specification: the settling of all matters between them relating
to the ownership and equitable distribution of real and personal
property; settling of all matters between them relating to the
past, present and future support, alimony and/or maintenance of
WIFE by HUSBAND or of HUSBAND by WIFE; and in general, the
settling of any and all claims and possible claims by one against
the other or agalnst their respective estates,
NOW, THEREFORE, in consideration of the premises and of
the mutual promises, covenants and undertakings hereinafter set

or dwell with him pr her by any legal or othllr proceedings, The
foregoing provisions shall not be taken to be an admission on the
part of either HUSBAND or WI!;'!,: of the lawfulness or unlawfulness
of the causes leading to their living apart,
2. INTERFERENCE: Each party shall be free from
interference, authority, and contact by the other, as fully as if
he or she were single and unmarried, except as may be necessary
to carry out the provisions of this Agreement. Neither party
shall molest the other or attempt to endeavor to molest the
other, nor compel the other to cohabit with the other, or in any
way harass or malign the other, nor in any way interfere with the
peaceful existence, separate and apart from the other, and each
of the parties hereto completely understands and agrees that
neither shall do or say anything to the children of the parties
at anytime which might in any way influence the chl}dren
adversely against the other party, it being the intention of both
parties to minimize the effect of any such separation upon the
childr.en.

condone and shall not be deemed to be a condonation ~n the part
of either party hereto of any act or acts on the par: of the
other party which have occasioned the disputes or u~~appy
differences which have occurred prior to or which mo} occur
subsequent to the date hereof,
4, SUBSE~UENT DIVORCE: The part ies hereby 2:knovlled:]e
that Wi fe has filed a Complaint in Divorce in Cumber:and County
to Docket No. 96-20'/~, claIming that the marriage l.~
irretrievably broken under Section 3301(c)of the Pe~~sylvania
Divorce Code. HUSBAND hereby expresses his ilgreemen: tha't the
marriage is irretrievably broken ~nd expresses his :~tent to
execute any and all Affidavits or other documents n'S.:essary for
the parties to obtain an absolute divorce pursuant :~ Section
3301 (c) of the Divorce Code at the same time as he CH)CL:tes this

6. EFFECTIVE DATE: The effective date of this Agreement
shall be the "date of execution" or "execution date," defined as
the date upon which it is executed by the parties if they have
each executed this Agreement on the same date, Otherwise, the
"date of execution" or "execution date" of this Agreement shall
be defined as the date of execution by the party last executing
this Agreement.
7. DISTRIBUTION DATE: The transfer of propErty/ funds
and/or documents provlded for herein, shall only tak0 place on
the "distribution date" which shall be defined as t~e date of

nature arising or which may arise under thls Agreem(!nt or for the
breach of any provIsions thereof, I t is the intention of HUSBAND
and WIFE to give each other by the execution of this Agreement a
full, complete and general release with respect to any and all
property of any kind or nature, real, personal or mixed, which
the othcr now owns or may hereafter acquire, except and only
except all rights and agreements and obligations of whatsoever
nature ariHlng or which may arise under this Agreement or for the
breach of any provision thereof. It is further agreed that this
Agreement shall be and constitute a full and final resolution of
any and all claims which each of the parties may have against the
othcr for equit.able division of property, alimony, counsel fees
and expcnses, alimony pendente lite or any other claims pursuant

or improper or illegal agreement or agreements: The parties
further acknowledge that they have each made to the other a full
accounting of their respective assets, estate, liabilities, and
sources of income and that they waive any specific enumeration
thereof for the purpose of this Agreement. Each party agrees
that he or she shall not at any future time raise as a defense or
otherwise the lack of such disclosure in any legal proceeding
involving this Agreement with the exception of disclosure that
may have been fraudulently withheld,
10, WARRANTY AS TO EXI~~G OBLIGATIONS: Each party
represents that they haVE' not' heretofore incurred or contracted
for any debt or liability or obligation for which the estate cf

11, WARRANTY AS TO FUTURE OBLIGATIONS: HUSBAND and WH'E
covenant, warrant, represent and agree that with the exception of
obligations set forth in this Agreement, neither of them shall
hereafter incur any liability whatsoever for which the estate of
the other may be liable. Each party shall indemnify and hold
harmless the other party for and against any and all debts,
charges and liabilities incurred by the other after the execution
date of this Agreement, except as may be otherwise specifically
provided for by the terms of this Agreement.
12, ,PERSONAL PROPERTY: The parties have divided between
them, to their mutual satisfaction, the personal effects,
household furniture and furnishings, and all other articles ot
personal property which have heretofore b,!Nl IIsed by them in
common, and neither party will. make any claim to any such items
which are now in the possession or under the control of the
other, Should it become necessary, the parties each agree to
sign any titles or documents necessary to give effect to this
paragraph upon request,

