On or about November 1, 1994, Akins entered into a contract with the Central Fulton School District located in McConnellsburg, Fulton County, Pennsylvania to perform certain heating, ventilating, and air conditioning construction work for the addition and alterations to the McConnellsburg Elementary School located in McConnells/;)urg, Fulton County, Pennsylvania (hereinafter referred to as the "Project"). 5. As required by the Pennsylvania Public Works Contractors Bond Law of 1967 (8 PS S 191 et seq.) Akins entered into a Contractors Bond with Washington, a copy of which Bond is attached hereto as Exhibit "A". 6. On or about December 23, 1994, Akins entered into a contract with JCI, wherein JCI undertook to supply labor and materials for the automatic temperature control system of the project, the terms and conditions of which contract are more fully set forth in the Purchase Order attached hereto as Exhibit "B" 7. Through and including December 23, 1995, JCI supplied labor and materials for the Project in a good and workmanlike manner, and billed Akins for the labor and materials in the total contract amount of $106,050.00. 8. Through and including October 13, 1995, Akins paid to JCI the sum of $72,184.86, leaving a balance due and owing on the contract price in the amount of $33,865.14. 9. I t;;; b ,0 .j c.n U , Contractors, Inl:. specifically denies that Johnson Controllnc, has supplied Akins Brothers Mechanical Contractors, Inc. with all of the labor and materials for which Johnson Controls Inc, has tilled Akins Brothers Mechanical Contractors, Inc. Akins Brothers Mechanical Contractors, Inc. admits that it was billed for the full contract price and that it has refused to pay Johnson Controls, Inc. the remaining amount due on the contract in the amount of $33.865.14, 18. Denied. Akins Brothers and Mechanical Contractors Inc, specifically denies that 90 days has elapsed since the date that the last labor and materials were performed and furnished for the project by Johnson Controls, Inc. By way of further answer, Akins Brothers Mechanical Contractors Inc, aver that Johnson Controls, Inc. provided labor and materials to the project in November and/or December of 1996, 19. The averments set forth in Paragraph 19 of Plaintiffs Complaint is a Conclusion of Law to which no answer is required, However. if this Honorable Court requires an answer. Defendant Akins Brothers Mechanical Contractors specifically denies that Washington International is obligated to Johnson Controls, Inc. in the amount of the unpaid billings, to wit: $33.865.14. Akins Brothers Mechanical Contractors, Inc. has not received full payment of the contract price from the project owner. 22. Under the terms and conditions of the contract. Akins Brothers Mechanical Contractors Inc. is not obligated to pay Johnson Controls. Inc.. the sum demanded. to wit: $33.865,14. until payment is recieved from the project owner, 23. The Purchase Order contains a condition precedent to Akins Brothers Mechanical Contractor's Inc. obligation to pay Johnson Controls, Inc. 24, Akins Brothers Mechanical Contractors. Inc. avers that the condition precedent has not occurred. 25. Johnson Controls. Inc. has failed to provide all labor and materials to the project as required by the Purchase Order set forth as Exhibit "B" of Plaintiffs Complaint. 26. As of the tiling of Plaintiffs Complaint. Plaintiff had not fully performed under the terms and conditions of its contract. 27, Plaintiff provided labor and materials for the project. as required under the terms and conditions of its contract. during the months of November and/or December of 1996, 28. Requisition # 13 for payment to Akins Brothers Mechanical Contractors, ; Inc. from the project owner for the amount due Johnson Controls, Inc. was submitted to the project owner on January 3, 1997.
