the parties daled March I. 1994, and to commence the making ____
of regular monthly payments thereafter. In the cvent there is a default in any payment
thereafter, the property to be sold in accordance with paragraph 9 of the agreement of the
parties as aforesaid.
In the event payment is not made as above described, Ihe defendant shall have thirty (30)
days from today within which to submit to the court his plan~ for 1I privllte slIle of the real estate
located at 62 FaiIView Street, Carlisle, Cumbcrland County, Pennsylvllnia. In the event such a
plan is not forthcoming and the parties ellnnot otherwise agree concerning Ihe Sllle of said real

AND NOW, comes the Defendant, by and through his counsel. W. Darren Powell, Esquire
of MARTSON, DEARDORFF, WILLIAMS & OTTO, and tiles this petition to strike the within
matter from the trial list, based upon the following
1,--- On or about April IS, 1996, Plaintiff. by and through her counsel Jerry.&.. Philpott,
Esquire, filed a complaint in Equity to the above docket
2. Thereafter, Defendant filed his Answer and New Matter to the Complaint, which was
signed by W. Darren Powell, Esquire, of MARTSON, DEARDORFF, WILLIAMS & OTTO.
Simultaneously, an entry of appearance was tiled evidencing this representation.
3. On December 4, 1996 Plaintiff tiled a document entitled "Plaintilrs Response to
Defendant's New Matter," and served a copy on W. Darren Powell, Esquire. Subsequently, Plaintiff
withdrew her preliminary objections and served the undersigned with a copy of the Praecipe
evidencing this withdrawal.
4 Thereafter, on February 4, 1997, Plaintiff filed a praecipe listing the case for a non-
jury trial.
5 At no time on or after that date was the undersigned counsel served with the Praecipe
listing this for trial nor was counsel ever advised of such a filing.
6. I Local Rule 214-1 states: "A case shall be listed for trial only by filing a praecipe in
duplicate directing the Prothonotary to list the case for trial The party listing the case for trial shall
provide forthwith a copy of the praecipe to all counsel.

This appeal is by one of two defendanls in an
equity proceeding from a decree requiring appellant
to releWle real estale from the lien of a judgment
which she had entered against her daughter (the
other defendant); to require both defendants 10

complete the probate of the will of appellant's
deceased husband, and for an accounting. The
principal question is whether the doctrine of
equitable eSloppel was correctly applied.
Gust Rinios, the plaintiff, and Anna Tritsch, olle
of the defendants, in the presence of and with the
acquiescence of Philomena Tritsch, the other
defendant and sole appellant (mother of "'nna
Tritsch), entered into a written contract on February
27, 194~ for the sale [36, PA 129) of premises 217
Eleclric Avenue, Borough of EWlI Pittsburgh. The
consideration WWl $2~,OOO. $1,000 of which WWl
paid at the execution of the contract, and Ihe balance
WWlIO be paid al settlement fixed for June I, 194~.
Tille was to be in fee clear of all encumbrances.
The mother and daughler lesided together in an
extremely close family and financial relalion. Early
in 1943 the mother and daughter went 10 tile office
of a real estate company, and requested the manager
10 find a buyer for the real eslate al $2~,OOO.
During the two years thereafler the mother and
daughter frequently came to the real eslate office
inquiring abouI prospective buyers. Ine mother WWl
active in this sales effon. In February 194~ the
manager secured an offer of $2~,OOO, which he
submitted to both defendanls, and which WWl
accepted by them. An agreemenl of sale was
prepared and executed by the daughter in the
presence of the mother.
[I) "'n examination of title revealed a defect. The
will of Alphonse Tritsch (father of the daughter and
spoll5e of appellant) had been lodged in the office of
the register of wills and had been proven but nol
probaled. No formal pelition hWl been presented for
its probale. The necessity for probale may tbus be
staled: the daughter acquired title to the real estale
by deed from the mother. The mother and ber
busband theretofore had taken litle in their joint
names. The wife survived. Sbe assumed thaI sbe
was the sole owner Wl surviving tenanl by the
entirety. The babendum of the deed 10 the hll5band
and wife reads 'as tenants in common and nol as
joinl lenanls.' This did nol creale a lenancy by the
entirety, B1ease v. Anderson, 241 Pa. 198, 88 A.
36~, and therefore there WWl no title by
survivorship. They held lit Ie as tenants in common.
Appellant's hll5band therefore died seiled of an
undivided half inleresl or estale in the real estale.
Alphonse Tritsch died testale. Under the terms of

4. AID the said party of the second part, agrees with
the said parties of the first part, to purchase the said
premises and pay therefore the sum of Twenty Thousand
($20,000.00) and 00/100 DOllars, in the manner and at the

become due and payable by the terms hereof, that then and in
such case, this agreement shall become null and void and the
party of the first part shall have the exclusive right to
have the property appraised and listed for sale. In the
event that the property is to be sold the party of the first
part and the party of the second part shall split the costs
of sale of the property equally and shall also split the net
proceeds therefrom equally.

JOINT MOTION FOR FINAL DECREE
AND NOW, comes the Plaintiff, Linda L. Maxwell by her Attorney, Jerry A.
Philpott, Esquire, and the Defendant, Dennis Crissman, by his Attorney, W.
Darren Powell, Esquire, and finals this Joint Motion for Final Decree, of which the
following Is a statement.
1. This matter was completely resolved by the Court by two Orders, one
dated December 5, 1997 and the other dated July 24, 1998, copies of which are
attached hereto as Exhibits "A" and "B" respectively.
2. Pursuant to the Order dated December 5,1997 the property which was
the subject of this proceeding was sold to David W. McGranahan and Sharyn L.
McGranahan by deed of Dennis Crissman, Linda Maxwell and James Maxwell
dated December 29, 1997 and recorded December 30. 1997 In Cumberland
County Deed Book 170, Page 91.
3. The said purchasers, David W. McGranahan, et. ux., have now
contracted to sell the subject property to a third party, Todd S. Benlck. et. ux.
J. The title search for Todd S. Benick, et. ux., showed this equity action
as outstanding.
5. The attorney for Todd S. Benlck was advised by the Cumberland
County Prothonatary Office that a final decree would be required In order to show
this equity action as closed and that the normal procedure would then be for the
recording of that final decree In the Cumberland County Recorder's Office.
6. The attorney for Todd S. Benlck, et. ux., has requested that the Plaintiff
and Defendant obtain such a Final Decree for recording.
7. All of the matters outstanding concerning this case, Including the
distribution of the net proceeds of sale pursuant to the Court's Order dated July
24, 1998, have been completed.
WHEREFORE, the Plaintiff and Defendant, by and through their attorneys.
