2. The owners or rogistered ownors of tho promises at which the Claimant
supplied materials and labor aro Dennis E. Moyer, Sr, and TOlllmie Meyer alkla Tamero
S. Meyer, adult individuals who roslde at 1 Pine Hill Avenue, Mechanicsburg,
Cumberland County, Pennsylvanio,
3. The Cleimant contracted with Owners for the construction, erection,
completion of en addition on the Owners' residence and vOl'ious other improvements
in and about said residence located at 1 Pine Hill Avenuo, Mechanicsburg, Cumberland
County, Pennsylvania. A copy of sold Contracts dated October 27, 1995 are attached
hereto and incorporated heroin as Exhibit" A".
4. For said work to be done pursuant to Contracts the Owners agreed to
pay Claimant the total sum of $35,960.13,
5. The nature and kind of materials lurnished by Claimant to the aforesaid
project consisted of various building materials and labor involved in installing the
same, which are more specifically described on the Invoice attached hereto as Exhibit
"Bit,
6. The amount claimed to be still due and chargeable against the premises
hereinbefore referred to is $15,626.98. This dollar figure represents the charges for
work performed, less payments on account. The Claimant has no note or other
collateral security for his claim.
7. The materials ond labor were furnished by the Claimant on or about
October 27, 1995 through on or about December 20, 1995, with the last materials
and labor being furnished on or about December 20. 1995.

B. Denied. It is specifically denied that the Plaintiff has failed to perform his
work in e workmanlike manner, and proof to the contrary is demanded in the trial of
this matter.
9. Denied. For the reasons set forth in response to Paragraphs 6, 7 and B,
it is denied that the Plaintiff has failed to complete certain remaining work that was
provided for in the contract. The Plaintiff stood ready, willing and able to complete
the contract so long as Defundants were prepared to comply with their obligations
under the terms of the contract and were not hindering, thwarting and interfering with
the Plaintiff's attempts to complete the contrnct,
10. Denied. The allegation set forth in Paragraph 10 is a conclusion of law
to which no responsive pleading is required, however, to the extent The Honorable
Court deems the response necessary, the Plaintiff denies that there is a failure of
consideration and proof to the contrary is demanded at the trial in this matter.
11. Denied. It is denied that the Defendants have already paid Plaintiff an
amount which far exceeds the value of Plaintiff's work and material. To the contrary,
the contract is substantially completed, however, the Defendants have only paid
approximately one-half of the balance due under the terms of the contract.
12, Denied. It is denied that the Plaintiff installed substandard and/or
defective materials in Defendants' home and proof to the contrary is demanded at the
trial in this matter,
13. Denied, It is denied that the Plaintiff coerced payments from the
Defendants. To the contrary, the Plaintiff submitted draw statements and requested
payment in the normal course of events pursuant to the terms of the contract. Proof
to the contrary is demanded at the trial in this matter,
14. Denied, It is denied that the Plaintiff misrepresented the status of the
project in requesting payments from the Defendants. Proof to the contrary is
demanded at the triol in this matter.
15. Denied. It is denied that the Plaintiff installed materials that were
deteriorated, altered, reconditioned, reclaimed and/or used and proof to the contrary
is demanded at the trial in this matter. By way of further answer, Plaintiff also wishes
to point out that the contracts do not specifically indicate that the matarials must be
original and/or new. As indicated in response to Paragraph 12, it is denied that any
of the materials installed by the Plaintiff were substandard and/or defective.
16, Denied, For the reasons set forth in response to Paragraphs 12 and 15,
the allegation set forth in Paragraph 16 is denied and proof to the contrary is
demanded at the trial in this matter.
17. Denied. The allegation set forth in Paragraph 17 is vague since it does
not state the "particular standard and quality" that the Plaintiff purportedly represented
his services to be. The contract provides that all work is to be completed in a
"workmanlike manner according to standard rractices" and Plaintiff avers that all of
its work was performed in a workmanlike manner and proof to the contrary is
demanded at the trial in this matter.
18, Denied, The allegation set forth in Paragraph 18 refers to the terms of
a "written guarantee" given to the Defendants. however, other than the terms set
forth in the contract, which is attached to the Complaint as Exhibit" A", the Plaintiff
is unaware of any other "written guarantee" and the Plaintiff demands proof of the
same.
19. For the reasons set forth in response to Paragraphs 6 through 18,
specifically Paragraph 17, the Plaintiff denies that any of the repairs and improvements
that the Plaintiff made upon Defendants' property were of a nature and quality inferior
to or below the standards agreed to in writing, which Plaintiff assumes is referring to
the contract identified as Exhibit" A" to the Complaint. Proof of inferior work is
demanded at the trial In this matter.
20. Denied. The allegl:ltion set forth in Paragraph 20 is a conclusion of law
to which no responsive pleading is required, however, to the extent that The
Honorable Court deems a response necessary, the Plaintiff denies that he has in any
way breached the terms of the contract for the reasons set forth in response to
Paragraphs 6 through 19 and proof to the contrary is demanded at the trial in this
matter.
21. Denied. The allegation set forth in Paragraph 21 is a conclusion of law
to which no responsive pleading is required, however, to the extent that The
Honorable Court deems a response necessary, the Plaintiff denies that his action.
violate the Unfair Trade Practices and Consumer Protection law, By way of further
answer, the Defendants do not specify what proviSions and sections of the Unfair
Trade Practices and Consumer Protection law the Plaintiff has purportedly violated
and proof of the same is demanded at the trial in this matter.
22. Denied. The contracts in question provide for a total contract price in the
amount of $35,960.13, There IS nothing in the written contracts that indicate that
Plaintiff Is to stop work when the charges for his work reached $18.913.93. This is
contrary to the terms of the contract and is also contrary to the Defendants' other
allegations that the Plaintiff has failed to complete tha work contracted for. Plaintiff
requests proof of the allegations set forth in Paragraph 22, including the allegation that
Plaintiff's claim is barred by the doctrine of estoppel.
23. Denilld. It is denied that Plaintiff provided any work of poor quality and
supplicd substandard or defective materials on the project and, hencc, the allegation
set forth in Paragraph 23 is denied and proof of the same is demanded at the trial of
this matter. By way of further answer, the Plaintiff also asserts that the Defendants'
allegation is vague since it does not indicate what portions of the contract involved
poor quality work and substandard material and the allegation further does not indicate
the dollar amount of any expenses incurred or estimates obtained to address the
allegedly poor quality work or defective materials.
24. Denied, For the reasons set forth in the response to Paragraph 23. the
allegation set forth in Paragraph 24 is denied and proof of the same is demanded at
the trial in this matter.
25. Denied. For the reasons set forth in response to Paragraph 23. the