complete, WIfE hereby covenants and agrees to assume and pay in
full the remaining balance of the first and second mortgages now
exi.sting and presently constituting liens upon ilnd encumbering
'the same premises, such mortgages being owed and payable to First
Federal and further covenants and agrees thnt she will indemnify
and save HUSBAND harmless from any and all liability, expense,
cas t, or loss whatsoever as a resul t of her non-payment 0 f or
non-performance of said mortgage and said mortgage conditions,
14, IlbHK ACCOUNTS: HUSBAND and WIFE acknowledge that
they each possess certain bank accounts and the like in their
respective nnmes. They hereby agree that each shall become sole
owner of their respective accounts and they each hereby waive any
interest i.n, or claim to, any funds held by t.he oth<:!' in such
accounts. Specifically, HUSBAND shall retain the IB~ Credit
Union accounts which BAistcd ilt the date of separation.

further agrees that he shall have no further claim cr interest in
the aforementioned bonds and agrees that he will not assert any
such claim in the future.
16. PENSIONS. ANNUITIES AND/OR RETIREMENT BENEFITS: WIFE
agrees that any monies which HUSBAND has acquired U:rough his
interests in either pensions, profit sharing, savings and trust
plans, annuities and/or retirement benefits through his present
or past employers shall remain his sole and exclusi':e property,
WIFE hereby covenants and agrees that she will exec~:e any
spousal waivers that may be required under the Pens:~n Reform Act
of 1974, the Re';iremEmt Equity Act of 1984, or any dmJ.lar
Federal or state statute that is now in effect or maj be enacted,
Nothing herein shall be deemed to waive WIFE's Social Security
riqhts. This paragraph iH intended to substitutE? fc" any other
statement, prepared form, or document which might b~ required by
any plan, fund, trust, administrator, trustee, or s::nilar entity
or person, so that HUSBAND may receive said benefit5 as if the
parties were never married.

form of benefit and a qualified pre-retirement survivor annuity
form of benefit under any plan of deferred compensation to which
Section 401 (al Ill) (8) of the Internal Revenue Code of 1986 (The
'Code) and/or Section 20:>(b) (1) of the Employee Retirement Income
Security Act of 1974 (ERISA) shall apply in which HUSBAND
currently or hereafter may be deemed a vested participant within
the mean.ing of Section 417 (f) (1) of the Code and Sect.ion
205(h) (1) of ERISA, WIFF', further consents to HUSBAND's current
and future designation of any alternative form of benefit and of
beneficiaries other than WIFE under any of such planls) and to
any revocation and/or modificatlon of such designatlon Is)
including any of such plans referred to in Section
401 (a) (11) (B) (iii) of the Code or. Section 205(b) (1) Ie) of ERISA,
WIFE hereby further agrees to ~xccut0 any an4 all documents or
forms which shall be requ.ired, at any time, and from time to

consents required by Section 417(a) (2) of the Code or Section,

her consent to the designation by HUSBAND of a specific
beneficiary or a specific form of benefits, and WIFE hereby
voluntarily elects to relinquish both such rights.
18, LIFE INSURANCE I WIFE is cogni zant of the fact that
HUSBAND has maintained and paid pr.emiums on a life insurance
policy, WIFE hereby expressly relinquishes, waives and renounces
any and all proprietary, statutory, distributional, and
beneficiary rights and options to the aforesaid insurance policy,
WIFE herewith agrees and warr.ants that HUSBAND has full and
complete discretion to change the designated beneficiaries on the
aforesaid policy and to exercise any and &11 additional rights he
may have as owner of the policy.
19, MOTOR VEHICLES: With respect to the mota r vehicles
owned by one or both of the parties, they agree as follows:

payments shall terminate upon th,e f,irst to occur of the fOllowing
flvents: WIrE's remarrIage, WIFE's cohabitat.ion, WIFE's death,
HUSBAND's death, or October 31, 2000, 'I'hese payments are
intended to be included in WIrE's income and deducted from
HUSBAND's gross income pursuant to Federal tax laws, WIE'E agrees
that all of the said payments shall be included as income in her
applicable tax return and she shall pay such taxes as may be
required by reason of such inclusion, 'I'he parties further agree
that they specifically intend this amount to be non-modifiable by
either party.
23, CQUNSEL FEES: Except as providc,d herein, each party
hereby Indemnifies and agrees to inUemnify and hold the other
harmless against the claims of any attorney or person who
rendered or claims to have rendered services to him or her in
connectiOn with the divorce proceedings and the negotiation of,
this Agreement or otherwise.

