Plaintiff, Edythe B. P"tsy, is a persona ot the full age of majority and resident at Carlisle, Cumberland county, Pennsylvania, 2 . Detendant, Weis Markets, Inc, , is a corporation authorized to do and doinq business in Pennsylvania, owning and operating severai grocery stores, the one in question located in Carlisle, Cumberland county, Pennsylvania. ], On or about April 21, 1994, Plaintiff was a customer of the Defendant, shopping at its Carlisle store. 4. Plaintiff attempted to remove two bottles of detergent from cases ot detergent on display, that were stacked very high, almost to the ceilinq. The bottles of deterqent remained in the cases, ~nd the cases wer(! Ht~lcked on top of each other. 5. As Plaintiff attempted to remove two of the bottles from the display that were within her reach (at or about shOulder level), several of the bottles or boxes of detergent from higher levels on the d i'~play co Ildpsod on her, striking her at various places ,of her body, incluelinq her head, neck, shoulders, back and legs. l07444/JKW 6, Plaintitt suttered multiple injuries as a result of being struck by the detergent bottles, "nd/or boxes, including but not limited to, muscular "nd ligamentous strains to her neck, shoulders, back, upper and lower extremities, and has suffered from chronic headaches since bein'l struck on and about the head and shoulders, has suffered memory loss, developed a nodule on her tht'oat, as we 11 as hilving experienced an aggravation of pre-existing arthritic conditions as well as other medical complications and thoir sequela. 7. Plaint if t bel il've9, ilnd therefore avers, that the constructed in 'Juch ,I way t'lat .lllowed bott Ie,; and/or their boxes to filll from its upper l~velB when a customer removed bottles of deterge~t t 1'0111 one 0 f ttlP Cd rtons with i n rench, ;.> 10, Plaintiff further believes, and therefore avers, that Defendant breached its duty of reasonable care to her, thereby causing all of her injur~es and damages, by negligently designing, constructing, stocking, inspecting, and maintaining the detergent display in such a way that she could not reach those bottles of detergent at the top and higher levels of the display, thereby inviting and requiring her to remove bottles from a level within reach, which had the unanticipated result of causing the upper level containers to fall on her, thereby causing her injuries. 11. Plaintiff therefore alleges that Defendant was negligent in the design, construction, stocking, inspection, and maintenance of the aforesilid display, and in its failure to warn her of the danger, which was known or should have been known to the Defendant prior to Plaintiff's accident. This failure to warn Plaintiff caused or contributed to the cause of Plaintiff's accident and injuries. 12. As a direct and proximate result of being struck by Defendant's detergent containers from Defendant's detergent display in Defendant's store, Plaintiff suffered multiple injuries whiCh required medical attention. 13.