Dear Mr. and ~frs, ~feyer:
When ~Ir. Vasquez dropped off the <Stimate at our office on October 27, 1995,
I don't believe much ~as said except thank you. The amount of your mortgage was
already determined, but the cash available was not known b~cause the attorney
who handled the clcsing \,'as in ch,nge of getting the mortgage, taxes, etc. together.
It turned out there was $18,913,93 left over for home improvements. We
advised you to tell 1st Class to spend $9000 doing whatever was necessary to get
ready for the siding installation, and when the $9000 was used up to stop. The
remainder was released as twO separate checks to complete the exterior of the
home (see contract for $8748.73).
We advised you that when this had been done we would have the house reapp-
raised and if there was enough equity we would consider a second mortgage to com-
plete the contract with Class I. Mr. Vasquez called repeatedly and WI kept telling
him that we could do nothing until after the reappraisal. When it came back at
only $102,000 I was disappointed for you because you would have to try and finish
up room by room instead of getting it over with. r. also could have used another
loan.
I never indicated to you or Mr, Vasquez that the loan was approved for the
completion of the entire contract, Loan approval was always contingent on the
second appraisal.
I have enclosed a copy of the second appraisal as it appears it may be of
some use to you if Nr. Vasquez pursues his threat to'sue.

12. plaintiff installed substandard and/or defective
materials in Defendants' ho.e.
13. The Plaintiff used the incomplete status of the project
in an attempt to coerce, and, in fact did coerce, the Defendants
into making additional payments.
14. The Plaintiff knowingly misrepresented the status of the
project in reque"ting payments from Defendants.
15. It is believed, and therefore alleged, that Plaintiff
installed materials that were deteriorated, altered, reconditioned,
reclaimed and/or used or secondhand in Defendants' home while
Defendants bargained for, were chargee;! for, and have paid for
original or new materials.
16. Plaintiff represented that materials installed in
Defendants' home were original or new when, in fact, much of the
material was reconditionee;!, reclaimed, used or secondhand.
17. Plaintiff represented to the oefendants that its services
were of a particular standare;! ane;! quality when, in fact, they were
less than the standard ane;! quality represented.
18. Plaintiff failed to comply with the terms of the written
quarantee given to the Defendants.

19. Plaintiff made repair. and improvement. on Detendanta'
real property ot a nature and quality interior to or below the
atandarda agreed to in writing.
20. Plaintiff'. actions, a. described herein, conatitute
breachea of contract.
21. Plaintift'. action., a. described herein, violate the
Untair Trade Practice. and Consumer Protection Law.
22. Plaintiff knew that he was to stop all work on the
Defendants' home when the charges for his work reached $18,913.93,
but failed to do 80. Plaintitf's claim i8 barred by the doctrine
ot estoppel.
23. Because of Plaintiff's poor quality ot work and u.e ot
.ubetandard and/or defective materials throughout the project, the
Detendants have incurred, or will incur, expenees in hiring
difterent contractors and purchasing the proper quality material..
24. It i. believed, and therefore averred, that the coat. in
completing and/or repairing the Plaintitt '. contract work will
exceed the amount claimed to be due by the Plaintift in ita
Mechanic'e Lien Claim.

2. The owners or registered owners of the premises at which the Claimant
supplied materials and labor are Dennis E. Meyer, Sr. and Tammie Meyer a/k/a Tamera
S. Meyer, adult individuals who reside at 1 Pine HIli Avenue, Mechanlcsburg,
Cumberland County, Pennsylvania.
3. The Claimant contracted with Owners for the construction, erection,
completion of an addition on the Owners' reaidence and various other Improvements
In and about said residence located at 1 Pine HIli Avenue, Mechanicsburg, Cumberland
County. Pennsylvania. A copy of said Contracts dated October 27, 1995 are attached
hereto and incorporated herein as Exhibit" A",
4. For said work to be done pursuant to Contracts the Owners agreed to
pay Claimant the total sum of $35,960.13.
5. The nature and kind of materials furnished by Claimant to the aforesaid
project consisted of various building materials and labor involved in installing the
same, which are more specifically described on the Invoice attached hereto as Exhibit
"B",
6. The amount claimed to be still due and chargeable against the premises
hereinbefore referred to is $15,626.98. This dollar figure represents the charges for
work performed. less payments on account, The Claimant has no note or other
collateral security for his claim,
7, The materials and labor were furnished by the Claimant on or about
October 27. 1995 through on or about December 20, 1995, with the last materials
and labor being furnished on or about December 20, 1995,