misrepresentations or failures to disclose the nature and extent
of his or her separate Income on the aforesaid joint returns,

and applicability of the Deficit Recluction Act of 198~

26, W""IVER ':IF ALIMONY: HUSBAND and WI FE recognize and
acknowl~dge that the foregoing provisions for their individual
benefit are satisfactory with regard to their support and
maintenance, past, present and future, The parties release and
discharge the other absolutely and forever for the rest of their
lives from all claims and demands, past, present or future, for
alimony or for any provision for support or maintenance, except
as specifically provided for herein. The parties further
acknowledge that in consideration of the transfers made herein

demands they may now have or hereafter have against the other for

29, WAIVER OF CLAIMS: Except as' herein otherwise
provided, each party may dispose of his or her property in Bny
way, and each party hereby waives and relinqllhhes any and all
rights he or she shall now have or hereafter acquire, under the
present and future laws of any jurisdiction, to share in the
property or the estate of the other as a result of the marital
relationship, including without limitation, dower, curtesy,
statutory allowance, widow's allowance, widower's allowance,
right to take in intestacy, ri,qht to take against the Will of the
other, and the right to act as aclministrat<H or exeCl,ltor of the
other's estate. Each party will, at the request of the other,
execute, acknowledge and deliver any and all instruments which

30. ENTIRE AGREEMENT: This Agreement contai ns the entire
understanding of the parties and therp. are ~o representations,
warranties, covenants or undertakings other than those expressly
set forth herein,
31, FINANCIAL DISCLOSURE: The parties confirm that they
have relied on the completeness and substantial accuracy of the
financial disclosure ot the other as an inducement to the
execution of this Agreement. The parties acknowledge that there
has been no formal discovery conducted in their pending divorce
action. Notwithstanding the foregoi"g, the rights of either party
to pursue a claim for equitable distribution, pursuant to the
Pennsylvania Divorce Code, of any interest owned by the other
party ill an dS:iet of any nature at any time prior to :he date of
execution of this Agreem,mt that was not disclosed tc the other
party or his or her counsel prior to the date of the within

dated May 31, 1996, the full-time Master has been appointed in
the above referenced divorce proceedings.

Present for the Plaintiff, Nancy EiChelberger, was
attorney Laurie A. Saltzgiver, and present for the Defendant,
Douglas Eugene EiChelberger, was attorney Maria p, cognetti,
A divorce complaint was filed on April 16, 1996,
raising grounds for divorce of irretrievable breakdown of tho
marriage, Counsel advised that the parties will sign and file
affidavits of consent prior to the hearing to be scheduled so
that the divorce can be concluded under Section 3301(c) of the
Domestic Relations Code.
The divorce complaint also raised tho economic
issues of equitable distribution, alimony, alimony pendente
lite, and counsel fees and expenses.
with respect to the alimony claim, counsel have
indicated that there may be an issue with respect to marital
misconduct involving husband's alleged relationship with a
female friend prior to the parties' separation, Therefore, we
will schedule a separate hearing on that issue.
The parties were married on June 23, 1979, and with
respect to the date of separation there is an iSBue that the
parties separated either in 1990 or 1991. Counsel for wife
avers that the parties separated on April 4, 1991, and coun.el
for husband avers the parties separated in 1990. In any event,
we will also take testimony at the same timo we have the he.rln9
on the marital misconduct issue, on the matter of dotermlnln9
when the parties separated. The date of separation Is relevant
specifically with respect to the valuation at husband'. pen.lon

The parties are the natural parents ot two
children, Daniel L" born November 8, 1980, and Becky Jo, born
June 22, 1982, There has been a concern about Daniel'. health.
He may have a muscle disease which has not yet beon diagno.ad
which may atfect his long term health situation.
Husband is currently paying spousal support per
month in the amount of $365,00 and child support for the two
Ghildren in the amount of $726,00, The support is being paid
through the Cumberland county Domestic Relations Office.
Wife is 38 years of age and resides at 440 County
Line Road, York springs, Pennsylvania, with the two children.
She is a high school graduate and works for the Pennsylvania
Supreme Court, Pennsylvania Board of Law Examiners. Her 1995
income tax return showed an annual gross of around $20,000.00.
Wife had a stroke a few years ago but seems to be doing well
health wise at the present time. Counsel are going to determine
if she will have medical insurance benefits through her employer
upon the entry of a divorce decree. If not, we are fairly
certain that she will be entitled to COBRA benefits through IBM
but we need to know the cost of those benefits.
Husband is 44 years of age and resides at 1155
Rhoda Boulevard, Mechanicsburg, Pennsylvania. He lives with a
female friend, Husband has a high school education and counsel
is going to inquire as to whether or not he has any advanced
training or degrees. Husband is employed with IBM as a customer
engineer and according to wife's estimate, including bonus
income, husband's annual gross for 1996 will be $53,000.00,
His W-2 for 1995 which was attached to his income and expense
statement showed income of $49,466,00, Husband has not raised
any health issues,
The parties own real estate at 440 County Line
Road, York Springs, Pennsylvania, where wife is residing. A
market analysis on the property shows a range in value on the
property from $121,500.00 to $138,500,00, That analysis was
done by Vernon Anderson, Another market analysis shows a range
of $119,000.00 to $125,000.00, Counsel have pointed out that
the home is heated by wood and there are probl.ems with the
septic system and well. Counsel for husband intends to have
the property appraised by a certified appraiser and that
appraiser will be instructed as to the problems raised by wife
so he can take those issues into account in arriving at a market
value. Also on the property is a pool which counsel need to
specifically advise whether or not the pool will be considered
in the appraisal or as a separate asset of personal property
which can be removed. There is a loan balance owing for the
pool of around $2,700.00 - $2,800.00, The pool loan is secured
by a lien in favor of First Federal. Counsel indicated that the
amount payable on that loan monthly is between $119.00 and
$170,00,
The mortgage on the property is with First Federal
and the balanoe on the mortgage is around $30,680.00. The
mortgage payment is $349.00 per month. The mortgage payment
does not include real estate taxes and insurance.
wife traded the parties' 1985 Mercury Marquis on a
1990 Ford Tempo which she currently uses as her vehicle.
Counsel need to determine the amount of trade-in that wife
received for the Marquis to place a value on that Marquis for
purposes of equitable distribution,
Husband has a 1994 Ford pickup truck and husband's
valuation, exclusive of any lien due and owing, is $4,950.00.
Wife will review that value to determine whether or not she can
agree and stipulate to the $4,950.00 value.
Around separation there was a checking account and
a savings account with the IBM credit union and counsel for wife
would like to have verification of tile date ot Bepdrdtion
balances on those accounts, The money in those accounts has
been estimated by husband to be around $350,00 total which
husband retained.
Husband claims that there are around $~OO.OO worth
of United states savings bonds and counsel for wite is going to
inquire of her client about the bonds and the value.
Husband is a participant in a pension plan with his
employer. Ms, Cognetti did a valuation of the pension based on
a computer program which she recently acquired showing a marital
value of $14,347,00, The percentage of the plan which is
marital according to Ms, cognetti is 56%, Attorney Saltzgiver
can do her own evaluation and we can determine if counsel can
agree as to the present value after that evaluation is
completed, Ms. Cognetti will provide Ms, saltzgiver with a copy
of her computations and report.
Husband also participates in a tax deferred saving
account and a IBM personal retirement provision. wife would
like to have a release from husband allowing her to obtain
information about those accounts. Husband claims both accounts
were nonmarital, Wife claims that at separation there was
$1,200.00 in the tax deterred savings account.
The household tangiblo personal property has not
been appraised and counsel may have an appraisal done since wife
has placed a value on that tangiblo personal property at
$2,500.00 and husband has not 9uggosted a value tor that
property, Husband indicatod ho would llko to have a bucket
full of cement which wife claims ho h~s already received and a

a stroke on May 18, 1996, Wife was off work for approximately
two weeks as a result of this stroke. For the most part, she is
now back to work full-time, however, she experiences a lot of
fatigue, and has to cut her work day short on occasion, The wife
is employed as an administrative clerk with the pennsylvania
Board of Law Examiners. She is current ly undergoing further
medical testing to determine the cause of the stroke, but little
is known at this time.
The parties' son, Daniel, is also experiencing medical
problems, at this time. He has a muscle disease, and is
currently undergoing testing and treatment at Hershey Medical
Center. Additionally, the son currently sees and has been seeing
a counselor to help him deal with issues regarding his parent's
separation and divorce. All of these physical and emotional
health care related problems have caused an additional financial
burden upon the wife.
The wife has resided in and maintained the marital residence
since the parties' separation. She has made all paym~nts on the
mortgage, and the pool loan against the residence. The wife has
conducted extensive repairs to the residence with the major
repairs totalling approximately $8,000.00. Numerous repairs
continue to be necessary to maintain the residence, which need to
be completed at this time. There is presently a problem with the
septic system, which needs to be corrected in the ,near future.

Wife intends to introduce exhibits regarding the counsel
fees which she has incurred. Wife also requests an advance on
counsel fees from the husband for appraiser and actuarial costs.

V. INCOME: Delendan: is employed by IBM. His gross wages for 1995 were
$49,466.55 as conlirmed by a copy of his 1995 W-2 statement which is attached as
Exhibit "A". Also attached hereto and marked as Exhibit "8" is a copy of his 1995
Federal Income Tax Return. See attached Exhibit "Cn, recent paystubs. for year to date
income,
